‘Zudpi jungles' are forest land: SC

New Delhi: The Supreme Court on Thursday struck a balance between protection of environment and right to livelihood as it declared 86,400 hectares of 'Zudpi Jungle' lands in eastern Vidarbha region of Maharashtra as forests but protected the structures existing on it till December 1996.
The top court noted that 'Zudpi' was a Marathi word, literally translating to bushes or shrubs, and 'Zudpi' lands meant an inferior type of unoccupied lands with bushy growth.
These lands consist of low Murmadi soil (arid soil with gravel and soft stones) where tree growth was not possible and hence these were dominated by shrubs and other dry vegetation. These are, however, extremely ecologically important areas that act as wildlife corridors, according to experts.
A bench of chief justice of India (CJI) BR Gavai and justice Augustine George Masih in its order said: 'It is directed that the Zudpi Jungle lands shall be considered as forest lands in line with the order of this court dated December 12, 1996 in the present proceedings.'
The bench directed the Maharashtra government to submit a consolidated proposal for each district. The land in question was part of six districts of Eastern Vidarbha Region — Nagpur, Wardha, Bhandara, Gondia, Chandrapur and Gadchiroli.
The Maharashtra government had in 2019 approached the top court seeking clarification whether its decision in the TN Godavarman case on December 12, 1996 — the verdict defined the term forest — would apply to Zudpi jungle or forest land, which are grazing land.
Noting that on the land in question, there stood government buildings, residential quarters, schools, graveyards, educational and public institutions, the bench said, 'In the peculiar facts and circumstances of the present case, we direct that as an exception, and without the same being treated as a precedent whatsoever for any matter, the Zudpi Jungle lands allotted by the competent authority up to December 12, 1996 and for which land classification has not been changed, the state of Maharashtra shall seek approval under Section 2 of the Forest (Conservation) Act, 1980 for their deletion from the list of Forest Areas.'
The court directed the Centre to approve the proposal without imposing any condition for compensatory afforestation or levy of net present value (NPV) but directed the state to ensure that the land used is not changed in the future under any circumstances.
'We clarify that all activities for which lands have been allotted by the competent authority will be deemed to be site-specific,' the top court added.
The top court's 1996 decision held that forest land as defined in Section 2 of the FC Act would include not only forests as understood in the dictionary sense but any area recorded as forest in the government records.
The court in its Thursday's order reiterated its recent decision of May 15 directing chief secretaries/administrators of all states and UTs to constitute Special Investigation Teams for examining to whether any forest land in possession of Revenue Department has been allotted to any private individuals/institutions for non-forestry purposes and directed states to either restore the land or recover cost of the land in the event such restoration is not possible.
Maharashtra chief minister Devendra Fadnavis hailed the verdict as a major relief for Vidarbha region which, he said, has been lagging in terms of development because of the Forest (Conservation) Act, 1980.
'I would say it is a landmark and historical judgment because the Supreme Court has maintained a balance between the development and environment,' Fadnavis told reporters.
'Most importantly, our demand for exempting slums that are settled on zudpi land for giving them ownership rights has also been approved by the SC. This will allow the state to give ownership rights to the people residing in those slums,' he said, adding the top court has approved all recommendations of the state government.
Experts pointed out that Zudpi jungles have been considered forest since the 1980's. 'In 1987, the Maharashtra government asked the environment ministry to exempt the Zudpi Jungles from the purview of the Forest Conservation Act 1980. This meant that Maharashtra was treating Zudpi Jungles as forests,' Debi Goenka, executive trustee of Conservation Action Trust, said.
'One of the important issues that was raised before the top court was the fact that the CEC report was completely silent on the impact of the proposed denotification of Zudpi Jungles on wildlife and wildlife corridors. It must be kept in mind that even small patches of forests are important for wildlife especially if they are located within wildlife corridors. This aspect has been completely ignored,' he added.

The Commission has now recommended the state government revoke the special immunity granted to CID Crime regarding cyber fraud cases—delivering a major win for transparency and the rights of hundreds of duped citizens. The exemption, in effect since October 25, 2005, under a Home Department notification, placed CID Crime beyond the purview of the Right to Information Act for crime-related investigations. However, the recent judgment has pierced this shield in the context of cybercrime, which the Commission argued is no longer a conventional 'sensitive crime' but a rapidly escalating public menace impacting citizens daily. The ruling stemmed from a plea by Rakesh Kumar Prajapati, a Gandhinagar resident who lost Rs 4.5 lakh to cyber fraud. After filing a complaint with the Cyber Crime Cell, Prajapati sought the FIR copy and related documents under the RTI Act. CID Crime rejected his request, citing the 2005 exemption. Unwilling to accept silence in the face of theft, Prajapati took the matter to the State Information Commission.

T Rabi Sankar, Deputy Governor of the Reserve Bank of India (RBI), has been appointed as a part-time Member of the Sixteenth Finance Commission on Saturday. The appointment of Sankar is consequent to the resignation of one of the full-time Members of the XVIFC, Ajay Narayan Jha, on personal grounds. The Department of Economic Affairs of the Finance Ministry in a notification said, "In pursuance of clause (1) of article 280 of the Constitution read with the provisions of the Finance Commission (Miscellaneous Provisions) Act, 1951 (33 of 1951), the President is pleased to appoint T Rabi Sankar as a part-time Member of the Sixteenth Finance Commission." He will be a part-time Member of the Sixteenth Finance Commission from the date of appointment to the date the Commission submits its report or 31 October 2025, whichever is earlier. Sankar is currently overseeing the key portfolios of the FinTech Department, the Financial Markets Operations Department, and the Financial Markets Regulation Department at the Reserve Bank of India (RBI). Sankar has played a pivotal role in the launch of the Central Bank Digital Currency (CBDC). In April, the Appointments Committee of the Cabinet (ACC) approved T. Rabi Sankar's reappointment as Deputy Governor of the Reserve Bank of India (RBI) for one year. Sankar was Executive Director of the Reserve Bank before being elevated to the post of Deputy Governor in 2021. T. Rabi Sankar, a seasoned central banker, joined the Bank in 1990 and has held various positions at the Reserve Bank of India. As Executive Director, he oversaw the Department of Payment and Settlement Systems, the Department of Information Technology, Fintech, and the Risk Monitoring Department at the RBI. The government appointed Arvind Panagariya as the Chairman of the 16th Finance Commission in 2023. The commission makes recommendations about the distribution of the net proceeds of taxes between the Union and the States. The Finance Commission is constituted by the President under article 280 of the Constitution, mainly to give its recommendations on the distribution of tax revenues between the Union and the States and amongst the States themselves. Two distinctive features of the Commission's work involve redressing the vertical imbalances between the taxation powers and expenditure responsibilities of the centre and the States, respectively, and equalisation of all public services across the States.

Two more persons were arrested in Assam in a crackdown on alleged 'anti-national and communal elements', Chief Minister Himanta Biswa Sarma said on Saturday. With this, the number of arrests in such cases in the state since the terror attack in Jammu and Kashmir's Pahalgam increased to 90. While Goalpara Police arrested Sanidul Islam for allegedly 'offensive social media posts on Lord Ram', Kamrup Police apprehended Saniur Rahman for 'inciting communal discord' through social media, Sarma said on social media. The attack at Baisaran near Pahalgam town on April 22 left 26 persons dead and 17 injured. The terrorists targeted tourists after asking their names to ascertain their religion, the police said. All but three of those killed were Hindu. Since the attack, the Bharatiya Janata Party government in Assam has been arresting persons accused of alleged 'anti-national' activities. On June 1, the chief minister said that 81 'anti-nationals' were put 'behind bars for sympathising with Pakistan'. On April 24, Sarma had said that the state would take action against anyone directly or indirectly defending the 'horrific, Pakistan-sponsored terror attack in Pahalgam'. This came after Opposition All India United Democratic Front MLA Aminul Islam was arrested on sedition charges for claiming that the Pahalgam attack and the 2019 Pulwama attack may have been the results of conspiracies by BJP leaders. Islam got bail in the sedition case on May 14, but was detained again under the National Security Act on the same day, PTI reported. The Act allows for long periods of detention without trial and suspends important rights of the accused person, including the right to legal representation and immediate information about the cause of the arrest.
