Trump administration blocked from cutting local health funding for four municipalities

A federal court has temporarily blocked the Trump administration from clawing back millions in public health funding from four Democrat-led municipalities in GOP-governed states.
It's the second such federal ruling to reinstate public health funding for several states.
U.S. District Judge Christopher Cooper in Washington, D.C., issued a preliminary injunction Tuesday sought by district attorneys in Harris County, Texas, home to Houston, and three cities: Columbus, Ohio, Nashville, Tennessee, and Kansas City, Missouri. The decision means the federal government must reinstate funding to the four municipalities until the case is fully litigated.
'The federal government cannot simply ignore Congress and pull the plug on essential services that communities rely on,' Harris County Attorney Christian Menefee said. 'Today's decision ensures we can keep doing the work that protects our residents — from tracking disease outbreaks to providing vaccinations and supporting vulnerable families.'
Their lawsuit, filed in late April, alleged $11 billion in cuts to U.S. Centers for Disease Control and Prevention programs had already been approved by Congress and are being unconstitutionally withheld. They also argued that the administration's actions violate Department of Health and Human Services regulations.
The cities and counties argued the cuts were 'a massive blow to U.S. public health at a time where state and local public health departments need to address burgeoning infectious diseases and chronic illnesses, like the measles, bird flu, and mpox.' The cuts would lead to thousands of state and local public health employees being fired, the lawsuit argued.
The local governments, alongside the American Federation of State, County and Municipal Employees union, wanted the court to reinstate the grants nationwide. But Cooper said in his preliminary injunction that the funds can only be blocked to the four municipalities and in a May 21 hearing expressed skepticism about whether it could apply more widely.
The funding in question was granted during the COVID-19 pandemic but aimed at building up public health infrastructure overall, Menefee said in a statement in April.
The four local governments were owed about $32.7 million in future grant payments, Cooper's opinion notes.
The federal government's lawyers said the grants were legally cut because, "Now that the pandemic is over, the grants and cooperative agreements are no longer necessary as their limited purpose has run out.' They used the same argument in the case brought by 23 states and the District of Columbia over the HHS funding clawback.
Menefee said the cuts defunded programs in Harris County for wastewater disease surveillance, community health workers and clinics and call centers that helped people get vaccinated. Columbus City Attorney Zach Klein said the cuts forced the city to fire 11 of its 22 infectious disease staffers.
Nashville used some of its grant money to support programs, including a 'strike team' that after the pandemic addressed gaps in health services that kept kids from being able to enroll in school, according to the lawsuit.
Kansas City used one of its grants to build out capabilities to test locally for COVID-19, influenza and measles rather than waiting for results from the county lab. The suit details that after four years of work to certify facilities and train staff, the city 'was at the final step" of buying lab equipment when the grant was canceled.
Representatives for HHS, the CDC and the cities did not immediately respond to requests for comment Tuesday.

Hong Kong's Hang Seng dropped 1.2% to 23,695.62 while the Shanghai Composite Index retreated 0.2% to 3,380.47. The Kospi in Seoul gained 0.6% to 2,967.89 while Australia's S&P/ASX 200 shed 0.2% to 8,528.50. On Tuesday, U.S. stocks slumped under the weight of higher oil prices and weaker than expected retail sales in May. The S&P 500 fell 0.8% to 5,982.72 and the Dow Jones Industrial Average dropped 0.7% to 42,215.80. The Nasdaq composite fell 0.9% to 19,521.09. Secretary of State Marco Rubio, who accompanied Trump to Canada, was calling counterparts on Monday to discuss the situation, but he told some of them that the United States did not intend to join the Israeli attack on Iran, according to three officials familiar with the calls who spoke on the condition of anonymity to talk frankly about the private discussions. By Tuesday, those officials said they believed the U.S. position had changed and that Trump was considering joining the attack. Sen. 'I think he's very calm, very resolved,' Graham said. 'I don't think Israel can finish Fordow without our help, and it's in our interest to make sure this program is destroyed, as much as it's Israel's. And so if there's something you need to do to help Israel, do it.' Advertisement Trump was supposed to remain in Canada on Tuesday, but he dashed back to Washington a day early, saying that he needed to be in Washington to monitor the situation in the Middle East. German Chancellor Friedrich Merz, who met with Trump in Canada, expressed gratitude on Tuesday for Israel's attack on Iran, saying that Israel was doing 'the dirty work … for all of us.' 'We are also affected by this regime,' Merz told Germany's ZDF broadcaster on the sidelines of the summit. 'This mullah regime has brought death and destruction to the world.' While some of Iran's nuclear facilities have been attacked in recent days by Israel, the most significant is the Fordow enrichment plant, which is buried deep underground and inside a mountain. U.S. officials have said the center can be effectively attacked only with massive, 'bunker-busting' bombs, including the GBU-57, a 15-ton round known as the 'massive ordnance penetrator,' or MOP. The 20-foot-long bomb is carried by the B-2 Spirit, the bat-wing-shaped stealth bomber. The fleet is based at Whiteman Air Force Base in Missouri and previously has been deployed for global bombing runs in which they rely on aerial refueling to fly to and from targets without stopping. Should the Pentagon use other kinds of bombs to attack Iran, it could rely on an array of other aircraft, including fighter jets already in the region and B-52s. The Pentagon temporarily relocated some of these aircraft recently to Diego Garcia, an island with a joint U.S.-British military base in the Indian Ocean. Advertisement Trump's claim of control over Iran's skies may be an indication that U.S. officials have assessed that most of Iran's air defense have been destroyed by Israel in recent days. Since Israel launched the attack on Iran late last week, U.S. officials have bolstered their extensive presence in the region but have repeatedly stressed that they are doing so for defensive purposes only. Trump has contradicted that messaging, however, warning Iranians in Tehran, a city of about 10 million people, that they should evacuate. While the U.S. military had not launched any strikes on Iran as of Tuesday afternoon, defense officials said, it has assisted Israel in other ways, including using Navy destroyers off the coast and fighter jets to shoot down Iranian munitions fired toward Israel. Gen. Michael 'Erik' Kurilla, the top U.S. commander overseeing operations in the Middle East, who has advocated a hawkish approach toward Tehran, told the House Armed Services Committee last week that he has presented a 'wide array of options' to Trump and Defense Secretary Pete Hegseth if they choose to pursue military force against Iran. Kurilla told lawmakers that the United States 'now stands in a strategic window of opportunity to secure its national interests' in the Middle East - including preventing a nuclear-armed Iran. Most experts assess that Iran would need a week to produce enough highly enriched uranium for a bomb. But they say that it would take months, up to a year, to turn the uranium into a weapon. In Canada, while Merz backed Israel, other leaders were less outspoken or spoke in thinly veiled disagreement. Advertisement French President Emmanuel Macron told reporters in Canada on Tuesday that a ceasefire and ongoing negotiations were the only solution. 'I think that people are sovereign, they change their leaders by themselves and all those who have wanted in the past to change regimes through strikes or military operations have made strategic errors,' he said. Kaja Kallas, the top European Union diplomat, said that E.U. foreign ministers who held an emergency virtual meeting Tuesday morning were united in their call for de-escalation. 'When it comes to the United States getting involved, then it will definitely drag the region into a broader conflict, and this is in nobody's interest,' Kallas said. Rubio, in a telephone call Monday night, 'emphasized that it is also not in their interest to be drawn into this conflict,' she said. Elsewhere in the Middle East, Egyptian Foreign Minister Badr Abdelatty urged de-escalation and negotiations in phone calls Tuesday with both Araghchi and U.S. envoy Steve Witkoff. In Qatar, Foreign Ministry spokesman Majed al-Ansari said his government was one of many in the region exerting efforts to 'reach calm that spares the region the repercussions of this dangerous escalation of the Israeli aggression against the Islamic Republic of Iran.' Israel continued to pummel Iran Tuesday, using about 60 fighter jets to target 12 missile launch and storage sites, many in western Iran, Israel Defense Forces spokesman Effie Derfin said Tuesday night. Israel's military also claimed Tuesday to have killed Ali Shadmani, whom it described as Iran's wartime chief of staff. Israel did not present evidence of the assassination, and Iran did not immediately confirm his death. Iran's supreme leader appointed Shadmani to his position four days ago after his predecessor, Gholam Ali Rashid, was killed in Israeli attacks on Friday. Iranian civilians streamed out of the capital overnight and into Tuesday. It was the International Atomic Energy Agency's first assessment that the centrifuge halls buried deep underground may have been damaged. Iran's retaliatory barrages against Israel carried on for a fifth day, triggering Israel's air defenses on an 'hourly basis,' the military official said. The Iranian attacks have killed 24 people in Israel and injured more than 600, the Israeli government said Tuesday. Iranian authorities said that 224 people had been killed by Israeli strikes as of Sunday, the most recent figures available. They did not differentiate between military and civilian casualties. Senate Republicans double down and target clean energy in draft tax bill

Tax credits for clean energy and home energy efficiency would still be phased out, albeit less quickly, under Senate Republicans' latest proposed changes to a massive tax bill. Electric vehicle incentives and other provisions intended to move the United States away from fossil fuels would be gutted rapidly. Senate Republicans cast their version of the bill as less damaging to the clean energy industry than the version House Republicans passed last month, but Democrats and advocates criticized it, saying it would still have significant consequences for wind, solar and other projects. Ultimately, wherever Congress ends up could have a big impact on consumers, companies and others that were depending on tax credits for green energy investments. It could also impact long-term how quickly America transitions to renewable energies. 'They want everybody to believe that after the flawed House bill, that they have come up with a much more moderate climate approach," said Sen. Ron Wyden of Oregon, the top Democrat on the finance committee, during a conference call with reporters Tuesday. 'The reality is, if the early projections on the clean energy cuts are accurate, the Senate Republican bill does almost 90%" as much damage as the House proposal, added Wyden, who authored clean energy tax credits included in the 2022 Inflation Reduction Act passed during former President Joe Biden's term. 'Let's not get too serious about this new Senate bill being a kinder, gentler approach.' The Edison Electric Institute, a trade association representing investor-owned electric companies, issued a statement applauding the Senate proposal for including 'more reasonable timelines for phasing out energy tax credits.' 'These modifications are a step in the right direction,' said the statement from Pat Vincent-Collawn, the institute's interim chief executive officer, adding that the changes balance 'business certainty with fiscal responsibility.' Whether all of the changes will be enacted into law isn't clear yet. The Senate can still modify its proposals before they go to a vote. Any conflicts in the draft legislation will have to be sorted out with the House as the GOP looks to fast-track the bill for a vote by President Donald Trump's imminent Fourth of July target. Notably, many Republicans in Congress have advocated to protect the clean-energy credits, which have overwhelmingly benefited Republican congressional districts. A report by the Atlas Public Policy research firm found that 77% of planned spending on credit-eligible projects are in GOP-held House districts. The clean energy tax credits stem from Biden's climate law, which aimed to boost to the nation's transition away from planet-warming greenhouse gas emissions and toward renewable energy such as wind and solar power. The House version of the bill took an ax to many of the credits and effectively made it impossible for wind and solar providers to meet the requirements and timelines necessary to qualify for the incentives. After the House vote, 13 House Republicans lobbied the Senate to preserve some of the clean energy incentives that GOP lawmakers had voted to erase. Language included Monday in the reconciliation bill from the Senate Finance Committee would still phase out — though more slowly than House lawmakers envisioned — some Biden-era green energy tax breaks. The Senate proposal further 'achieves significant savings by slashing Green New Deal spending and targeting waste, fraud and abuse in spending programs while preserving and protecting them for the most vulnerable,' said Sen. Mike Crapo, R-Idaho and chairman of the committee. On the chopping block are tax credits for residential rooftop solar installations, ending within 180 days of passage, and a subsidy for hydrogen production. Federal credits for wind and solar would have a longer phaseout than in the House version, but it would still be difficult for developers to meet the rules for beginning construction in order to receive the credit. At the same time, it would boost support for geothermal, nuclear and hydropower projects that begin construction by 2033. 'The bill will strip the ability of millions of American families to choose the energy savings, energy resilience, and energy freedom that solar and storage provide,' said Abigail Ross Hopper, president and CEO of the Solar Energy Industries Association. 'If this bill passes as is, we cannot ensure an affordable, reliable and secure energy system.' Opponents of the Senate's text also decry domestic manufacturing job and economic losses as a result. 'This is a 20-pound sledgehammer swung at clean energy. It would mean higher energy prices, lost manufacturing jobs, shuttered factories, and a worsening climate crisis,' said Jackie Wong, senior vice president for climate and energy at the Natural Resources Defense Council. The bill would also cancel incentives such as the Energy Efficient Home Improvement credit — which helps homeowners make improvements such as insulation or heating and cooling systems that reduce their energy usage and energy bills — 180 days after enactment. An incentive for builders constructing new energy-efficient homes and apartments would end 12 months after signing. The House's proposed end date for both is Dec. 31. 'Canceling these credits would increase monthly bills for American families and businesses,' Steven Nadel, executive director of the nonprofit American Council for an Energy-Efficient Economy said in a statement. The Senate proposal moves up the timeline for ending the consumer electric vehicle tax credit from the end of this year to 180 days after passage. It also cuts the provision that would have extended until the end of 2026 a credit for automakers that had not made 200,000 qualifying EVs for U.S. sale. It would also immediately eliminate the $7,500 credit for leased EVs. This administration has staunchly gone after EVs amid Trump's targeting of what he calls a 'mandate,' incorrectly referring to a Biden-era target for half of new vehicle sales by 2030 be electric. ___
