Looming over two cases threatening Musk's car company is a single question: Can he be trusted?

Elon Musk fought court cases on opposite coasts Monday, raising a question about the billionaire that could either speed his plan to put self-driving Teslas on U.S. roads or throw up a major roadblock: Can this wildly successful man who tends to exaggerate really be trusted?
In Miami, a Tesla driver who has admitted he was wrong to reach for a dropped cell phone moments before a deadly accident, spoke of the danger of putting too much faith in Musk's technology — in this case his Autopilot program.
'I trusted the technology too much,' said a visibly shaken George McGee, who slammed into a woman out stargazing, sending her 75 feet through the air. 'I believed that if the car saw something in front of it, it would provide a warning and apply the brakes.'
In unusual coincidence, regulators arguing an Oakland, California, case tried to pin exaggerated talk about the same Tesla technology at the center of a request to suspend the carmaker from being able to sell vehicles in the state.
Musk's tendency to talk big — whether its his cars, his rockets or his government costing-cutting efforts — have landed him in trouble with investors, regulators and courts before, but rarely at such a delicate moment.
After his social media spat with President Donald Trump, Musk can no longer count on a light regulatory touch from Washington. Meanwhile, sales of his electric cars have plunged and so a hit to his safety reputation could threaten his next big project: rolling out driverless robotaxis — hundreds of thousands of them — in several U.S. cities by the end of next year.
The Miami case holds other dangers, too. Lawyers for the family of the dead woman, Naibel Benavides Leon, recently convinced the judge overseeing the jury trial to allow them to argue for punitive damages. A car crash lawyer not involved in the case, but closely following it, said that could cost Tesla tens of millions of dollars, or possibly more.
'I've seen punitive damages go to the hundreds of millions, so that is the floor,' said Miguel Custodio of Los Angeles-based Custodio & Dubey. 'It is also a signal to other plaintiffs that they can also ask for punitive damages, and then the payments could start compounding.'
Tesla did not reply for a request for comment.
That Tesla has allowed the Miami case to proceed to trial is surprising. It has settled at least four deadly accidents involving Autopilot, including payments just last week to a Florida family of a Tesla driver. That said, Tesla was victorious in two other jury cases, both in California, that also sought to lay blame on its technology for crashes.
Lawyers for the plaintiffs in the Miami case argue that Tesla's driver-assistance feature, called Autopilot, should have warned the driver and braked when his Model S sedan blew through flashing lights, a stop sign and a T-intersection at 62 miles-an-hour in an April 2019 crash. Tesla said that drivers are warned not to rely on Autopilot, or its more advanced Full Self-Driving system. It say the fault entirely lies with the "distracted driver" just like so many other 'accidents since cellphones were invented.'
Driver McGee settled a separate suit brought by the family of Benavides and her severely injured boyfriend, Dillon Angulo.
Shown dashcam video Monday of his car jumping the road a split second before killing Benavides, McGee was clearly shaken. Asked if he had seen those images before, McGee pinched his lips, shook his head, then squeaked out a response, 'No.'
Tesla's attorney sought to show that McGee was fully to blame, asking if he had ever contacted Tesla for additional instructions about how Autopilot or any other safety features worked. McGee said he had not, though he was heavy user of the features. He said he had driven the same road home from work 30 or 40 times. Under questioning he also acknowledged he alone was responsible for watching the road and hitting the brakes.
But lawyers for the Benavides family had another chance to parry that line of argument and asked McGee if he would have taken his eyes off the road and reached for his phone had he been driving any car other than a Tesla on Autopilot.
McGee responded, 'I don't believe so.'
The case is expected to continue for two more weeks.
In the California case, the state's Department of Motor Vehicles is arguing before an administrative judge that Tesla has misled drivers by exaggerating the capabilities of its Autopilot and Full Self-Driving features. A court filing claims even those feature names are misleading because they offer just partial self-driving
Musk has been warned by federal regulators to stop making public comments suggesting Full Self-Driving allows his cars to drive themselves because it could lead to overreliance on the system, resulting in possible crashes and deaths. He also has run into trouble with regulators for Autopilot. In 2023, the company had to recall 2.3 million vehicles for problems with the technology and is now under investigation for saying it fixed the issue though it's unclear it has, according to regulatory documents.
The California case is expected to last another four days.

Mr Yusuf is currently leading Reform's efforts to cut public spending across councils, following the party's local elections success in May. But, in an interview with Politico, Mr Yusuf has revealed his grander ambitions to take charge of the Treasury should Reform win power in 2029. 'I think Chancellor is obviously a very interesting and important position,' he told the website. 'But, you know, ultimately, these are all decisions Nigel will make, and I think he is a long way from making them. 'The talent density available to this party continues to grow very significantly.' Mr Yusuf is not among Reform's five MPs in the House of Commons. But he remains one of the party's key figures despite his dramatic resignation as chairman in June. The 38-year-old quit the role - and briefly the party - following a row over banning the burqa. He described a question to the Prime Minister concerning a ban on burkas - which are worn by some Muslim women - from his party's newest MP as 'dumb'. But Mr Yusuf, who is Muslim himself, later backtracked on leaving the party and said his decision to stand down had been the result of 'exhaustion'. He claimed to have been working for 11 months as Reform chairman 'without a day off'. David Bull has since succeeded Mr Yusuf as party chairman.

Elon Musk's 'retro-futuristic' Tesla Diner in Hollywood has become a new flashpoint for the 'Tesla Takedown' movement, with dozens of protesters picketing the diner last weekend alongside inflatable tube figures of Musk performing a Nazi salute. The viral popularity of the new diner, which is surrounded by 80 Tesla charging stations and two giant movie screens, has sparked out-the-door lines, massive traffic jams, and two angry protests, all within its first week of operation. Organizers say they are protesting against what they see as the Tesla CEO's corrosive effect on US democracy, as well as the human cost of the sweeping government cuts he spearheaded while working within the Trump administration earlier this year. For months, protesters who oppose the billionaire's political power have demonstrated outside of Tesla showrooms across the US and the world, hoping that by applying pressure to Tesla, a publicly-traded company, the Tesla Takedown movement can have an impact on Musk's behavior. 'Musk thought [the diner] would be good for him, but it's actually great for anti-Tesla protesters as well, to give us increased visibility,' said Joel Lava, who has been organizing weekly Tesla Takedown protests outside a Tesla service station in Burbank, California. Tesla did not immediately respond to a request for comment. Though Musk has officially left his role within the Trump administration, and has since publicly feuded with the president, the devastating effects of his so-called 'department of government efficiency' (Doge) live on, Lava said. Lava cited recent reports that the US had thrown away nearly 500 metric tons of emergency food aid this spring, in the wake of Doge's dismantling of the US Agency for International Development (USAID). Global health officials have also said Musk's budget-cutting efforts have thrown global HIV prevention efforts, including the rollout of a new 'miracle' drug, into chaos. There are hometown considerations, as well, Lava added: Musk has a history of anti-trans comments, and the diner is right on the border of West Hollywood, one of LA's historic LGBTQ+ neighborhoods. Protesters outside the Hollywood diner last weekend carried signs reading 'Fuck Nazi Billionaires' and 'Boycott Tesla'. 'We WILL NOT REST until the world has internalized the truth that TESLA FUNDS FASCISM,' organizers wrote in a post advertising the demonstrations, which one Los Angeles organizer estimated attracted about 100 people on Saturday, and about 85 on Sunday. A Los Angeles police spokesperson described the two demonstrations in Hollywood as 'peaceful protests'. Social media video of the diner demonstrations showed a few apparent Musk supporters yelling at protesters, including one young man caught on video describing himself as 'a proud fascist'. Dave, a Los Angeles-based Tesla Takedown organizer, said a few drivers of newer Teslas and Cybertrucks around the diner had screamed at the protesters, and 'there were some people who were doing the Sieg Heil [salute]'. At least one Cybertruck driver had gotten out of his vehicle to confront protesters, Dave said. The organizer asked not to be identified by his full name because he feared that protesting against Musk might affect his employment opportunities. Other Tesla fans waiting in line outside the diner simply seemed confused by the political rhetoric, Dave said, and other people driving by the diner were audibly supportive. 'We got a lot of honks and fist-pumps in solidarity, and many of those were even from Tesla drivers themselves – especially the people driving the older models of Teslas,' he said. Since it opened at 4.20pm last Monday, the diner has attracted Musk fans from across southern California, as well as curious tourists. At about midday on Wednesday last week, many fans in line had brought children with them, and some said that their kids were especially excited to see Musk's diner, which they had heard about on TikTok or YouTube. One Tesla Diner customer told the LA Public Press on Saturday that the protesters' comparisons of Musk to a Nazi did not make sense to him. 'If he's a fascist, who has he killed?' the man asked. 'Nazis kill people, from what I understand.' Dave, the Tesla Takedown organizer, said the demonstrators were considering more protests outside the diner, but that the group has already received at least one social media threat that they will be assaulted if they protest again next weekend. Asked about those threatening social media posts, which came from an anonymous pro-Musk Bluesky account, an LAPD spokesperson said the department was not currently aware of 'any specific threat'. For Angelenos who live in the neighborhood surrounding Musk's new diner, its sudden popularity has sparked a litany of complaints. Local news outlets have reported that neighborhood residents have complained of the chaos and traffic it has brought to the neighborhood, including 'insane gridlock from 1pm to 1 am', and concerns about the giant movie screens blocking the view from nearby apartments. 'If you can send people to Mars, you should be able to figure out how to make this doable for residents,' one resident told ABC7 News.
