Musk's X must face part of lawsuit over child pornography video
While rejecting some claims, the 9th U.S. Circuit Court of Appeals in San Francisco said X, formerly Twitter, must face a claim it was negligent by failing to promptly report a video containing explicit images of two underage boys to the National Center for Missing and Exploited Children (NCMEC).
The case predated Musk's 2022 purchase of Twitter. A trial judge had dismissed the case in December 2023. X's lawyers did not immediately respond to requests for comment. Musk was not a defendant.
One plaintiff, John Doe 1, said he was 13 when he and a friend, John Doe 2, were lured on SnapChat into providing nude photos of themselves to someone John Doe 1 thought was a 16-year-old girl at his school.
The SnapChat user was actually a child pornography trafficker who blackmailed the plaintiffs into providing additional explicit photos. Those images were later compiled into a video that was posted on Twitter.
According to court papers, Twitter took nine days after learning about the content to take it down and report it to NCMEC, following more than 167,000 views, court papers showed.
Circuit Judge Danielle Forrest said section 230 of the federal Communications Decency Act, which protects online platforms from liability over user content, didn't shield X from the negligence claim once it learned about the pornography.
"The facts alleged here, coupled with the statutory 'actual knowledge' requirement, separates the duty to report child pornography to NCMEC from Twitter's role as a publisher," she wrote for a three-judge panel.
X must also face a claim its infrastructure made it too difficult to report child pornography.
It was found immune from claims it knowingly benefited from sex trafficking, and created search features that "amplify" child pornography posts.
Dani Pinter, a lawyer at the National Center on Sexual Exploitation, which represented the plaintiffs, said in a statement: "We look forward to discovery and ultimately trial against X to get justice and accountability."
The case is Doe 1 et al v Twitter Inc et al, 9th U.S. Circuit Court of Appeals, No. 24-177.

Spirit Airlines pilot ‘removed from duty' after being arrested for stalking teenagers, officials say
A Spirit Airlines pilot who was allegedly stalking teenagers was arrested at Louis Armstrong New Orleans International Airport and "removed from duty" by the airline. Dominic A Cipolla, 40, has been charged with stalking two teenagers, according to a July 11 criminal complaint. The charges originate in Johnson County, Kansas, and include birthdates for the alleged victims — 12 and 17 years old. Cipolla was arrested by law enforcement at the airport in New Orleans on June 17 in connection to the criminal allegations, according to The Guardian. After he was taken into custody, police took him to jail before transferring him to Johnson County, Kansas, on August 2. He bonded out after posting $12,500 and he is scheduled to return to court on August 12.. According to the Guardian, Cipolla alleged actions with the younger victim and are considered a felony. If convicted, Cipolla could be sentenced to one to three years in prison. The other charges he faces is a misdemeanor, which could land him a fine of up to $2,500 or up to a year in jail. The charges related to Olathe, Kansas, a town in Johnson County. According to the court documents, Cipolla lives in Kansas City, Missouri, which is about 22 miles north of Olathe. However, officials have released few details of his alleged crimes. Spirit Air confirmed to the Guardian that it is "aware of a matter involving a pilot at Louis Armstrong New Orleans International Airport ... which was unrelated to the performance of their job duties." 'The pilot was removed from duty pending our investigation into the matter,' the airline said in its statement. 'And we arranged for another pilot to operate the flight.' According to the Guardian, Cipolla joined Spirit in 2022 and spent time in the U.S. military. Spirit has faced other connections to sex-crime arrests in recent days. One of the airline's passengers — a registered sex offender — was recently arrested for groping a teenage girl sitting next to him. John Daniel Fowler, 65, of Indiana, told police that he had merely been reaching down to help right the thermos of the 17-year-old girl in the next seat after it tipped over. He reportedly tried to talk to the teen, but she didn't want to. A criminal complaint alleges that after falling asleep under a blanket, the teen awoke to find Fowler's hand underneath her blanket rubbing her crotch. Fowler was charged the same day with abusive sexual contact aboard an aircraft. If he's convicted, he faces three years in a federal prison. On top of the charge, prosecutors may push for a 10-year enhancement for having committed a new crime while a registered sex offender.

Trump considers four finalists for Fed chair
Donald Trump revealed who he is considering to chair the Federal Reserve if he should move to oust Jerome Powell. And among the short list is not his current Treasury Secretary Scott Bessent. 'I love Scott, but he wants to stay where he is,' Trump said Tuesday morning during a wide-ranging interview on CNBC's Squawk Box. 'I asked him just last night, 'Is this something you want?' 'Nope, I want to stay where I am.' He actually said, 'I want to work with you. It's such an honor,' Trump said reenacting his conversation with the Bessent. The president has been at war with Federal Reserve Chairman Powell , who has refused to bow to pressure to lower interest rates. Trump could also allow Powell to serve out his full term, which ends in May 2026, and select a replacement then. Trump joked with CNBC anchor Becky Quick that she and her co-hosts would be better than Powell. 'You guys are better than most of the people who do it for a living,' he said. The president told CNBC that he has a list of four people he is considering to take Powell's place. The final four include former Federal Reserve Board of Governors Kevin Warsh and Council of Economic Advisors member Kevin Hassett. Current Fed Governor Christopher Waller has also been floated as a potential future chairman. 'The two Kevins are doing well and I have two other people that are doing well,' Trump said on Tuesday during the call-in interview, naming two of the four he's considering. While Trump has repeatedly threatened to fire Powell, it's not easy for a president to oust leaders at independent agencies. Trump says he has the authority to remove Powell and has cited disagreements over monetary policy – specifically the issue of interest rates. But the Federal Reserve Act of 1913 prevents the president from firing members of the Federal Board of Governors, including the chairman, for any reason other than 'for cause.' This generally is interpreted as misconduct or neglect of duty. It does not appear to encompass policy disagreements like those Trump has repeatedly expressed. Additionally, a Supreme Court decision in 1935 reinforced that a president cannot without cause fire top officials at independent agencies, which includes the Fed. Additionally, Trump has a more urgent Fed Board vacancy to fill after last week's resignation of Biden appointee Adriana Kugler. In his attacks on Powell, Trump has even tried to allege fraud was afoot in a $2.5 billion Federal Reserve renovation project and this was possible justification for removal. During a tour of the Fed headquarters with Powell on July 24 , Trump implied mismanagement of funds or fraud, saying that the cost rose to $3.1 billion. Powell immediately corrected Trump in front of the press, noting the figure he was referencing included a separate building that was renovated five years prior. Trump has not provided any concrete evidence of fraud.
