The pilot of an army chopper that crashed and killed all four on board took action to avoid a mid-air collision with another aircraft, a defence report reveals.
The Aviation Safety Investigation Report into the MRH-90 Taipan helicopter crash on July 28, 2023 was released on Wednesday.
Captain Danniel Lyon, Lieutenant Maxwell Nugent, Warrant Officer Class Two Joseph Laycock and Corporal Alexander Naggs were killed when their helicopter crashed into waters in the Whitsundays during Exercise Talisman Sabre.
The investigation found the primary cause of the tragedy was "spatial disorientation", which happens when a pilot misperceives the position of their aircraft in relation to the surrounding environment.
It concluded that the pilots were likely experiencing a level of fatigue shown to "impede optimal performance" and increase susceptibility to spatial disorientation.
"The estimated level of fatigue ... was considered sufficient to affect their actions and decisions in the event," the report said.
The crew, from the Sydney-based 6th Aviation Regiment, were flying in a helicopter given the call-sign Bushman 83, which was the third in a formation of four aircraft as part of a training exercise.
The report found that after making a turn, Bushman 83 climbed more than 100 feet within 14 seconds.
Cockpit voice recordings revealed there were no communications between the choppers for the period of the climb.
But a recording from inside Bushman 83 heard the co-pilot ask "have you still got ('em)".
The aircraft pilot replied "yeah still got ('em) mate".
It was found the aircraft pilot "almost certainly" lost sight of the helicopter ahead in the formation, Bushman 82.
The report stated the aircraft pilot of Bushman 83 likely didn't know the chopper was facing nose down and combined with a lack of recognition of the aircraft's increasing airspeed "resulted in a very high and unrecoverable rate of descent towards the water".
The two helicopters came within 50m of each other, with Bushman 83's aircraft captain taking action to avoid a mid-air collision.
The report found the helicopters were conducting manoeuvres during rain showers which limited visibility. The chopper was flying with its cabin doors closed which also restricted visibility.
The report identified 196 findings, resulting in 46 recommendations across the Defence Aviation Safety Program.
All of the recommendations have been accepted by the Defence Aviation Authority, which has committed to their implementation.
The aviation safety investigation has been labelled one of the most complex conducted by Defence in recent history.

Kamal El Jamal fired a bullet through a garage roof of a Condell Park home on January 12, 2023, which seriously injured his partner who was 37 years old at the time. El Jamal, now 35, has been given a maximum prison sentence of seven years with a minimum of four years and three months. The bullet, fired by the then 32-year-old, pierced through the garage ceiling, past the floorboards of the bedroom directly above, through the mattress and was lodged into his partner who was laying on the bed. El Jamal drove his partner to Bankstown Hospital shortly after. She suffered serious injuries to her chest, ribs, spine, and liver — causing paralysis below her spine. The NSW District Court heard on Friday she will never walk again. At the time of the incident, El Jamal claimed to paramedics that he "just found her like this", before he left her at the hospital and drove away. The firearm was never recovered by police. At the sentence hearing on Friday, the court heard that El Jamal has been caring for his partner, who has since forgiven him for causing her paralysis. Defence counsel April Francis said the woman, who needs assistance with daily activities like bathing and clothing, "is desirous of having the offender assist her with the state that she finds herself in". However, District Judge Sean Grant said El Jamal "should not benefit from the injuries he has occasioned." In a letter written to the court, El Jamal aimed to show remorse for his actions. The 35-year-old stated he was suffering "intense psychosis", and was "seeing and hearing things", which Judge Grant rejected as there was no evidence for these episodes. Judge Grant said if the firearm was volunteered to police after the incident occurred, it would be a sign of remorse. "A message needs to be sent to the community that if you possess and use a firearm you will be sent to jail for a long time. El Jamal had spent time in two rehabilitation centres since the incident, which Judge Grant considered during sentencing. He also said his criminal history, which included several drug matters and the contravention of an apprehended domestic violence order, disentitled him to leniency. Judge Grant said El Jamal had attempted to rehabilitate himself, but was "unable to conclude he will not be before a court again". He will be eligible for parole from April 19, 2028.

Kimberley Superintendent John Hutchison says Broome police will enforce e-scooter rules as part of a Statewide safety campaign, after an e-scooter struck and killed a Perth pedestrian. Fifty-one-year-old Thanh Phan was hit from behind by a hire e-scooter allegedly ridden by a backpacker who is accused of being three times over the legal blood alcohol limit on Saturday night. He died in hospital on Monday after undergoing surgery for a serious head injury. The British backpacker, 24-year-old Alicia Kemp, has been charged over the crash. Appearing in Perth Magistrates Court on Tuesday her bail was opposed, with prosecutors arguing she was a flight risk due to being on a working holiday visa. Ms Kemp will be remanded in custody until July 15. The latest fatality brings the number of e-scooter-related deaths to five across WA this year. The growing number of fatalities is a serious concern for the Broome-based Superintendent. 'You only have to drive around Broome for five minutes, and you will see 10 people riding around on e-scooters with no helmets on, some of them at significant speeds,' Supt Hutchison said. He spotlighted how the tourist town's urban layout puts reckless e-scooter drivers at risk. 'We haven't got the bike path systems in Broome's that some other towns have, especially in the Perth metro area, so a lot of the time e-scooter riders are riding without proper lighting.' His apprehensions are backed by a medical study showing 190 e-scooter injuries were treated at Broome Hospital between April 2023 and April 2024. The study also found that the median age for accidents was 26 years-old, equally male and female, that 55 per cent reported being intoxicated, and 75 per cent were not wearing a helmet. Supt Hutchison is warning the Broome community that if e-scooters go over 25km/h on the road and are heavier than 25 kilograms, they are classifies as off-road motorcycles, which means police can seize them if they are not on the road. The Shire of Broome said they did not intend to suspend their e-scooter trial after two local governments in Perth ordered their removal in the wake of the pedestrian's death. 'We will continue to monitor the trial closely and assess its outcomes based on local data, community feedback, and safety considerations,' the shire said. 'We acknowledge the concerns raised by recent events at the City of Perth and remain committed to ensuring the safe use of e-scooters in Broome through appropriate regulation and operator engagement.'

A Sydney man who shot his wife and severed her spine, causing 'catastrophic injuries', will spend at least four years behind bars. Kamal El Jamal, 35, fired several shots from an illegal firearm into the ceiling of his Condell Park garage, in Sydney's southwest, as his wife, Georgina Vlahos, slept in her bed directly above on January, 12, 2023. El Jamal, pleaded guilty in Downing Centre District Court in February to recklessly causing actual bodily harm and using a pistol not authorised to do so. Appearing in court for sentencing on Friday, El Jamal cried as Judge Sean Grant sentenced him to seven years in prison, with a non-parole period of four years and three months. Judge Grant said the shooting was a 'very grave example' of this type of offending, which involved 'a grave risk of death to another person'. 'The victim has no feeling below her spine … she will never walk again,' he told the court. The prosecution submitted that the victim suffered 'catastrophic injuries' and would undoubtedly require 'significance assistance in various aspects of everyday life'. However, Ms Vlahos had previously written to the court requesting that El Jamal be her caregiver and saying she had 'forgiven' him. Details of the horrific injuries he inflicted upon his then partner were previously read out in court. It wasn't until about 30 minutes after the bullet travelled through the garage ceiling, the floorboards of the main bedroom and the mattress of the bed and hit Ms Vlahos that El Jamal called out to a neighbour for help. The shots severed Ms Vlahos's spine and caused significant damage to her liver and spleen. She suffered a devastating spinal cord injury and was told she would never walk again. At the time of the shooting, El Jamal was 'significantly affected by drugs' and 'did not intend to harm his partner or anyone else', his Legal Aid barrister Ertunc Ozen previously told the court. Court documents say Ms Vlahos told paramedics that she 'didn't remember anything' upon her arrival at Bankstown Hospital, and she 'could not feel her legs'. CCTV footage from the day of the incident shows El Jamal driving up to the ambulance bay in a Mercedes-Benz before stopping and getting out of the vehicle. He then approached paramedics and yelled 'help her, you've got to come and help her', before telling them he 'just found her like this'. While paramedics were tending to Ms Vlahos, El Jamal fled the scene on foot. The reasoning for firing the shot is not known, the court was told on Friday, and the pistol was never recovered. 'It is disturbing that the firearm has not been recovered and that it remains in the community,' Judge Grant told the court. El Jamal's bail was refused during a hearing in February and he was remanded in custody. He will be eligible for parole in April 2028.
