2 former apartheid officers' bid to get off the hook for Caiphus Nyoka murder fails
PRETORIA - The latest bid by two former apartheid police officers to get off the hook for the murder of student activist Caiphus Nyoka has failed in the Pretoria High Court.
Judge Ismail Mohammed delivered the judgment on Thursday morning.

Sixty-three-year-old Abram Engelbrecht, 62-year-old Pieter Stander, and 75-year-old Leon van den Berg, who were members of the reaction unit of apartheid police, are accused of shooting the student activist multiple times in his Daveyton home.
In 2024, a fourth accused, Johan Marais, pleaded guilty and is yet to be sentenced.
Lawyers for van den Berg and Engelbrecht brought a Section 174 discharge application this week, arguing that the State had no evidence against them that could lead to a conviction.
Mohammed delivered his verdict but did not give a comprehensive judgment.
'Having heard counsel, the court is of the view that the application for a discharge in terms of Section 174 of the Criminal Procedure Act should be refused.'
Mohammed said he would be incorporating the full judgment, detailing the reasons for his ruling in the final overall judgement in the matter.
That means the defence will now have to open its case and call its witnesses.

Ex-constable Johannes Shuping was sentenced to six years for soliciting bribes to tamper with a police docket. The Kuruman Regional Court in Northern Cape has sentenced a former police officer to six years' imprisonment for soliciting R10 000 to make a court docket disappear. Ex-constable Johannes Shuping was sentenced after the court convicted him on two counts of corruption from an incident that dates back to 2018. Shuping, then a detective at Kathu police station, re-arrested the complainant, Buti Moepadira, despite his case already being before the court. Former Saps officer jailed for corruption After Shuping arrested Moepadira, the accused offered to 'make the docket disappear' in exchange for R11 000. National Prosecuting Authority (NPA) regional spokesperson Mojalefa Senokoatsane said the complainant was detained at the Kathu police station due to lack of accommodation in Kuruman. 'A R6 000 cash payment was delivered to the accused by the complainant's brother. Shuping continued to demand the outstanding R5 000, prompting Moepadira to report the matter to the Directorate for Priority Crime Investigation (the Hawks),' Senokoatsane said. In response, the investigating officer launched a sting operation using marked banknotes, as permitted by Section 252A of the Criminal Procedure Act. Caught in Hawks sting after demanding R11k bribe During the operation, Moepadira's brother handed over the remaining R4 000 to the accused. Although the former officer fled the scene, police arrested him a week later at his workplace. 'At the time of his arrest, he was found in possession of marked R200 notes, which matched the serial numbers recorded during the operation,' Senokoatsane said. As a law enforcement official, he had a duty to uphold the law, but he chose to violate both the Constitution and his oath. A severe punishment will deter similar misconduct and help restore public confidence in the criminal justice system, Barnett emphasised. Six year direct imprisonment The Kuruman Regional Court agreed and sentenced Shuping to six years' direct imprisonment on each count. The court ordered the sentences to run concurrently, resulting in an effective six-year prison term. The NPA welcomed the conviction and sentence. Zandile Gumede's lawyer claims State has ignored court order in fraud investigation

Image: Tumi Pakkies / Independent Newspapers It has been 10 days since the Durban High Court issued an order compelling the State to disclose evidence regarding a fraud investigation into former mayor of eThekwini, Zandile Gumede. However, her lawyer says the State has not honoured the court's order. Gumede is currently on trial with 21 others for money laundering, racketeering, fraud, corruption, and contravention of the Municipal Finance Management Act and the Municipal Systems Act, relating to the R320 million Durban Solid Waste (DSW) tender. The evidence sought by the defence is a report done by Masama Consulting, which found that the appointment of the Integrity Forensic Solutions (IFS) was unlawfully made by eThekwini's City Integrity and Investigations Unit (CIIU). According to the evidence before the court, CIIU received a stack of documents alleging irregularities in the DSW tender. The IFS was then hired to look into it. Following an investigation by the IFS, the Hawks were given the case, and arrests were made. On Friday morning, Gumede's counsel, advocate Jay Naidoo SC, told the court that the 10 days had passed and the State had not given him anything. Counsel appointed by the National Prosecuting Authority (NPA), advocate Reshma Athmaram, told the court that they were waiting for the eThekwini city manager's response. 'Two days after the order was issued, the investigating officer served it to the accounting officer (city manager), and we haven't received a response,' she said. Judge Sharmaine Balton said the municipality should comply with the court order. Balton said the State needed to give the defence, among other things, a whistle-blower report dated May 9, 2023, the forensic investigation report, together with all annexures compiled by Masama Consulting (mostly referred to as the Masama report), and the CIIU's recommendations on actions to be taken. Additionally, she said a copy of the record of the disciplinary proceedings instituted against the CIIU's top investigator by the municipality should be made available to the defence. She added that a charge sheet served on the CIIU investigator and the outcome of the disciplinary tribunal must be given to the defence. Additionally, the matter was postponed to Monday as the new witness, Zithulele Mkhize, did not take the stand. This was due to the 13th accused, Mkhize, being sick. His counsel, advocate Willie Lombard, told the court that his client was sick and handed in a medical report. He submitted a copy and an original medical report.
