Changes to school retirement plan advance to full Nebraska Legislature

LINCOLN — The full Nebraska Legislature appears likely to debate a governor-backed bill to reexamine contributions for school employees' retirement plans, which the sponsor described as a 'win-win-win.'
The Nebraska Retirement Systems Committee on Monday morning voted 4-0 to advance Legislative Bill 645 by State Sen. Beau Ballard of Lincoln, the committee chair. State Sens. Brian Hardin of Gering and Danielle Conrad of Lincoln were absent from the vote, but Ballard left the vote open through at least the end of the day for both to weigh in if they choose to.
'This is a win for state tax dollars, a win for teachers and also, I believe, a win for property taxpayers as well,' Ballard told the Nebraska Examiner of his amended bill.
The school retirement plan at center stage applies to eligible school employees outside of the Omaha Public Schools, which has a separate retirement plan.
Currently, teachers and other eligible school staff contribute 9.78% of their monthly payroll to the pooled retirement plan. School districts match this at 9.88% of the amount they pay their employees, while the state contributes 2% of statewide school employee payroll each year.
The estimated payroll for teachers in Nebraska, as of July 1, 2024, was $2.5 billion annually. That means the plan took in $543 million in direct contributions — about $50 million from the state, $245 million from employees and $248 million from school districts in the most recent year.
The amended LB 645 is significantly different from when it was introduced in January, which at the time would have reduced state contributions to 0% depending on the plan's actuarial funding status, but left contribution rates for employees and school districts the same. The plan is currently 99.91% funded.
If LB 645 moves forward, contribution levels of all three groups would change at four stages based on the actuarially funded level — less than 96% funded, between 96% and 98% funded, between 98% and 100% funded and fully funded.
The state would fall to 0.7% of annual contributions at the two intermediate stages, retaining the 2% contribution level when the retirement plan is underfunded and paying zero when the plan is fully funded.
State Sen. Rob Clements of Elmwood, chair of the Legislature's Appropriations Committee, and a member of the Retirement Committee, said LB 645 could save the state $77 million over the next biennium.
The governor's office maintains that the freed-up funds should not be used to balance the state's projected budget deficit but instead to invest in education.
Under the latest version of Ballard's bill, school employees would contribute 9.75% of payroll if the plan is less than 96% funded. This would lower to 8.75% and 8%, respectively, at the intermediate stages. When fully funded, employees would contribute 7.25% of their individual pay to the plan. Employees were brought to the table for negotiations prior to LB 645's public hearing last month.
Ballard's staff provided data estimating that the average school teacher could receive $1,000 in more take-home pay if the retirement plan is more than 98% funded, as it is now, because of lower monthly contributions.
When the plan is fully funded, take-home pay for the average teacher could rise by up to $1,500 each year.
Employers would continue to contribute 101% of what their employees do, which is a first for the continued negotiations. Before, LB 645 would have locked the employer contribution rate at 9.88% of what employees are paid. Ballard said allowing lowered contributions when the retirement plans are flush could lead to reduced property taxes.
Lowered contributions at full funding would lower contributions for both employers and employees by 2.5%, potentially freeing up funding for a priority of the Nebraska State Education Association — funding more long-term substitutes so teachers can take paid time off around significant life events.
That bill, LB 440 from State Sen. Ashlei Spivey of Omaha, is planned to be advanced through the Education Committee's LB 306. An amended version of her bill seeks a 0.35% payroll tax, for both employees and employers, to fund four weeks of long-term substitutes, rather than her original proposal's idea for six weeks.
Excess funds collected under the Spivey proposal above what's needed to cover subs would be steered toward teacher retention or recruitment, such as forgivable loans for special education teachers as provided in Lincoln State Sen. George Dungan's LB 408.
Before structural changes to state retirement plans can be made, an actuarial study must assess the feasibility. The latest study came back last Thursday indicating the plan would still receive about 0.27% more funds each year than required under state law at full funding. The actuaries said this provides 'little cushion … to absorb adverse experience.'
State law currently requires that the state is on the hook for additional funding in any given year if the plan requires more funds outside of annual contributions.
The actuaries wrote that part of the 'challenge' in the future will be adjusting to the varied contribution rate, which could eat into state funds, property taxes or employee pay.
The study also takes into account a phased-in slightly lower assumed return on investment for the retirement plan. State Sen. Tony Sorrentino of the Elkhorn area, vice chair of the Retirement Committee, said normally contributions would increase in that case. The actuaries agreed this could increase risk to the retirement plan.
However, Ballard and Clements noted that one built-in fail-safe is increased contributions if the funding status of the retirement plan lowers.
The actuaries predicted the probability that the retirement plan would be fully funded about 56.4% of the time over the next 20 years, while it could be less than 96% funded about 31.5% of the time.
Ballard, who introduced LB 645 more than 50 legislative days ago, said he appreciated the feedback that he received from teachers, administrators, school boards, the Governor's Office and more, all of which he said are now on board.
Conrad clashed with Ballard at LB 645's public hearing in March in part over the bill's negotiations. She could not immediately be reached for comment Monday on the advanced bill, nor could the NSEA.
Ballard said he took the feedback of teachers and other employees with 'high consideration.'
'This is their livelihood, this is their retirement plan,' Ballard said. 'We want to make sure that they are protected because they do so much for our state, and we just really appreciate their feedback.'

(Zach Wendling/Nebraska Examiner) LINCOLN — Nebraska Secretary of State Bob Evnen is seeking reelection as the state's chief elections officer. In his campaign kick-off event Friday, the secretary of state touted the state's elections as the nation's most 'secure or accurate.' But he said he wonders whether any non-citizens might have gotten on the voter rolls. Evnen appeared to be trying to balance defending the state's elections his office administers and echoing the concerns of some Republicans and President Donald Trump over election integrity since the 2020 presidential election, national framing that some election experts have warned could undermine trust in elections. 'There is more work to be done, and we must continue to focus on being proactive in the future,' Evnen said. 'Threats to election security are not static.' U.S. Sen. Deb Fischer, R-Neb., and Lt. Gov. Joe Kelly joined Evnen's reelection announcement, as well as a handful of Nebraska state senators. Evnen is running for his third term as secretary of state, but this race follows his closest contest to date, a 2022 GOP primary in which he faced two populist Republican challengers who combined to hold him under 50% of the vote. He won the general election without any major party opponent. His office, in addition to overseeing elections, also handles business registrations and international relations. Kelly emphasized that the country has seen 'some very poorly orchestrated elections,' but 'not in Nebraska.' 'We've been so lucky to have Bob Evnen,' Kelly said. Kelly and other speakers praised Evnen for how he has represented Nebraska when speaking to other counties about trade opportunities with the state, and for his handling of elections. Nebraskans passed a state constitutional amendment in 2022 requiring the Legislature to implement voter ID in Nebraska. Nonpartisan poll watchers have praised Evnen's office for its implementation of the law, and Fewer voters were turned away under the law than in other states with similar laws. Evnen, in talking about the voter rolls and what he described as the risks of non-citizens voting, said years of the U.S. having an 'open border' left him questioning 'whether some of those people ended up on voter rolls.' Election watchdogs have said that framing from some Republicans is based on the 'myth' of widespread voting by non-citizens. The Heritage Foundation, a conservative think tank, analyzed election conduct from 2003 to 2024 and found 24 instances nationally of noncitizens voting out of millions of votes cast. Evnen also reemphasized his support for Trump's executive order overhauling the administration of U.S. elections. The secretary signed on to a joint letter with 19 other Republican secretaries of state this year that requested more access to federal immigration data to help verify voter registrations. Evnen told KETV earlier this year that he would like to investigate whether 46 Nebraskans who have voted over the past several elections are U.S. citizens. When the Nebraska Examiner asked the Secretary of State's Office earlier this year how many non-citizens had been removed from voter rolls or voted in past elections, a spokesperson said the agency has not 'removed anyone due to their status as a non-citizen, nor do we believe that there are many such people registered to vote.' Evnen's office, in the regular course of business, removed 13,550 voters from the voter rolls after the November 2024 election – most due to death or relocation from the state. Such removals are routine and required by federal and state law. Evnen said Friday that his office is working with the Nebraska Attorney General's Office to establish a process to confirm the citizenship of people registered to vote in Nebraska. Current Federal law doesn't require proof of citizenship to register — but it bans noncitizens from voting in elections. Other states, such as Wyoming and Louisiana, have passed state laws requiring anyone registering to vote to provide proof of citizenship. Those bills align with the Safeguard American Voter Eligibility Act, which the U.S. House passed in April. The SAVE Act would require proof of citizenship in federal elections. If the SAVE Act passes the Senate and becomes law, it would codify parts of the Trump executive order that Evnen calls a 'new and hopeful chapter.' 'The President's executive order all but points to Nebraska as the model for how free and fair elections should be conducted,' Evnen said. Evnen has talked about potentially requesting more time from the Legislature to verify signatures on petition drives for ballot measures after questions were raised about the validity of some signatures gathered for recent petitions, including ones targeted in a lawsuit aimed at stopping medical marijuana. Legislation seeking to provide more time fell short this year. Evnen also said Friday that he is 'proudly pro-life and pro-Second Amendment' — topics beyond the scope of his office that could signal that the Secretary of State has bigger aspirations. He said he expected a challenger in 2026, whether from his right flank, a Democrat or both. Ballard Power to supply fuel cell engines to Sierra Northern Railway
Ballard Power Systems has signed a supply agreement with Sierra Northern Railway for 1.5MW of fuel cell engines, with delivery expected in 2025. The agreement is part of Sierra Northern Railway's decarbonisation strategy in California. Ballard will provide 12 FCmove-XD engines to retrofit three diesel locomotives, transitioning them to hydrogen power for zero-emission operations. Oklahoma company seeks to buoy U.S. production of critical rare earth magnets
Stillwater, Oklahoma — Buried on Round Top Mountain in a remote part of West Texas are rare earth minerals, the metals that could power America's future. Rare earths are a group of 17 elements used in many of the world's most advanced technologies, including semiconductors, electric cars and guided missiles used by the military. Before they can be used, the minerals must be turned into magnets, and China produces as much as 95% of the world's rare earth magnets, according to energy research company Wood Mackenzie. But USA Rare Earth, a Stillwater, Oklahoma-based company, is trying to change that by bringing this critical supply chain back to the United States. "I'd say we're a good 10, 15 years behind," USA Rare Earth CEO Joshua Ballard told CBS News of where he thinks U.S. production of rare earth magnets should be. Inside its warehouse in Stillwater, USA Rare Earth is rushing to assemble massive machines that will eventually produce up to 5,000 tons of magnets per year. According to Ballard, that will equal about 10% of U.S. demand. "Right now, we have to ask permission from China in order to get the magnets and minerals we need for our defense technologies," Ballard said. "...This is an incredible choke point for this country." In April, the Trump administration announced an economic investment deal with Ukraine designed to give the U.S. access to Ukraine's rare earths, a move that comes amid the White House's trade disputes with China. Ballard showed CBS News a small-scale laboratory that is showcasing what could be possible. Inside, engineers are refining the volatile rare earth metals, cooking and compressing them into tiny but powerful magnets. "When you think about all these new technologies, whether it's in your phone, there's probably 12 magnets if you have an iPhone," Ballard said. "A car, there's up to 40 magnets in a car. And the strength of them allows you to create smaller technologies with the power of the magnet." And while companies like USA Rare Earth will eventually help lessen U.S. dependence on China, Ballard said that's still a long way off. "It's a long term proposition," Ballard said. "We've got a lot of work to do here. There's a few sites here in America that are working out today. It's not nearly enough. We've got a lot of work to do."
