Man who sexually assaulted five women at Irish pilgrimage site jailed

A worker at the Lough Derg pilgrimage site who duped unsuspecting women into helping him at the retreat so he could sexually assault them has been jailed for a total of four years.
Cunning Tomas Gallagher preyed on five female victims by asking them to help him repair washing machines and tumble dryers during a series of terrifying incidents at the renowned religious setting.
But instead of helping the workman, the innocent women found themselves being sexually assaulted after the 42-year-old preyed on the unsuspecting women.
Details of the plans hatched by Gallagher were outlined before Letterkenny Circuit Court last week.
Gallagher had pleaded guilty to seven charges in all, four for sexual assaults of adults, two for sexual assault on children and one charge of invitation to a child to sexually touch.
And today, having considered reports on Gallagher as well as the statements from his victims, Judge John Aylmer jailed the father-of-one for five years with the last 12 months suspended.
He said the crimes, as outlined in the case, were "egregious acts of violence in a sacred place of pilgrimage."
He told Gallagher that his crimes were 'deceitful' and 'premeditated' and that he placed them in the mid-range for such offences and which merited a sentence of seven years before mitigation.
In mitigation he noted an early plea, the fact that the accused had no previous convictions, that he appeared to be remorseful and ashamed of his actions.
Judge Aylmer also noted that Gallagher had undertaken 24 counselling sessions, that he was fully cooperative and that he had been ostracised in the local community.
Taking the totality factor into account and that all sentences will run concurrently, Judge Aylmer said he was reducing the overall sentence to one of five years.
He then added that with regard to all efforts to encourage rehabilitation and the fact that it needs to be encouraged, he suspended the final 12 months of that sentence meaning Gallagher will serve four years in prison.
He is also to go under the supervision of the Probation Services for 12 months.
Gallagher, from Rathanlacky, Dunkineely pleaded to a total of seven charges against five different women at the holy island on the shores of Lough Derg.
He pleaded to six charges of sexual assault at St Patrick's Purgatory.
These offences are contrary to Section 2 of the Criminal Law (Rape) (Amendment) Act 1990, as amended by Section 37 of the Sex Offenders Act 2001.
He also pleaded that in the same period and location, he did attempt, by inviting, inducing, counselling or inciting a child to sexual touching. This offence is contrary to Section 4 Criminal Law (Sexual Offences) Act, 2017.
The victims, who cannot be named to protect their identity, ranged in age from their early teens to more mature women in their later years.
All of the offences took place in 2022, when Gallagher worked both as a maintenance man at the retreat, as well as driving a boat taking pilgrims to and from the island.
Barrister for the state, Ms Fiona Crawford, BL and investigating Garda Joanna Doherty outlined the details of the incidents.
Statements given to Gardai by the victims told how Gallagher had approached them, asking them to come into a laundry room as he needed help fixing various machines.
The statements outlined how the unsuspecting women were asked to reach behind them into the machines while Gallagher fixed a "pipe."
The women thought they were holding a pipe but instead they were gripping the accused man's penis.
On one occasion, Gallagher told one of his victims to twist the pipe like she was "revving a motorcycle."
Gallagher told another victim that the "pipe" would be soft and moist.
An older victim was approached by Gallagher, who asked her to reach behind a dishwasher and hold a pipe but she "knew immediately it was no pipe" as it was warm and soft and felt like a penis.
The woman couldn't see it but the shocked woman jumped back and shouted "what the f*** is that?"
The woman didn't tell anybody else about the incident that day but felt upset and did later tell her daughter about what had happened.
On another occasion, Gallagher asked a young teenage girl to help him with a washing machine and asked her to hold a "pipe".
She grabbed the "pipe" and he told her to "hold it there" as he chatted to her about school.
However, the girl told how the pipe didn't feel like plastic but was warm and had a rubbery texture and that it felt sticky or sweaty.
Another teenager told in her statement how Gallagher asked him to assist her with a tumble dryer and told her to put her hand behind a wooden board and he got her to hold something.
He told the girl to hold the "pipe" harder and then to loosen it and then to increase her grip before he said "yeah, that's fine."
The young woman then said the pipe was "squishy, wet and warm" and when she stood up she saw Gallagher's penis sticking out from the zipper of his trousers.
One young woman eventually came forward and told a person in charge what had happened which led to others coming forward making complaints of a similar nature against Gallagher.
Gallagher was interviewed by Gardai on three occasions and initially denied anything untoward had happened.
During one interview with Detective Garda Paul McHugh, Gallagher admitted asking one woman to hold a pipe on a tumble dryer as it had been leaking.
He claimed the woman had got up and left for no apparent reason and he had been left nervous and embarrassed by the incident.
However, he later admitted the offences and entered a guilty plea.
Victim impact statements from the women were read out in court while two young women chose to read out their own statements.
One young woman fought back tears as she told how despite being the victim she felt ashamed and disgusted by what had happened and often thinks about if she could have stopped this from happening to other women.
She added that she often thinks about Gallagher's son and that she prays that he is safe.
An older victim said she feels vulnerable and intimidated by what had happened and that she is sorry that she did not speak up sooner but was afraid that people would laugh at her or not believe her.
Another victim told how she was a student but failed her exams because she became depressed after Gallagher's assault on her.
However, she later completed her exams and was proud of herself and was determined not to allow her attacker to ruin her life further but still feels he stole something from her.
A teenage victim said she has been forced to attend counselling because of anxiety and that she is now always on edge and simply cannot trust men.
She decided not to come to court as she feared that seeing Gallagher again would trigger her anxiety.
Another woman, who now lives abroad and gave her evidence by videolink, told how she lives in an apartment with a lift and if a man gets into the lift she can't stop thinking "what if?"
She said she realises that she should not tar all men with the same brush but Gallagher's attack had made her an angrier, wearier and a meaner person as a result.
She added that she does feel disgusted by what had happened but sometimes feels glad that he had chosen her and that she had alerted the authorities to what was happening as she hated to think what number of victims there might have been.
Gallagher took to the witness stand and said he wanted to apologise to his victims.
He said he "truly regretted" his actions and was sorry for the hurt and pain he had caused his victims and their families.
Asked by his barrister, Mr Colm Smyth, SC, if he realised this was a huge breach of trust, Gallagher replied that he did.
He also revealed that he had engaged in 24 counselling sessions to better understand the impact his actions have had on others.
Mr Smyth said his client accepted full responsibility for his actions, that he had now lost his employment and had become a pariah in the local community because of the publicity surrounding the case.
He added the fact that the offences took place in a sacred place, a place of pilgrimage for Christian people going back many centuries, also had to be acknowledged.
Mr Smyth suggested to Judge John Aylmer that there also has to be "light at the end of the tunnel" for Gallagher, asking him to consider his client's remorse, his blameless life up until now and his guilty plea.

A Central Criminal Court Judge has told a Dublin tattoo artist that 'his actions and attitude are less than encouraging' after he was found guilty of sexual assault in 2016. The court heard that Henrique Pereira (34) of Saint Patrick's Road, Drumcondra, Dublin, was found guilty of sexual assault at an apartment on Phibsborough Road, Dublin, on October 19, 2016. He has no previous convictions. At a previous hearing, a victim impact statement was read to the court on behalf of the injured party in this case. It outlined the flashbacks she has, which she described as 'debilitating' and 'vivid.' She said, 'The flashbacks were as vivid today as when they first happened.' She struggles with being in small spaces and said the assault has 'made me feel very unwell and unsafe'. Passing sentence yesterday, Ms Justice Mary Ellen Ring began by wishing the injured party in this case well in the future and that the conclusion of this case may now bring her some closure. Ms Justice Ring said Pereira has no memory of meeting the injured party in this case and said, 'it seems that he was engaging in a conveyor belt of dating at the time.' She said Pereira 'needs to understand that a woman is entitled to change their mind'. The judge said, 'The impact has been significant, and Pereira is responsible for that impact.' She also noted that 'his actions and attitude are less than encouraging'. She set a headline sentence of three years and six months. The judge noted that the mitigating factors in this case included his lack of a previous conviction in Ireland or any other jurisdiction. She noted that he is a small business owner and has family obligations. After considering the mitigating factors, Ms Justice Ring sentenced him to two and a half years in prison but suspended it in full for two and a half years. She also placed Pereira under the supervision of the Probation Services for 18 months and told him that he must carry out all directions deemed necessary by his probation officer. Garda Aoife Moroney told Conor Devally SC, prosecuting, that Pereira and the woman met on a dating website and arranged to meet at a restaurant in Dublin for a meal. After the meal, they decided to go for a drink, and Pereira wanted to visit a certain pub, rather than one local to where they had just eaten. While they were having a drink, they shared a kiss, and Pereira suggested they might have sexual intercourse later, but the injured party made it clear that this would not happen. The court heard that the injured party declined an offer to go back to Pereira's apartment. He then stood in a doorway and opened a door. A cat appeared, and the injured party stood in the doorway to stop the cat from getting out. Pereira again invited her to come upstairs and she did but did not sit down or take her jacket off. The woman was about to leave, but Pereira stopped her. He kissed her, and she went down the stairs of his apartment to leave, but she was unable to open the front door. Pereira then sexually assaulted the woman by touching her around her genital area. She managed to push him away, and he stopped. The woman maintained a 'friendly manner' with Pereira out of fear, and he walked her to the bus stop, where she gave him the impression that they would meet again. Gda Moroney said the woman contacted her friend and later the gardaí. When Pereira was questioned by the gardaí, he said he did not know who they were talking about, as he had seen many women from the dating app over that period of time. He told the gardaí that he did not, and would not, do anything untoward. In April 2023, Pereira was stopped at a border check in Spain, and he later presented to the gardai in Ireland. Timothy O'Leary, SC, defending, stated that his client has wanted to be a tattoo artist since the age of seven. In 2018, he opened his own tattoo shop in Ireland, employing several people. Counsel said his client will now be placed on the sex offenders register, and this will have an effect on his travel. He also noted that his client now accepts the jury's verdict. The court was informed that Pereira wished to give evidence on his own behalf before sentence. He told the court, 'I would like to say that I am sorry for everything that happened'. Mr O'Leary put it to his client, 'Do you understand that you have a lot of work to do between men and women and consent?' to which he said he did and that he would carry out any courses deemed necessary. Counsel asked him if he understood the impact that what he did had on the injured party in this case, to which he said 'yes.' Pereira apologised to the court for his existence and later for his behaviour. Mr O'Leary asked the court to consider a suspended sentence.

A man who admitted to repeatedly raping his foster daughter over a seven-year period must pay more than €300,000 in damages to her, a High Court judge has ruled. Stephen Murray, formerly of Humphreystown, Valleymount, Co Wicklow, was jailed for 11 years in 2022 after pleading guilty to multiple counts of rape, oral rape and sexual assault of Kelly Kemmy. The offending occurred between February 2009 and December 2015, when Ms Kemmy was aged between 11 and 18 years old. Ms Kemmy (27), who waived her right to anonymity following Murray's sentencing, subsequently issued civil proceedings against Murray and Tusla. Ms Kemmy's claim against Tusla, which sought damages for negligence for placing her in the care of Murray, was later settled for €250,000. READ MORE In February, 2024, Mr Justice Paul Coffey ruled in favour of Ms Kemmy in her claim against Murray, which sought damages for personal injuries as well as rape, sexual assault, assault, battery, false imprisonment and trespass to the person. Murray did not participate in the proceedings and judgment was made against him in default of appearance. In a judgment on Wednesday, Ms Justice Emily Egan ruled Ms Kemmy should receive damages of €328,000 from Murray. Ms Justice Egan, who characterised the nature and severity of abuse suffered by Ms Kemmy as a 'worst case scenario', said Ms Kemmy should be awarded €578,000 arising from her action against Murray. This would comprise €450,000 in general damages and €128,000 in special damages. However, the judge ruled that Tusla and Murray were 'concurrent wrongdoers' in the case and as such, the €250,000 settlement with Tusla should be deducted from the total award. '[Ms Kemmy] suffered damage as a result of the tortious and criminal actions of Murray and that damage was not prevented, interrupted or ameliorated by Tusla, as it ought to have been,' the judge said. An award of €450,000 in general damages reflects 'the nature, severity, timing and duration of abuse and the severity of the injury' to Ms Kemmy, Ms Justice Egan said. This award is greater than damage previously awarded for other child sexual abuse cases, the judge said. The judge noted the current upper limit for awards of general damages in personal injuries cases is €550,000. The €128,000 in special damages arises primarily from Ms Kemmy's claims of loss of earnings. Referring to Ms Kemmy's evidence in the civil case, Ms Justice Egan noted that it is estimated she suffered hundreds of separate incidents of rape, occurring three to four times a week. Murray's abuse of Ms Kemmy began when she was 11 years old, some seven years after she and two of her siblings were fostered by Murray and his wife. 'For years, [Ms Kemmy's] dignity and autonomy were taken from her, causing her to suffer humiliation, frustration, helplessness, loneliness and despair,' the judge said. It was Ms Kemmy's evidence that Murray told her the abuse was normal but secret, and if she told anyone, 'it would ruin the family', the judge noted. Ms Kemmy said she felt trapped, helpless and frightened, and that her shame was so overwhelming she felt she had no one to turn to for help, the judge said. Ms Kemmy reported Murray's abuse to An Garda Síochána in July 2019. After this, she was rendered effectively homeless and her relationship with her two siblings was 'devastated', the judge noted. Murray would later plead guilty to 14 counts of rape, two counts of oral rape and one count of sexual assault. Ms Kemmy continues to suffer with post-traumatic stress disorder, the judge noted. The judge also said Ms Kemmy is a resourceful and intelligent woman, keen to gain security for herself and her young child, and who has ambitions of becoming a social worker.

‘I want to meet him in a safe space and look him in the eyes': Spanish tourist raped in Dublin wants to meet her attacker

A Spanish tourist who was raped in Dublin city centre during New Year's Eve celebrations has said she wants to meet her attacker in a safe space and ask him how he could have been so cruel. The prosecution will now look into providing restorative justice for the complainant to allow her to do this, with the court hearing that it is rarely utilised for victims in rape cases before the Central Criminal Court. Christopher O'Grady (33), formerly of Muirhevnamor, Dundalk, Co Louth, was found guilty of one count of raping the then 19-year-old woman on January 1st, 2019 following a trial last March. He was homeless at the time. In her victim impact statement which was read out by prosecution counsel, Tony McGillicuddy SC, the woman said: 'I don't know why, but I want to meet him in a safe space and look him in the eyes and ask him what reason would anyone have to be so cruel to a young woman.' READ MORE '...I want to know if he believes his own lies. I want him to truly see me and be forced to see himself as monstrous as I saw him.' She outlined the effects the rape have had on her, saying O'Grady turned her life upside down. 'He didn't see the person behind the body,' she said. She described how she can no longer socialise or dance like she used to, is fearful of walking alone at night and is hypervigilant of other young women out at night. Padraig Dwyer SC, defending O'Grady, submitted his client was guilty of rape on the basis that he was reckless as to whether the young woman was consenting or not. He said O'Grady now accepts his guilt and wished to apologise to the victim for the hurt and pain he caused her. After some consultation with both O'Grady and the complainant, the court was told that they are both willing to engage in restorative justice. Ms Justice Caroline Biggs warned O'Grady that this does not mean he will not be serving a custodial sentence for his offending. She noted that any restorative justice process would need to be managed by appropriate individuals, given the effects of the crime on the complainant. Mr McGillycuddy said he had some knowledge of restorative justice but was 'not aware of it being used for an offence of this nature'. Ms Justice Biggs adjourned the case to July 24th to give the prosecution time to look into the issue. The trial heard the woman had been in town to watch the New Year's Eve fireworks that night when she got separated from her friend and came into contact with O'Grady outside a shop. She told the court she was trying to find a bar to meet her friend and O'Grady walked her through town to a car park area where the alleged rape occurred. The woman said she felt 'like a doll' and didn't have any strength in her body during the alleged incident. Afterwards, the court has heard she walked with O'Grady back through the city centre for about 40 minutes, where she got talking to a couple – a man and woman - outside a shop and parted ways with O'Grady. The woman ended up in a B&B with the second man after the woman went home, where they had anal sex before the woman went home to her accommodation. She told the court it was painful and she persuaded the man to stop. The trial was played CCTV footage of this encounter, which occurred in the hallway of the B&B. Ms Justice Biggs warned the jury that they may find this footage 'intrusive' and 'distressing', but she said she had made the decision that it needed to be shown in court as O'Grady had a constitutional right to put the evidence before them. When the complainant woke up the next morning, she told the court she 'realised I had two rapes and there might be a medical issue with that'. She went to hospital. The court heard no charge was brought against the second man, who gave evidence in the trial. Sergeant Eoghan Kirwan told the court that O'Grady has 65 previous convictions, including public order offences, criminal damage, drugs and theft. He took a bench warrant while on bail for this offence and has been in custody since August 2024. Defence counsel said O'Grady was living a 'shambolic' lifestyle at the time of the offence, that he was homeless, begging on the streets and doing drugs.
