ED raids close aides of suspended Invest UP boss in graft case

Lucknow: The enforcement directorate (ED) on Thursday conducted multiple raids in Lucknow at premises linked to Nikant Jain, a close associate of suspended Invest UP CEO Abhishek Prakash, in connection with a money laundering probe related to alleged commission demands for approving a solar power project.

According to officials, ED teams accompanied by paramilitary forces searched the residences of Nikant Jain in Viram Khand, his associate Saurabh Seth in Vishal Khand, and a hotel in Niralanagar.
These raids were carried out under the Prevention of Money Laundering Act (PMLA) and yielded several incriminating documents which are being analysed. The ED is probing whether a Rs2.5 crore cheque issued by Rajendra Singh to Jain was a disguised bribe for securing official clearance for a solar project.
Singh reportedly told investigators that the cheque was issued for purchasing a property from Jain but was unable to provide any concrete details regarding the transaction, raising further suspicion.
During the raids, Saurabh Seth, who is listed as a director in one of Jain's firms, claimed he was initially an employee and was later made director. However, ED officials discovered that Seth is listed as a director in at least five companies, including two directly linked to Jain.
At the time of the raid, Jain's wife was present at the residence but denied any knowledge about her husband's business operations.
ED officials seized documents from both the residence and Jain's office. Raids and questioning continued till late Thursday night. Jain was previously arrested by the Lucknow police in connection with a bribery case where a 5% commission was allegedly demanded to approve a solar energy project by the company Solar P-6 under the state-run Invest UP platform. The controversy led to the suspension of then-CEO Abhishek Prakash.
The state govt had handed over the probe to a three-member SIT, which later filed a chargesheet against Jain.

The Directorate of Enforcement (ED), Chandigarh has launched a money laundering investigation against a Mumbai-based firm, Ankur Drugs and Pharma Limited, and one of its directors, Giriraj Vijayvargiya. The move comes two years after the Central Bureau of Investigation (CBI) in Chandigarh registered an FIR against the firm for allegedly defrauding Punjab National Bank (PNB) to the tune of Rs 60 crore. The ED has filed an application in the Chandigarh District Court requesting the CBI to hand over all case-related records, including the FIR, chargesheet, and other relevant documents. The CBI had concluded its probe in March this year and filed a chargesheet in the district court. According to the complaint, on July 17, 2023, Nand Kishore Barnwal, chief manager, PNB, approached the CBI alleging that Ankur Drugs and Pharma Limited had, in 2009, sought a short-term loan of Rs 50 crore and a term loan of Rs 30 crore to expand its Baddi unit. The bank eventually sanctioned loans amounting to around Rs 60 crore. However, the company defaulted on repayments, and by 2012, the account was classified as a non-performing asset (NPA) with outstanding dues exceeding Rs 60 crore. The bank alleged that the company had inflated stock values in its stock statements to secure higher credit limits and diverted the sanctioned short-term loan for long-term purposes, in violation of loan conditions. This amounted to a deliberate act of fraud and misuse of funds, the bank claimed. Following the alleged default and misuse, the PNB filed a formal complaint with the CBI, which led to the registration of an FIR against the company and its director. The CBI's investigation resulted in a chargesheet earlier this year, paving the way for the ED to now begin a parallel probe under provisions of the Prevention of Money Laundering Act (PMLA).

ED files supplementary prosecution complaint against 56 accused in Amtek Auto ‘bank loan fraud' case

The Enforcement Directorate (ED) has filed a supplementary prosecution complaint against 56 accused in a 'bank loan fraud' case involving Amtek Auto Limited and others. The agency has so far attached assets, most of which have been considered at their book value, worth about ₹6,261.37 crore. Among the others mentioned by the agency in the case are ARGL Limited, ACIL Limited, Metalyst Forging Limited, and Castex Technologies Limited, and other group companies, along with the main promoter Arvind Dham, and other individuals. Taking cognisance of the complaint, a special Delhi court has issued notice to all the accused, including promoters of the Amtek Group, their family members, Chartered Accountants, bankers, resolution professionals, and stock market operators. The ED initiated the probe on the Supreme Court directive dated February 27, 2024 while hearing a public interest litigation against the Amtek Auto group of companies on the charge of large-scale money laundering involving loans obtained mostly from public sector banks. The Central Bureau of Investigation has also registered cases based on complaints by IDBI Bank and Bank of Maharashtra, on the allegation of illegally diverting bank loans. According to the ED, its investigation revealed the role of Chartered Accountants who filed 'fraudulent audit reports and covered up the fictitious inflation of fixed assets in the books while not flagging the fraudulent diversions and criminal misappropriation done by the group'. Certain bankers sanctioned loans against 'undue benefits and evergreened loans without following Reserve Bank of India guidelines'. The agency also conducted inquiries against suspicious Mumbai-based stock market operators who 'helped Amtek Group in defrauding foreign portfolio investors' of about ₹1,000 crore of investment in Castex Technologies Limited. 'The stock operators were hired by Amtek Group for manipulation of company's shares through artificial price rigging,' it said. Following loan repayment default, 15 group companies were taken to the National Company Law Tribunal (NCLT) by the creditors. The cases were resolved with a deep haircut of 81% for the creditors. The agency found that 'even before the NCLT proceedings, the promoter group had alienated their assets by undervalued transfers using their front entities/benami persons'. Accordingly, the role of resolution professionals has also been covered in the complaint. 'After the resolution of group companies, personal insolvency proceedings of Arvind Dham was initiated by a committee of 23 creditors with claims of over ₹38,000 crore. Against the claim, a resolution of ₹35 crore was proposed by the accused,' it said, adding that ₹6,300 crore has so far been recovered by lenders under the Insolvency and Bankruptcy Code. During the probe, the ED purportedly detected a maze of about 500 shell entities created to buy and hold assets worth over ₹6,000 crore using siphoned off funds. It had earlier conducted searches and arrested Mr. Dham, following which a prosecution complaint was filed on September 6, 2024.

Jain monk Muni Nileshchandra Vijay has warned of launching an indefinite hunger strike from August 13 against the decision to shut down Dadar Kabutarkhana to stop people from feeding pigeons. He asserted the community would not abide by court orders on the issue if it went against their religious practices. The Brihanmumbai Municipal Corporation (BMC) has covered the Dadar Kabutarkhana area following court orders.(ANI) The Jain community is peaceful but, if needed, it will take up arms for religion, he had said on Sunday. Maharashtra skill development minister Manga Prabhat Lodha, who has been supportive of efforts to save kabutarkhanas (pigeon shelter or feeding stations), however, distanced himself from Vijay's comments. On August 6, a large number of protesters removed the tarpaulin cover put up by the Brihanmumbai Municipal Corporation (BMC) at the Dadar Kabutarkhana to discourage the practice of feeding grains to pigeons and also clashed with police. Speaking to reporters on Sunday, Vijay said, "We will follow the path of satyagraha and hunger strike. The Jain community is peaceful but, if needed, will take up arms for our religion. If any decision goes against our faith, we will not accept even the court's order." He claimed more than 10 lakh Jains from all over the country will take part in the protest. "The ban targets Jain traditions. The move is politically motivated with elections in mind. From ants to elephants, no living being should die (from hunger), that is what our religion teaches. Why is Jainism being targeted? Show how many people die after consuming liquor and chicken," the monk further said. Queried by reporters about Vijay's comments, Lodha said, "I do not agree with his statement. I have spoken twice on this matter and I am fulfilling my role. I will not comment further." The BMC on Sunday once again covered Dadar Kabutarkhana with plastic sheets. It repaired the damaged bamboo cladding at the spot before putting silver coloured plastic sheets on the pigeon feeding area, located on the west side of Dadar station, the officials said. To avoid any law and order issue and prevent people from feeding the birds, security at the site has been stepped up and the civic body also deployed its marshals at the kabutarkhana, they said. The BMC's decision to ban public feeding of pigeons in view of health hazards associated with the practice and close kabutarkhanas has led to a controversy. People who feed pigeons have challenged the civic body's decision in the Bombay High Court. On August 7, the HC said it had not passed any order directing the closure of kabutarkhanas in the city, but only refrained from staying the closure order of the municipal corporation. A committee of experts can study whether the old kabutarkhanas in the city should continue, but "human life is of paramount importance", it had said. The HC was hearing a bunch of petitions filed by people who feed pigeons challenging the civic body's decision to ban such feeding and close kabutarkhanas.
