Court rejects plea to summon more policemen in Sandeep Gadoli fake encounter case

India Today09-07-2025
A Mumbai sessions court has dismissed the prosecution's plea to summon four additional police officers, including senior officials from the Haryana police, in connection with the alleged fake encounter of gangster Sandeep Gadoli in a Mumbai hotel in 2016.Special Public Prosecutor Amin Solkar had sought the court's permission to summon Amit Kumar, Balbir Singh, Anil Kumar Sagwan, and Rajbeer Beniwal as co-accused under Section 319 of the Code of Criminal Procedure. Solkar argued that the testimonies of four key witnesses during the ongoing trial pointed to the involvement of the officers in a larger conspiracy to eliminate Gadoli.advertisementThe application was opposed by the existing accused in the case, who argued that no new evidence had emerged during the trial that wasn't already available at the time the chargesheet was filed. The defence emphasised that the Special Investigation Team (SIT), after a detailed probe, had not found any incriminating material against the officers in question and therefore did not include them as accused.
Further, the defence contended that issuing summons at this stage would unduly delay the trial, which is being conducted under time-bound directives from the Supreme Court. They also highlighted the prolonged incarceration of the current accused, some of whom have been in custody since 2016.After hearing arguments from both sides, Additional Sessions Judge Prashant C Kale rejected the application. 'There is no prima facie evidence against other persons for issuing summons against them as prayed,' the judge observed in his order. The case pertains to the killing of Sandeep Gadoli, a gangster from Haryana, who was shot dead in a Mumbai hotel room by a team of Haryana police officers. The incident is alleged to have been orchestrated at the behest of a rival gang. Eight individuals — including police officers, a mother-daughter duo accused of tracking Gadoli's movements, and a gangster — are currently on trial. So far, 43 witnesses have testified in the case.- Ends

Jain leaders to meet on Aug. 10 to condemn attack on their history, culture under the cover of Dharmasthala issue

Jain monk Sri Gunadhar Nandi Maharaj of Navagraha Teertha at Varur near Hubballi has said that a meeting of Jain leaders from across the State will be held at Varur on August 10 to condemn the continued attack on the history and culture of Jainism in the social media. Addressing presspersons at Varur on Monday, Gunadhar Nandi Maharaj said that keeping the developments in Dharmasthala as a cover, several miscreants have resorted to making unwarranted comments on Jain rulers and trying to project them in bad light by calling them names and accusing them of exploiting women which is highly condemnable. He said that Jain rulers, scholars and artistes have contributed a great deal to the history and culture of the nation which has been well documented by many. He said that there is not a single instance of atrocities attributed to Jain rulers found in the inscriptions related to Jain history. 'Despite such being the case, this defamation campaign against the community has pained us all. We want the State government to act against those engaged in the defamation campaign in the social media,' he said. The Jain monk said that a taluk-level meeting of Jain leaders will be held at Varur on Tuesday and a State-level meeting on August 10. He further clarified that as he has undertaken the Chaturmas Vrat, he will not be directly participating in the meetings. He said that he welcomes the ongoing SIT probe into the alleged killings in Dharmasthala as it will help in bringing out the truth. 'We have full confidence in the SIT and our State government. We want the probe to be completed at the earliest to bring out the truth. We hope that the investigation does not get delayed,' he said.

SC questions delay in forensic report on audio clips allegedly linking Manipur ex-CM to violence

The Supreme Court on Monday questioned why a fresh forensic report on the authenticity of audio clips allegedly linking former Manipur Chief Minister N Biren Singh to the ethnic violence in the state had not been submitted even though it had been sought three months ago, Live Law reported. In February, the court had directed the Central Forensic Science Laboratory to examine the clips and submit its findings in a sealed cover. After reviewing the report, a bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar in May said that it was not satisfied with the analysis given by the laboratory and asked for a fresh report. The bench has been hearing a petition filed by the Kuki Organization for Human Rights Trust, which has demanded an independent investigation into the audio clips purportedly featuring Singh's voice. In the recordings, a voice purported to be that of Singh is heard taking credit for ' how and why the conflict started ' bragging that he had defied Union Home Minister Amit Shah's order against the use of 'bombs' in the conflict and shielding individuals who snatched thousands of weapons from the state police armouries from arrest. At least 260 persons have been killed and more than 59,000 persons displaced since the ethnic clashes broke out between the Meiteis and Kuki-Zo-Hmar communities in May 2023. There were periodic upticks in violence in 2024. President's Rule was imposed in February after Singh resigned. On Monday, a counsel on behalf of Solicitor General Tushar Mehta, who has been representing the Centre, sought two weeks' time to submit the fresh report. 'By now, the forensic laboratory must have given you a report,' the bench said in response. 'At least tell us whether the report has come or if it is still in the pipeline.' When the counsel replied that the report had not yet been received, Kumar questioned the delay. 'How long does it take the FSL [Forensic Science Laboratory] to provide a definite analysis of the voice?' Live Law quoted him as saying. 'This can't go on endlessly.' The bench set the matter aside to allow the solicitor general to appear.

SC questions Uttar Pradesh's ‘tearing hurry' in promulgating Banke Bihari temple ordinance

The Supreme Court on Monday questioned the 'tearing hurry' with which the Uttar Pradesh government promulgated the 2025 Shri Bankey Bihari Ji Temple Trust Ordinance, which permitted it to take over the management of the shrine in Mathura district's Vrindavan, Live Law reported. A bench of Justices Surya Kant and Joymalya Bagchi was hearing petitions against the ordinance. It also expressed disapproval of the 'clandestine manner' in which the state government, by filing an application in a civil dispute, secured permission through a May 15 judgement to use temple funds for the development of a corridor. The May 15 verdict permitted the state government to use temple funds to acquire five acres of land to develop a corridor that is estimated to cost Rs 500 crore, India Today reported. However, this was allowed on the condition that the land should be registered in the name of the deity. On Monday, the bench verbally proposed to recall the directions in the May 15 verdict, Live Law reported. It also proposed the formation of a committee headed by a retired judge to oversee the management of the temple while the validity of the ordinance was being decided by the High Court. The bench then adjourned the hearing of the petitions against the ordinance till Tuesday. During the proceedings, advocate Shyam Divan, appearing for the former management of the temple, told the court that the ordinance ejected the Goswamis, who were earlier managing the temple, and vested the state government with the management, Live Law reported. He added that the directions in the May 15 judgement were passed 'behind the back of the management' as they were not heard. The verdict came in a case that dealt with a private dispute between two sects, the advocate added. The state government intervened in the private dispute and secured the orders for the utilisation of the temple funds, he added. The lawyer for the former management of the temple urged the court to issue a status quo order and further questioned the need for the state government to urgently promulgate an ordinance. 'Ordinance is for emergency measures,' Live Law quoted Divan as having said. The bench then asked Additional Solicitor General KM Nataraj, representing the state government, how the May 15 judgment could be justified when the affected parties were not heard. Kant criticised the manner in which the directions were passed without notice to the affected parties. 'A public notice could have been issued,' Live Law quoted Kant as having said. 'It was not a case of No Man's Land. Someone had to be heard on the behalf of the temple… Temple funds will have to be utilised for pilgrims, can't be pocketed by private persons.' He also added that the state government had filed an application in the dispute in a 'clandestine manner', adding that this was unacceptable. The judge asked why the state government did not acquire the land as per the law after paying compensation. 'What was the tearing hurry for the ordinance?' Live Law quoted Kant as having asked. The case The Banke Bihari temple in Vrindavan has historically been managed privately. In 2023, the Allahabad High Court permitted the development of a corridor that was proposed by the Uttar Pradesh government, Live Law reported. However, it restrained the state government from using Rs 262.5 crore from the temple fund for its construction. In March, the High Court appointed advocate Sanjay Goswami as an amicus curiae to assist in resolving management-related issues. Subsequently, the state government promulgated the 2025 Shri Bankey Bihari Ji Temple Trust Ordinance. It proposed the creation of a statutory trust with several state government officials as ex-officio trustees. On May 15, the Supreme Court modified the 2023 order issued by the High Court. The bench allowed the state government to use temple funds to acquire five acres of land around the temple for the development of the corridor. The verdict came in a private dispute between two sects
