NPA addresses public misinformation in Welkom lawyer's rape case

The National Prosecuting Authority (NPA) has dispelled misinformation regarding the criminal proceedings against rape and sexual offences accused Jan Gysbert Maritz, a well-known attorney from Welkom.
According to NPA spokesperson Mojalefa Senokoatsane, the recent 'dissemination of misinformation' was noted with concern and in a statement snubbed out public claims that suggested that 'nothing has happened in the matter' or that 'Maritz has not been found guilty'.
In an effort to correct the public record, reinforce understanding of the criminal justice process, and protect the dignity and privacy of the victims, Senokoatsane confirmed that 57-year-old Maritz has, in fact, been convicted of multiple serious sexual offences, including rape, by the High Court of South Africa, Free State Division, Bloemfontein.
'Maritz was charged with 18 counts under the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007, as well as an additional count of assault. The sexual offences occurred over a period of seven years, from 2007 to 2014, across the towns of Virginia, Welkom, and Odendaalsrus in the Free State Province. All victims of the sexual offences were under the age of 18 at the time the offences were committed.
'On 17 May 2021, Maritz initially pleaded not guilty. However, on 21 May 2021, he made formal admissions in terms of Section 220 of the Criminal Procedure Act 51 of 1977, which were accepted by the court. Based on these admissions, the high court convicted him on 16 counts, including three counts of rape and several other counts involving sexual offences against minors,' said Senokoatsane.
Following his conviction, Maritz changed his legal representation and appointed Advocate Dawie Joubert SC, who launched two applications:
An application for the recusal of the presiding judge, Judge Naidoo, on grounds of alleged bias; and
An application to withdraw the Section 220 admissions, which had formed the basis of the conviction.
The high court dismissed both applications, affirming that the trial had been conducted fairly and without prejudice.
Maritz's recusal application was dismissed by the Supreme Court of Appeal, and subsequently, the Constitutional Court also declined to entertain the matter, effectively exhausting all avenues of appeal regarding the recusal. Maritz's efforts to withdraw his Section 220 admissions have also, to date, been unsuccessful.
Maritz is expected to be sentenced on 6 October, in the High Court of South Africa, Free State Division. The court is set to consider imposing the prescribed minimum sentence of life imprisonment.
'The NPA condemns the deliberate spread of misinformation concerning this case. Such actions not only undermine public confidence in the criminal justice system but also risk inflicting further emotional harm and secondary trauma on survivors. The NPA urges all members of the public to refrain from making or disseminating inaccurate statements that may interfere with the proper administration of justice.
'The NPA remains resolute in its constitutional mandate to uphold the rule of law, ensure justice for victims of sexual and gender-based violence, and hold offenders accountable, regardless of their professional or social standing. The Authority will continue to prosecute all matters without fear, favour, or prejudice,' said Senokoatsane.
In the denied recusal application, presiding Judge Somaganthie Naidoo refused to recuse herself from the criminal trial.
According to the court record, after Maritz was convicted on his guilty plea he was released on bail with certain conditions, pending sentencing proceedings.

Thabo Enoch Theletsane, 41, faced charges of fraud and impersonation during a hearing at the Hatfield Magistrate's Court. According to the National Prosecuting Authority (NPA), Theletsane contacted a prominent businessman via WhatsApp, using a profile picture of Lebeya, the former National Head of the Directorate for Priority Crime Investigation (DPCI). This incident occurred while he was out on parole, having been released on 24 October 2024 after serving a sentence for previous fraud offences. During the call, he allegedly claimed his phone had been hacked and that the businessman would be contacted by 'Mr. Mokoena,' purportedly a police officer from the cybercrime unit. "Posing as 'Mr. Mokoena,' Theletsane allegedly told the businessman that his phone had been hacked and offered to 'clean' it. He is accused of requesting the businessman's frequently used contact numbers, which he then obtained. The accused allegedly asked the businessman to make a payment for a hard drive to store his information; however, this payment was not made," said the NPA in a statement released on Monday. In a separate incident, Theletsane allegedly contacted another complainant using the numbers supplied by this businessman. He allegedly told the second complainant that their phone had been hacked and requested a payment of R50,000 for a hard drive to store their information. The complainant paid the money. However, after realising they were defrauded, both victims reported the matter to the police a week later, on November 1, 2024. Following an investigation, Theletsane was arrested on May 10, 2025. He further argued that the parole board had indicated it would reconsider revoking his parole if he were granted bail. However, Prosecutor Dikeledi Moganyaka opposed the bail application, presenting an affidavit from investigating officer Mpho Phantinah Dlamini. The affidavit revealed that Theletsane had deliberately provided a false address during the investigation and had two prior convictions for fraud and forgery from 2020, making him a likely candidate to reoffend if released. In delivering judgment, the magistrate agreed with the State that the accused has a propensity to commit crimes since he is alleged to have committed the current offences just days after being released on parole. The court also found his claims about the parole board to be unsubstantiated and ruled that releasing him would not be in the interest of justice. The matter was postponed to September 2, 2025 for transfer to Court 16 at the Pretoria Magistrate's Court. IOL

Man's fake threats to skip work earns him real jail time
Fortuin admitted that he had been drinking heavily the day before and 'did not want to go to work the following day'. A 50-year-old Bellville man who sparked mass panic by making hoax bomb threats to police has been sentenced to five years' direct imprisonment. The Bellville regional court convicted Ferdinand Fortuin on three counts under the Protection of Constitutional Democracy Against Terrorism and Related Activities Act (POCDATARA), after he falsely claimed to have planted explosives at the Department of Water and Sanitation, Transnet offices and the Bellville taxi rank. The threats, made on 11 November 2024, forced the evacuation of more than 3 500 people and the deployment of multiple specialised police units. Bomb scare to avoid work According to the National Prosecuting Authority (NPA), Fortuin admitted in his plea and sentencing agreement that he had been drinking heavily the day before and 'did not want to go to work the following day'. 'He left his home in Mamre, expecting the roads leading to Bellville to be closed because of his bomb threats. They were not, and he worked the whole day,' the NPA said. Fortuin confessed to buying a cellphone from a drug user to make the hoax calls, including one to the toll-free emergency number, claiming to have placed explosives at the three locations, one of them being his own workplace. 'At the water and sanitation department offices on Voortrekker Road, police assisted by three bomb disposal technicians, the K-9 Dog Unit, and visible policing unit members evacuated 164 people,' the NPA said. Another 151 people were evacuated from the department's Bellville South offices. Police also cleared 250 people from the Transnet Park Building and evacuated around 3 000 people from the Bellville taxi rank, which was subsequently closed. Roads in and out of the rank were blocked, causing widespread disruption and panic. The court noted that he was a first offender, had pleaded guilty, shown remorse, and had 'strong personal circumstances' making him a candidate for rehabilitation. He was sentenced to five years' direct imprisonment on all charges combined. NPA regional spokesperson Eric Ntabazalila said they accepted the court's decision but warned that similar offences would be met with severe consequences. 'The NPA will not hesitate to prosecute conduct of this nature to the full extent that the law allows,' he said. Amantle Samane case: Pethe Sara Simao to plead guilty on all counts — lawyer
The case has been postponed. The legal representative for Pethe Sara Simao, the Mozambican national accused of the rape and murder of Amantle Samane, said the accused will plead guilty on all four counts. Simao made a brief appearance in the High Court of South Africa, Gauteng Division in Johannesburg, on Monday. Speaking to the SABC News following his appearance, Advocate Ndivhuwo Masindi confirmed his client had decided to plead guilty on all four counts. After a thorough consultation with my client, we decided that he will plead guilty on all four counts. We took the decision after receiving the disclosure from the state,' said the advocate. 'He indicated that he does not want to waste the state's time by going for a long trial. This is why he has now decided to plead guilty.' The Simao is facing charges of kidnapping, rape, murder and contravention of the Immigration Act. The case has been postponed to Friday, 15 August 2025. Amantle Samane case In October last year, the community of Orlando East in Soweto went from house to house searching for a man responsible for the rape and murder of six-year-old Samane. Samane's half-naked body was found in an empty shack two streets away from her home. ALSO READ: NPA confident of conviction in Amantle Samane murder case Police reported that the girl was playing with other children when the suspect, Simao, called her to his rented shack at one of the houses in Orlando. He allegedly raped and killed the girl inside the shack. He went into hiding following the incident. Community cooperation led to the arrest of the suspect. Simiao, who abandoned his bail application, was previously hospitalised after being assaulted in jail. When he appeared in court on 1 November 2024, the accused complained of injuries to his stomach, legs, and body.
