
Government must act on Suhakam's call without delay — Hafiz Hassan
As explained by the commission, a diversion mechanism allows children accused of minor or non-violent offences to be redirected away from the criminal justice system into community-based programmes focused on education, counselling, and behavioural support. This approach would not only reduce the risk of criminalisation and social stigma but also address underlying issues such as trauma, neglect, or mental health. Such a policy is not a denial of accountability, but a shift towards restorative and rehabilitative justice which is proven to be more effective and humane for children.
Diversion can be defined in different ways, but the term always refers to measures for dealing with children in conflict with the law without resorting to formal judicial proceedings or formal trial.
A more comprehensive description of diversion is this: it is the channelling of children who are in conflict with the law away from judicial proceedings through the development and implementation of procedures or programmes that enable many - possibly most - to avoid the potential negative effects of formal judicial proceedings, provided that human rights and legal safeguards are fully respected. The purpose of diversion is to avoid instituting judicial proceedings against children in conflict with the law, or to suspend judicial proceedings, as well as to influence a child's proper development; to enhance their personal responsibility; and to promote their reintegration into society.
Make no mistake that the use of the term is not recent.

According to Unicef, the term is already used by the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (1985), also called 'Beijing Rules'. It can be found in Rule 11 which reads as follows:
11. Diversion
11.1 Consideration shall be given, wherever appropriate, to dealing with juvenile offenders without resorting to formal trial by the competent authority.
11.2 The police, the prosecution or other agencies dealing with juvenile cases shall be empowered to dispose of such cases, at their discretion, without recourse to formal hearings, in accordance with the criteria laid down for that purpose in the respective legal system and also in accordance with the principles contained in these Rules.
11.3 Any diversion involving referral to appropriate community or other services shall require the consent of the juvenile, or her or his parents or guardian, provided that such decision to refer a case shall be subject to review by a competent authority, upon application.
11.4 In order to facilitate the discretionary disposition of juvenile cases, efforts shall be made to provide for community programmes, such as temporary supervision and guidance, restitution, and compensation of victims.
The above acknowledges that diversion has been practised on a formal and informal basis in many legal systems. It serves to hinder the negative effects of subsequent proceedings in juvenile justice administration.
Four years later in 1989, the United Nations Convention on the Rights of the Child (CRC) is also said to have promoted diversion, without using the term. This can be found in Article 40(3)(b) which stipulates that 'State Parties shall seek to promote the establishment of laws, procedures, authorities and institutions specifically applicable to children alleged as, accused of, or recognised as having infringed the penal law, and, in particular … whenever appropriate and desirable, measures for dealing with such children without resorting to judicial proceedings, providing that human rights and legal safeguards are fully respected.'
Diversion is also a measure in the United Nations Guidelines for Action on Children in the Criminal Justice System (1997), also called 'Vienna Guidelines'. The Guidelines provide a comprehensive set of measures that need to be implemented in order to establish a well-functioning system of juvenile justice administration, consistent with international standards.
Guideline 42 on Diversion states as follows:
'To prevent further overreliance on criminal justice measures to deal with children's behaviour, efforts should be made to establish and apply programmes aimed at strengthening social assistance, which would allow for the diversion of children from the justice system, as appropriate, as well as improving the application of non-custodial measures and reintegration programmes. To establish and apply such programmes, it is necessary to foster close cooperation between the child justice sectors, different services in charge of law enforcement, social welfare and education sectors.'
According to Unicef also, European instruments too have incorporated diversion, albeit not comprehensively. The European Rules for Juvenile Offenders Subject to Sanctions or Measures (2008) do not mention diversion, but the Guidelines of the Committee of Ministers of the Council of Europe on Child-Friendly Justice (2010) state as follows:
'Alternatives to judicial proceedings such as … diversion (of judicial mechanisms) … should be encouraged whenever this may best serve the child's best interests.' (See Guideline 24).
This year is the 40th and 15th anniversaries of the Beijing Rules and the European Guidelines respectively.
Do we sit further on diversion?
Kudos to Suhakam — especially its Chief Children Commissioner, Dr Farah Nini Dusuki — for highlighting the term.

‘Wasting sanitary pads to mock rivals': Wanita DAP slams veterans' protest as disrespectful to women
KUALA LUMPUR, Aug 4 — Wanita DAP has reportedly criticised the Negeri Sembilan DAP Veterans Club for using sanitary pads as gimmicks during a protest against the party's leadership, calling the act inappropriate and disrespectful to women. According to Malaysiakini, Wanita DAP chief and Deputy Communications Minister Teo Nie Ching said she did not agree with the move, as the move reinforced harmful stigma surrounding menstruation. 'Using sanitary pads as tools of attack or ridicule only reinforces the shame and stigma long associated with menstruation,' she was quoted as saying. Teo also reportedly pointed to the reality of period poverty in Malaysia, noting that some students are forced to miss school due to their inability to afford menstrual products. 'And yet, here they are wasting large quantities of sanitary pads just to mock their political rivals," she reportedly said. The Negeri Sembilan DAP Veterans Club reportedly staged a protest yesterday over the appointment of Johor native Vincent Wu as senator, criticising the decision as a betrayal of local interests. During the protest, members wore custom-made masks made from sanitary pads to symbolise what they described as the state leadership's silence on the matter. Lee Kong Hing, the club's chariman, reportedly described the masks as being thick, dense, highly absorbent, and and soundproof — qualities he reportedly said 'perfectly symbolise how seamlessly silent the state leadership is'. In a Facebook post last night, the Federal Territories wing of Wanita DAP condemned the act, urging party members to uphold dignity and engage in respectful discourse. 'The menstrual pad is not a tool for personal gain or internal protest,' read the post. 'It represents the lived experiences of millions of women, and should not be exploited to make a political point, especially within our own party,' it added.

King's visit to Russia marks highest-level bilateral engagement since 1967, says envoy
MOSCOW, Aug 4 — The state visit by His Majesty Sultan Ibrahim, the King of Malaysia, to Russia from Aug 5-10 has been described as the highlight of the diplomatic ties between the two countries, said Malaysia's ambassador to Russia, Datuk Cheong Loon Lai. He said the visit is the highest-level ever made and the first by a Malaysian Head of State to Russia since diplomatic relations were established in April 1967. 'His Majesty's state visit, at the invitation of Russian President Vladimir V. Putin, is a recognition of the five decades of diplomatic ties with Malaysia, which was among the earliest ASEAN countries to establish ties with the then Soviet Union. 'This visit also reflects the crucial role of the institution of the Yang di-Pertuan Agong in the context of international relations,' he told Bernama here yesterday in conjunction with Sultan Ibrahim's state visit. Cheong said the visit will begin in Moscow, where His Majesty is scheduled to hold an official meeting with Putin at the Grand Kremlin Palace. Both leaders are expected to discuss potential cooperation in the fields of trade and investment, higher education, technology and innovation, people-to-people ties, digital transformation, agriculture and food security, as well as regional and international issues. 'This highest-level visit will certainly have a high impact in increasing the momentum and positive trend of bilateral relations between Malaysia and Russia. 'It sends the message that Malaysia is serious and committed to efforts to strengthen and improve bilateral relations with Russia in all fields, particularly strategic cooperation and people-to-people ties,' he said. Fadhlina: Firm action once probe completed into upside-down flag incident at SJKC Chung Hua
KOTA BHARU, Aug 4 — The Ministry of Education (MOE) will take firm action once it receives the full investigation report on the incident where the Jalur Gemilang flag was flown upside down at Sekolah Jenis Kebangsaan Cina (SJKC) Chung Hua in Port Dickson, Negeri Sembilan, on Friday. Its Minister Fadhlina Sidek said the incident was a serious issue, as all parties had been repeatedly reminded of the importance and sensitivity of the national flag. 'We are currently awaiting the result of the full investigation. I want to stress that once we receive the complete report, we will take stern action. 'The MOE has repeatedly reminded everyone about the sensitivity, responsibility, and commitment involved in displaying the Jalur Gemilang. Incidents like this should not have happened,' she said. Fadhlina said this to reporters after presenting the Early Schooling Aid (BAP) to Form Six Semester One students for the 2025 session in Kelantan at the Educational Technology Resource Sector in Pengkalan Chepa, here today. 'I would like to stress that we are taking a very strict stance on any offence involving the improper display of the Jalur Gemilang because we do not want the spirit of the National Day celebration to be marred by such incidents,' she said. SJKC Chung Hua in Port Dickson today issued a public apology over the upside-down display of the Jalur Gemilang at its premises last Friday. The school board, Parent-Teacher Association (PTA), and the school administration, in a joint statement, expressed deep regret over the incident, which they described as an unintentional mistake. According to the statement, the incident occurred on Aug 1 when a school worker mistakenly installed one of the flags upside down. Meanwhile, commenting on the death of Form One student Zara Qairina Mahathir, Fadhlina stressed that the MOE was committed to ensuring a thorough and transparent investigation process, in the interest of justice for all parties involved. 'We assure that the investigation into this case will be carried out without delay from the MOE. This case is our priority. 'I wish to stress once again that no one will be shielded. We will take all necessary actions, based entirely on the results of the investigation,' she said. Prime Minister Datuk Seri Anwar Ibrahim today said the investigation into the death of Zara Qairina must be conducted thoroughly and transparently. The Prime Minister was reported as saying that he had discussed the matter with Inspector-General of Police Datuk Seri Mohd Khalid Ismail and Home Minister Datuk Seri Saifuddin Nasution Ismail to ensure a swift and thorough investigation. Zara Qairina, 13, was believed to have fallen from the third floor and was found unconscious in a drain near her school dormitory in Papar, Sabah, at 4 am on July 16. She was pronounced dead at Queen Elizabeth I Hospital here on July 17. The student's death quickly went viral, sparking widespread public reaction on social media. — Bernama
