Calcutta HC directs closure of all union rooms in colleges and universities till new bodies are elected
education department to issue an official notice with direction to shut all student union rooms in colleges and universities across the state until the student elections are held.
The Calcutta high court's double bench comprising Justices Somen Sen and Smita Das passed this judement to this effect.
The judicial directive was passed after one Sayan Banerjee filed a Public Interest Litigation (PIL) seeking a court order on the issue after a girl student of a law college was allegedly gang raped by a fomer student and two other students. The accused former student was very influencial as he was a student leader. The incedent took place in on June 25.
The student elections were last held in 2017.
The court also ordered the state to submit an affidavit within two weeks. The next hearing on this metter is on July 17.
The court directed that the student union rooms should be locked and cannot be used for any kind of recreational
activities.
"If there is any urgent need, a formal application with valid reasons must be submitted in writing to the
university registrar," the court explained.

Pant also mentioned how, "alarmingly, there have also been instances where, despite verification reports from competent authorities in West Bengal confirming the identity and citizenship of the individuals, there has been no positive action or relief". "I appeal to you to take a humanitarian view of the matter and ensure that these individuals, who are Indian citizens, are not subjected to arbitrary detention or harassment based on linguistic or regional identity," he wrote. "It is deeply distressing to learn that many of them are being targeted solely because they speak Bengali — their mother tongue — and are being unjustly labelled as Bangladeshi infiltrators. This sweeping generalisation is not only unfair and discriminatory, but also deeply hurtful to citizens who have every right to dignity and protection under the law," Pant added. Kolkata: Senior counsel Anindya Mitra challenged the 2023 Calcutta High Court order by Justice Abhijit Gangopadhyay annulling services of 32,000 primary school teachers and argued that a court of law cannot cancel appointments of people not made parties in a case because that would constitute a violation of the principles of natural justice. Arguing before a division bench of the Calcutta HC on Thursday, Mitra said, "The petitioners who moved the single bench didn't even make such a prayer." The senior counsel restricted his arguments to the 2016 selection of primary teachers that concluded in 2017 and distinguished it from the 2014 Teacher Eligibility Test (TET). Mitra argued that the writ petition was moved five years after the selection process had concluded and pointed out that the petitioners did not make any allegations of illegality. "The basis of the illegality recorded in the judgement was the judge's own, based on irrelevant considerations. He submitted that the judge made these observations in relation to the 2014 TET and not the 2016 selection process by the Board. The senior counsel drew the division bench's attention to the part of the single bench judgement stating: "the sense of justice is above the sense of law" and argued that such a conclusion goes against the basic framework of the Constitution and rule of law. The counsel pointed out that the judge, while taking on an investigation on his own, had questioned candidates from only four of 20 districts and made a generalised observation on aptitude tests, when nine among those questioned had said that aptitude tests were held. Mitra cited SC judgements to substantiate that a court cannot generalise issues. He further pointed out from the records that the judge had initially ordered the cancellation of 36,000 teachers. Kartik Maharaj gets HC breather
Kolkata: Calcutta High Court on Thursday directed the state to not take any step against Padma Shri awardee Kartik Maharaj, who is facing rape allegations, until it hears the case. Justice Jay Sengupta's directive came as the accused moved court seeking protection after he was served a police summons. Kartik Maharaj's counsel pleaded for an in camera hearing. The state, however, held that it could be an open one. Justice Sengupta will make a decision on this matter at the next hearing on July 7.
