
Allahabad HC Seeks State's Reply On Objections To Bankey Bihari Temple Trust Ordinance
The objections were raised by amicus curiae Sanjay Goswami in a matter filed under Article 227 concerning the temple's administration
The Allahabad High Court on Monday took on record serious objections raised against the Uttar Pradesh government's move to constitute a trust for the management of the Shri Bankey Bihari Ji Temple in Mathura, and directed the State to respond.
The objections were raised by amicus curiae Sanjay Goswami in a matter filed under Article 227 concerning the temple's administration. The court was hearing a petition filed by Pranav Goswami and others.
Goswami challenged the constitutional validity of The Uttar Pradesh Shri Bankey Bihari Ji Temple Trust Ordinance, 2025, particularly objecting to provisions that allow the inclusion of several government officials as ex-officio trustees. These include the District Magistrate, SSP Mathura, Municipal Commissioner, officials of the Dharmarth Karya Vibhag and the Braj Teerth Vikas Parishad.
He argued that the temple is a privately managed religious institution traditionally overseen by the successors of Swami Haridas Ji, and that the ordinance attempts to give the State administrative control over it through indirect means. The move, he said, amounted to a 'backdoor entry" by the State into religious affairs.
According to the amicus, while the government may regulate crowd management and ensure public safety, it cannot take over internal administration or interfere with religious practices of a temple that is not State-controlled. He also cautioned that such an ordinance, if not examined, may set a precedent for similar government actions across the State.
'The Constitution forbids such type of venture by the State Government encroaching upon the area of religion," he submitted, while referring to existing examples of temple control by State governments in other regions like Tamil Nadu.
The High Court observed that the matter required further consideration and directed the Uttar Pradesh government to respond to the objections raised. The case has been listed for further hearing on July 30.
It was also noted that a related matter is scheduled to be heard before the Supreme Court on July 29.
The case is being heard by Justice Rohit Ranjan Agarwal.

EC to opposition: Get 'wrongfully excluded' to file claims
NEW DELHI: Brushing aside the allegation by opposition MPs Asaduddin Owaisi and Randeep Surjewala that the special intensive revision of electoral roll in Bihar is an exercise in disenfranchising minorities and precarious communities, the Election Commission on Wednesday asked them to get all such electors to file their claims and objections before Sept 1. "Mr Owaisi and Mr Surjewala should ensure that their state units and booth level agents (BLAs) facilitate those they complain have been wrongfully excluded to file their claims with the ERO to add them back in the electoral roll. Interestingly, even as the national party leaders have been complaining of alleged irregularities and imperfections in the roll, not a single claim or objection was filed by any of the 1.6 lakh party BLAs in the field, between publication of the roll on Aug 1 and 9 am on Wednesday," said an EC official. On the other hand, 3,659 individual electors directly filed their claims and objections during this period. Another 19,186 newly-eligible electors have also filed pleas for fresh enrolment through Form 6, along with the mandatory declaration. EC on Wednesday said it is revising the Bihar roll as per the Constitution and the extant laws, and with full transparency. AutoSaveMax Get Quote While the opposition parties question the purpose of the SIR exercise, EC underlined that it has also led to Bihar becoming the first state in the country to limit the number of electors per booth to 1,200, which is expected to cut queues on polling day. EC said lists of electors reported by BLOs as dead, permanently shifted, having two votes and who could not be contacted after at least three visits of BLOs were shared with all political parties and their BLAs on or before July 20, giving them ample time to report any wrongful additions or deletions.

‘Contempt rule can't take away CJ's powers'
Kolkata: Senior counsel Parthasarathi Sengupta, while making his arguments in response to senior counsel Kalyan Banerjee's plea in a recent contempt case before the Calcutta High Court Thursday, submitted that the chief justice of a high court enjoys certain general powers under the Constitution that a rule of the Contempt of Courts Act couldn't take away. Sengupta was arguing over the maintainability of the contempt rule issued by a division bench of justices Arijit Banerjee, Sabyasachi Bhattacharyya and Rajarshi Bharadwaj against TMC's Kunal Ghosh and seven others in connection with the ruckus where a mob stamped on a photo of a high court judge. He submitted that the chief justice didn't issue the contempt rule. Sengupta submitted that the division bench, after seeking affidavits, issued the contempt rule on its own motion. He argued that the advocate general's taking cognisance of the complaint was not mandatory for the high court to take cognisance of the complaint. The bench will hear the matter again on Aug 14.
