‘Can't assume powers Constitution has not vested': Centre warns Supreme Court against judicial overreach

Opposing the Supreme Court fixing a three-month timeline for the President and governor to act on bills forwarded by the state legislature, Solicitor General Tushar Mehta has said that the judiciary does not hold answers to all problems in a democracy and 'if any organ [of state] is permitted to arrogate to itself the functions of another…the consequence would be a constitutional disorder…'.
In written submissions to the court, where a five-judge bench is hearing a reference made by the President on whether time schedules can be fixed for the actions of the President or governor, on August 12, Mehta stressed the importance of the separation of powers between the legislature, the executive, and the judiciary.
Despite this, he pointed out, 'there are certain zones which remain exclusive to either of the three organs…and cannot be trenched upon by the others. The high plenary positions of Governors and President fall within that zone. While they are political positions, they are also representations of democratic will'.
'While the President is elected and governors are appointed by Council of Ministers [acting through President], direct elections are not the only form of democratic processes in a republican democracy. The positions of power, where appointments are made by elected representatives, are also legitimate centres of democratic faith,' Mehta said.
On governors, he said, they 'are thus not to be treated as alien/foreigner in the federating units of the Union. Governors are not just emissaries of the Centre rather representatives of the entire nation in each and every federating unit. They represent national interest and national democratic will in the States as part of the larger Indian constitutional brotherhood.'
Responding to the question of granting assent to bills, he said: 'The gubernatorial assent is a high prerogative, plenary, non-justiciable power which is sui generis in nature. Although the power of assent is exercised by the person at the apex of the Executive, however, the assent itself is legislative in nature.'
Mehta pointed out that 'this blended and unique nature of assent, clothes it with a constitutional character whereby no judicially manageable standards exist. Thus, despite the expanding contours of judicial review, there are some zones like assent that remain non-justiciable. The classical notion of judicial review cannot be lifted and applied to assent as the factors at play during the grant or withholding of an assent have no legal or constitutional parallel.'
Mehta said that 'a wide-ranging judicial review of assent procedures, either post-assent or at a stage anterior to the grant of assent, would potentially destabilise the constitutional balance between organs of State. It would create an institutional hierarchy and upset the constitutional balance of powers between the three organs' and 'has the potential to convert the Indian Constitution, into one which postulates supremacy of Judiciary as a doctrinal principle'.
This, he said, was against the 'basic structure of the Constitution' and 'against any justifiable reading of the Constitution as a whole'.
Mehta underlined that 'judicial deference and restraint have come to define the high ideals of Indian judiciary, and the judicial branch does not hold keys or solutions for every conundrum that may arise in a democratic polity'.
Saying that the Constitution framers, advisedly, left some questions outside the judicial realm, he added: 'This has been recognised as an inherent limitation of judicial procedures and judicial forums across the world….The power of mandamus thus, cannot be exercised over such functionaries owing to their constitutional status and inter-organ comity.'
The law officer said that 'each organ of the State in the Constitution has certain core functions, one organ interfering with the core functions of another would breach the separation of powers which is a fundamental feature of Indian Constitution'.
Saying that certain political questions may have only democratic remedies under the Constitution, Mehta said: 'In the zest of finding a solution to the problem presented before one organ, such organ must follow the essential feature of separation of powers in such core functions.'
He further pointed out that 'when the Constitution seeks to impose time limits for taking certain decisions, it specifically mentions such time limits. On the other hand, when it designedly sought to keep the exercise of powers flexible, it does not impose any fixed time limit. Since the text of Article 200 or 201 does not provide a specific time limit, no form of judicial review or judicial interpretation can impose the same.'
Mehta said that 'the exercise Article 142 is not a supervening judicial power which can override the constitutional provisions or run contrary to them. The Apex Court, even under Article 142, is bound by constitutional provisions and principles'.
He added that 'the alleged failure, inaction, or error of one organ does not and cannot authorise another organ to assume powers that the Constitution has not vested in it. If any organ is permitted to arrogate to itself the functions of another on a plea of public interest or institutional dissatisfaction or even on the justification derived from the Constitution ideals, the consequence would be a constitutional disorder not envisaged by its framers.'
The SG said it 'would dissolve the delicate equilibrium that the Constitution establishes and would negate the rule of law. The perceived lapses, if any, are to be addressed through constitutionally sanctioned mechanisms such as electoral accountability, legislative oversight, executive responsibility, reference procedures or consultative process amongst democratic organs etc. Thus, Article 142 does not empower the Court to create a concept of 'deemed assent', turning the constitutional and legislative process on its head.'

He also outlined the Union government's upcoming infrastructure plans to improve connectivity between high-speed corridors in Delhi-NCR, which will improve logistics in the region and reduce costs. If I say that 50% of traffic jams in Delhi will reduce due to the UER-II and Dwarka Express highway, I don't think it will be surprising,' he said. Crediting Prime Minister Narendra Modi for directing his ministry to develop world-class infrastructure, he said, 'At that time, the situation in Delhi was not good. There were traffic jams decided to make Delhi a world-class city and made a plan to make it congestion free.' Gadkari said plans are underway to link UER-II with the Delhi-Katra Expressway, link Jammu and Kashmir and Punjab with the Delhi airport, and the Delhi-Mumbai Expressway with UER-II. 'The upcoming Delhi-Dehradun Expressway is also connected from UER-II. Travel time from vehicles coming from the Dehradun side to the Delhi airport will come down from 2-2.5 hours to just 45 minutes. A road link will also connect Noida, Faridabad with the Delhi-Dehradun Expressway, which will also work as a bypass for east Delhi,' the minister said. He said that a direct link from southwest Delhi to the Noida-Faridabad road will be built, and a tunnel road connecting Shiv Murti–Mahipalpur (Dwarka Expressway) with Nelson Mandela Road (Vasant Kunj) will be built. Elevated corridors on the AIIMS-Mahipalpur-Gurugram routes will reduce snarls on the inner and outer ring roads. Gadkari said all these road projects will also reduce the cost of logistics to make Indian goods competitive in the global market. Citing studies by multiple IITs, Gadkari said the logistics cost has reduced by 6% due to the improvement of roads and by 2026, the logistics cost will be in single digits. The union minister said of the ₹65,000 crore worth of projects envisioned to ease congestion in Delhi, projects worth ₹48,000 crore have been completed in the past decade. He said three out of the six greenfield expressways connecting Delhi are ready, and the remaining three, including the Delhi-Mumbai Expressway, will be completed by December 2026. The other two are the Delhi-Katra Expressway and the Delhi-Dehradun Expressway. The Dwarka Expressway, Delhi-Meerut and Delhi Peripheral Ring Road have already been completed. Recalling litigation that held up the peripheral ring road, he said: 'With great difficulty, even after many problems, we completed the project, and heavy incoming traffic to Delhi was diverted.' He said the Delhi Meerut Expressway, signal-free corridors between Mukarba Chowk and Sonepat, and Dhaula Kuan and Gurugram, eased the twin problems of pollution and congestion. Gadkari said the two projects inaugurated on Sunday were envisioned in the Delhi Master Plan of 2001, but previous governments did not act on it. According to details shared, the upcoming tunnel project between Shiv Murti and Nelson Mandela Marg will be 5km long, and consist of two ducts with three lanes each. It will pass under Delhi's southern ridge at a depth of 20-40 metres. The National Highways Authority of India (NHAI) will provide cross-passage and lay-by zones at every 500-metre interval, according to an NHAI report. The project is likely to cost ₹3,500 crore. The AIIMS to Mahipalpur-Gurugram elevated corridor is likely to be 20km long and cost around ₹5,000 crore. According to an NHAI decongestion report shared with the Delhi government, the highway connecting UER-II with Delhi-Katra Expressway will be around 20 kilometres long and is likely to cost around ₹4,000 crore. Once complete, it will serve as an alternative to the NH-44. Similarly, the UER-II extension to the Delhi-Dehradun Expressway will start from Alipur and end near Tronica City, covering around 17km. This extension is likely to cost around ₹3,350 crore and would provide faster connectivity to commuters from Haryana and Rajasthan heading towards Dehradun. 'It will decongest Delhi by diverting long distance and freight traffic from central roads easing pressure on NH-48, NH-44, Ring Roads and Barapullah elevated corridor,' the report reads. A further eastern extension of the UER-II, which will act as a new bypass for east Delhi, connecting Noida, Ghaziabad and Faridabad, will be around 65 kilometres long and ₹7,500 crore. 'The highway will connect major roads such as Delhi-Dehradun Expressway, Delhi-Meerut Expressway, Noida-Greater Noida Expressway and DND-Faridabad highway. It will provide connectivity to towns such as Loni, Baghpat, Ghaziabad, Noida with North, Northwest and West Delhi,' the report reads.

Prime Minister Narendra Modi on Sunday inaugurated two major national highway projects worth ₹2,000 crore which will directly benefit Haryana. These are construction of two new four-lane connectivity roads to Sonepat and Bahadurgarh under the Urban Extension Road-2 project. The chief minister said that Haryana, being the industrial and agricultural hub of northern India, would be the biggest beneficiary of these projects. 'These key projects will not only boost exports, imports and investments by ensuring direct connectivity from Kundli, Sonepat, Bahadurgarh, Gurugram and Manesar to Delhi airport, but will also provide relief from traffic congestion in the region,' Saini said. Saini said that the Centre is creating an extensive network of roadways, railways and airways connectivity. Listing out the projects which will be to Haryana's advantage, Saini named the Western Dedicated Freight Corridor, Rail Coach Repair Factory, Kundli-Manesar-Palwal and Kundli-Ghaziabad-Palwal Expressways, Gurugram-Sikanderpur and Faridabad-Ballabhgarh Metro Links, the country's first elevated railway track in Rohtak, the Rohtak-Meham-Hansi railway line, the National Cancer Institute at AIIMS Jhajjar, and AIIMS in Rewari. He said that Haryana recently received the gift of a metro corridor from Rithala to Kundli. The chief minister also said that these initiatives will give a new impetus to investment, employment and industrial development in the state, further strengthening Haryana's contribution to the national economy.

A bench of Justices B V Nagarathna and R Mahadevan will hear the suo motu case titled "In Re: Cadets Disabled During Military Training Struggle". The case has been listed after a media report highlighted the plight of cadets who are medically discharged after suffering disabilities during training at premier institutions such as National Defence Academy and Indian Military Academy. As the injuries suffered by them are prior to commissioning, they are denied ex-servicemen benefits like disability pension or treatment under the Ex-Servicemen Contributory Health Scheme, leaving them without any institutional support.
