Allahabad HC bins Patanjali's plea against Rs 273 crore GST penalty

File photo PRAYAGRAJ: Allahabad high court has dismissed a petition by yoga practitioner Ramdev's Patanjali Ayurved Ltd challenging a Rs 273.5-cr penalty imposed by GST authorities. In a recent order, a bench of Justices Shekhar B Saraf and Vipin Chandra Dixit rejected Patanjali's argument that such penalties constituted criminal liability and could be imposed only after a criminal trial. The court cited Section 122 of CGST Act, 2017, and held that such fines could be imposed through civil proceedings, without requiring criminal trials. The HC pointed out that GST penalty proceedings were civil in nature and could be adjudicated by proper officers and 'were not required to undergo prosecution'. According to GST authorities, Patanjali came under investigation following information about suspicious transactions involving firms with high input tax credit (ITC) utilisation but no income tax credentials. The investigation led to allegations that Patanjali 'indulged in circular trading of tax invoices only on paper without actual supply of goods'. Directorate General of Goods and Services Tax Intelligence (DGGI), (Ghaziabad circle) issued Patanjali a showcause in April 2024 proposing the penalty of Rs 273.51. The company then moved the HC.

SSC introduces Aadhaar based verification to enhance recruitment transparency

Prayagraj: Aimed at enhancing transparency in recruitment across various ministries, offices, and departments under the Central Govt, the Staff Selection Commission (SSC) has officially implemented Aadhaar-based verification at all stages of its recruitment process. The SSC released its policy framework on Friday, outlining the integration of Aadhaar authentication in recruitment procedures. According to the commission, verifying candidates' identity at multiple stages of the recruitment process is essential to maintain the integrity and fairness of selection. While traditional methods like photo and biometric verification have been in use, Aadhaar authentication is expected to serve as an additional, more robust measure to prevent fraud. Though Aadhaar verification will remain optional, the SSC is encouraging candidates to opt for it due to its efficiency and reliability. Candidates who opt out of Aadhaar verification will be required to upload multiple supporting documents such as PAN card, passport, voter ID, driver's licence, birth certificate, school certificates, utility bills, bank passbooks, rent agreements, and a recent passport-sized photograph. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Beyond Text Generation: An AI Tool That Helps You Write Better Grammarly Install Now Undo These documents must be clear, updated and verifiable. Additionally, such candidates must report to the examination centre at least two hours before gate closure for manual verification. The key advantage of Aadhaar authentication is smoother processing and fewer checks during the examination process. Candidates opting for Aadhaar-based verification will face fewer document checks, and minor discrepancies in photographs or signatures will not result in rejection of applications. Moreover, they will be allowed to report closer to the scheduled entry time due to reduced physical verification formalities. Verification stages include Aadhaar OTP-based verification during One-Time Registration (OTR), Aadhaar facial authentication while submitting applications, fingerprint or iris-based biometric verification at the examination centre, Aadhaar authentication during physical/medical tests, and final verification at document review and appointment stages.
