
App-based cab drivers go on strike in city, leave hapless citizens in lurch
Jaipur: App-based cab services in Jaipur came to a standstill on Monday as owners' and drivers' associations started an indefinite strike. With over 23,000 app cabs keeping away from city roads, commuters, particularly those at the airport, railway stations, and bus stands, struggled to find transport.

Offline autorickshaws were the only available option, with drivers making hay, overcharging passengers.
The strike saw the participation of approximately 25,000 app-based cab drivers, 20,000 auto drivers, and 10,000 commercial bike and taxi operators. Their demands included implementation of the gig workers' welfare legislation, fare regulation, and adherence to the Motor Vehicles Act. The state is awaiting the implementation of the Rajasthan Platform Based Gig Workers (Registration and Welfare) Act, 2023, passed by the Gehlot govt.
Protesters who work for Ola, Uber, Rapido, and inDrive platforms urged the state govt to enforce prescribed fares, remove non-compliant private bikes, and ensure aggregators follow the Motor Vehicles Act. They also called for a city taxi policy to maintain a supply-demand equilibrium. While the services are expected to resume on Tuesday, the protests will continue.
"The main reasons for this strike are the increasing exploitation of operators by these companies, unfair fare policies, violations of the Motor Vehicles Act, and non-compliance with motor vehicle aggregator guidelines," said Ashish Arora, president of the Rajasthan Gig and App-Based Workers' Union.
"Drivers claim that due to intense competition among these companies, fares are being reduced unfairly, threatening their livelihoods. Additionally, these companies have engaged thousands of private bike riders, which is illegal under the MV Act," he added, saying while the strike was scheduled only for Monday, the protest would continue.
Devendra Jain, a businessman, who was affected by the strike said, "Generally, from airport to my Malviya Nagar home, app cabs charge around Rs 150 to 170.

On Monday, I was surprised to find that no cabs were accepting bookings on any of the apps. When I found out there was a strike, I headed for the auto stand at the airport. The driver straightaway asked for Rs 400."
Some drivers continued operations despite the strike, taking advantage of increased fares. Union representatives intercepted operating vehicles, warning drivers without troubling passengers. In certain instances, they removed booking applications from the mobile devices of drivers.
The associations presented two primary demands: Revision of fares according to govt-prescribed rates and enhanced safety measures for both drivers and passengers.
"For car rental services, the govt has set a fare of Rs 25 per km and a minimum fare of Rs 150 within city limits. For outstation, it is fixed at Rs 12 per km. We want app cabs to charge fares based on this rate. From Tuesday, we are going to demonstrate in front of the commissionerate and on VT Road in Mansarovar," stated Sanjay Ratnu, president of Krantikar Taxi Drivers' Association, Jaipur.

Courts must remain vigilant against the weaponisation of criminal law for settling civil disputes as the law, when misused, ceases to be a shield and becomes a sword, said the High Court of Karnataka while quashing a criminal case registered against a man by his business partner by invoking provisions of the SC/ST (Prevention of Atrocities) Act, 1989, to settle a financial dispute. 'The complainant to take revenge or arm twist the petitioner for financial dispute, has made use of the criminal justice system. The subject complaint is a blade of vengeance, cloaked in the garb of law,' the court observed. Justice M. Nagaprasanna made these observations while quashing the criminal proceedings against Vilas Bhormalji Oswal on a complaint lodged by his estranged business partner Somashekara of Bengaluru. Case background Mr. Oswal and Mr. Somashekara were partners in Green Land Infra, a real estate development firm established in 2011, with the former being authorised signatory of the firm and the latter being the managing director. However, certain differences cropped up between them leading to closure of the business in 2016 resulting in unresolved disputes. Meanwhile, Mr. Somashekara, who is a Scheduled Caste (SC), lodged a complaint with the Directorate of Civil Rights Enforcement (DCRE) in April 2021 alleging that Mr. Oswal had made a casteist remark against him in December 2020. However, the DCRE had not acted on the complaint for nearly three years. Interestingly, the DCRE in February, 2024, recorded the statement of Mr. Somashekara and in March 2024 recorded the statements of two witnesses, known to Mr. Somashekara, who stated that they were present when Mr. Oswal allegedly abused the complainant. After recording the statements, the DCRE forwarded the complaint to the Jayanagar police in April 2024 for registering the criminal case. The police, after investigation, filed the charge sheet against Mr. Oswal and a trial court took cognisance of offences against him in June, 2024. However, the HC pointed out that the only allegation against Mr. Oswal in the complaint was that he told Mr. Somashekar at the playground, 'do not show your casteist mindset' and there was no allegation that the petitioner abused Mr. Somashekar by taking the name of his caste or that the so-called abuse was made in front of two persons, who were treated as witnesses after four years. Not in complaint 'The so-called eyewitnesses again are to be held to have been procured later, as there is no narration in the complaint that the incident was witnessed by two eyewitnesses nor the eyewitnesses would say that they accompanied the complainant to the ground,' the court observed while stating that if this case is permitted to proceed on these glaring facts, it would amount to an egregious abuse of legal machinery.

More overtime work, registration waiver among Punjab Shops and Establishments Act tweaks cleared by cabinet
The Punjab cabinet on Wednesday gave its nod to a major amendment to the Punjab Shops and Commercial Establishments Act 1958 to reduce compliance burdens on 95 per cent of small businesses and to enhance the ease of doing business in the state. The decision was taken at a cabinet meeting held at Chief Minister Bhagwant Mann's official residence. Addressing the media on the cabinet decision, Mann said the amendment was aimed at getting shopkeepers, who form 85 per cent of all traders, out of inspector raj. He said that all establishments employing up to 20 workers would now be exempted from all provisions of the Act. This move is expected to directly benefit lakhs of shopkeepers across Punjab. However, such establishments will still be required to submit relevant information to the labour department within six months of the Act coming into force or the commencement of their business. The permissible overtime in a quarter has been increased from 50 hours to 144 hours. Additionally, the daily spread-over period of work has been extended from 10 hours to 12 hours, inclusive of rest intervals. Nevertheless, employees must be paid overtime at double the regular rate for work exceeding nine hours per day or 48 hours per week. The registration process has also been streamlined and the establishments with 20 or more employees will now receive deemed approval for registration within 24 hours of application submission. Under the amendment, establishments employing up to 20 workers are required to provide only basic information and are not obligated to register. Moreover, penalties under sections 21 and 26 have been rationalised—raising the minimum fine from Rs 25 to Rs 1,000 and the maximum from Rs 100 to Rs 30,000. Now class-wise amendments will be made in the amended Act and it will be introduced in the upcoming Assembly session for approval. Mann said that all the stakeholders would be consulted. The chief minister said that if a shopkeeper or the owner of an institution makes his workers work more than the stipulated time and does not even pay double the money, the workers can complain to the labour inspector. Earlier they had to go to the labour court. To prevent harassment and allow businesses time to achieve compliance, a three-month grace period will be provided between the first and second offences, as well as subsequent ones. A new section 26A has also been introduced to allow for the compounding of offences, thereby decriminalising the Act and eliminating the need for shopkeepers to attend court. Meanwhile, all the securities and rights provided by various labour laws will be adhered to for safeguarding the interests of the labourers, according to the government.
