
Man's sister laughs to the bank after suing police minister
The Gauteng High Court recently awarded R800,000 in damages to the family of Thomas Mashudu Mulaudzi, who died in 2021 before seeing justice for his unlawful arrest and detention that lasted nearly six months in 2015-2016.
Judge Seena Yacoob delivered the judgment on 16 July 2025, ordering the Minister of Police to pay damages with interest dating back to 2016, plus legal costs.
The case was brought by Mulaudzi's sister, Patience Lutendo Mulaudzi, who serves as executrix of his deceased estate.
Mulaudzi, 44, 'died in 2021, apparently from complications arising from the Covid-19 virus,' according to the judgment.
He passed away five years after being found not guilty and discharged from charges related to a truck hijacking he had no involvement in.
Background of the case
The ordeal began on 21 December 2015 when Mulaudzi was working as a dispatch clerk at Diplomat Warehouse.
He was called to his superior's office and arrested without being told what charges he faced.
Police handcuffed him and took him to where his employer's hijacked truck was parked.
Despite having no connection to the hijacking, Mulaudzi was denied bail because police provided the magistrate with incorrect address information.
The judgment revealed that 'bail was denied because the police told the magistrate that Mr Mulaudzi had provided an incorrect address. However, he had not; the police had mixed up his address with that of the driver of the hijacked truck.'
This error resulted in his detention at Modderbee Prison for nearly six months.
Yacoob noted that 'the conditions in the prison were deplorable' and this was 'common cause' between both parties, supported by reports from the Judicial Inspectorate on Correctional Services.

Impact on family and life
The unlawful detention had devastating consequences for Mulaudzi's family life.
As a widower, he was solely responsible for three minor children.
The court found that the children 'were left home alone when he was arrested' and 'he was only able to arrange for their care the following day.'
The psychological impact was severe.
Yacoob recorded that Mulaudzi 'testified that he would have liked to have died in prison because he was being accused of something he did not do.'
The judge described how 'the effects of the arrest and detention on Mr Mulaudzi were clearly extremely traumatic and catastrophic.'
The arrest damaged Mulaudzi's reputation and dignity, particularly as it occurred at his workplace.
When he was eventually released, the judgment noted that 'he did not get his job back because it had already been filled.'
At a subsequent CCMA hearing, his employer claimed he was involved in a hijacking. However, there was no evidence of his involvement in the hijacking.

Previous legal findings
In 2018, Judge Twala had already determined that Mulaudzi's arrest and detention were unlawful.
Yacoob explained that 'my brother Twala J determined in 2018 that the arrest and detention of Mr Mulaudzi was unlawful, and that the first defendant, the Minister of Police, is 100% liable for Mr Mulaudzi's damages arising therefrom.'
However, Twala dismissed claims of malicious prosecution and assault but upheld the unlawfulness of the detention.
The recent judgment focused solely on determining the quantum of damages, as liability had already been established.
Yacoob noted that 'the matter is now before me to determine the quantum of damages for which the minister is liable' and that ultimately 'Mulaudzi was discharged because there was no evidence against him.'
Expert medical evidence
Mental health experts retained by both parties agreed that Mulaudzi suffered from Post-Traumatic Stress Disorder (PTSD) and Major Depressive Disorder (MDD) as a direct result of his arrest and detention.
Yacoob described the effects as 'clearly extremely traumatic and catastrophic'.
The judge described how Mulaudzi was transformed from being 'a gainfully employed, respectable member of his community and a caring father' into someone denied basic respect and proper legal procedures.
The court emphasised the broader trauma of incarceration, noting 'the 'ordinary' consequences of being incarcerated in one of South Africa's overcrowded and under-resourced prisons, with all autonomy removed.'

Criticism of state conduct
The judge strongly criticised the manner in which state officials handled the case, both during the original proceedings and the current damages assessment.
'They were unprepared, produced evidence erratically and called irrelevant witnesses,' the judge wrote, emphasising that this criticism applied more to the minister's officials than to legal counsel.
The judge noted that 'unfortunately, the same is still applicable nearly seven years later.'
Despite common cause evidence and similar submissions from both sides regarding appropriate damages, settlement proved impossible.
The court found that 'the matter could not be settled simply because the Minister (or the Minister's authorised representative) declined to give the appropriate instruction.'
This resulted in unnecessary legal costs and the consumption of scarce judicial resources.
Yacoob observed that 'court resources, which are notoriously insufficient,' were applied to 'determine a matter that could easily have been settled.'

Damages assessment
Legal representatives for Mulaudzi's family argued for damages between R700,000 and R1 million, while the state submitted that R500,000 to R700,000 would be appropriate.
The judge emphasised that quantum determination 'is not a mathematical exercise, and that it is not a simple calculation of a daily, weekly or monthly rate.'
She said the assessment must consider the arrest circumstances, detention conditions, duration, and the violation of basic human rights, while balancing this against the fact that damages come from public funds.
After considering all factors, Yacoob determined that 'the appropriate amount to be R800 000.'
I am satisfied that a slightly higher award is justified,' Yacoob stated.
Punitive costs order
Beyond the damages award, Judge Yacoob imposed a punitive costs order against the state, requiring payment of the plaintiff's legal costs on an attorney and client scale.
The judge acknowledged that he 'would ordinarily be wary of granting a punitive costs order against the State, as it is public funds at issue and the state has many responsibilities.'
However, he justified the order by finding that the way the minister's officials behaved was deserving of a punitive costs order.
The court ordered the minister of police to pay R800,000 plus interest of 10.5% from 30 August 2016, to be paid within 20 days of service.
Additionally, the judge ruled that the state cover all plaintiff's legal costs, including expert witness fees and interpreter fees, with interest from the tax date to the payment date.

Tiffany Meek, a Fleurhof resident faces grave charges, including the murder of her 11-year-old son Jayden -Lee, as well as crimen injuria and attempts to defeat or obstruct the course of justice, The proceedings are drawing huge public attention due to the nature of allegations against her. Meek previously told the court she could afford R5,000 bail and gave an alternative address in Meadowland in KwaZulu-Natal should she be granted bail. Prosecutor Olga Mapokgole called investigating officer, Sergeant Linda Duma, to the stand to testify. He confirmed Meek had no previous convictions. Image: Supplied The court heard Jayden-Lee was reported missing at the police station at 7.30pm on May 13, 2025. He was expected to be back home from school at 3.30pm. The investigating officer said Meek told police she was working from home and when she realised her son was not home, she contacted her mother to call the scholar transport as she did not have airtime. Once her statement was taken, Meek and police went to the scholar transport driver's home to question him on the child's whereabouts. The driver said he had dropped Jayden-Lee. The man's house was also searched but nothing was found. Police, Meek, and family went to Swazi Place Complex to ask security if he had seen anything, but he referred them to his colleague, who had worked the day shift and knocked off at 6pm. 'The security guard was asked if he saw the child and he said yes. It was during this time the applicant (Meek) interrupted him, stating he was not telling the truth. The security guard insisted he saw him as he was the one who opened for him with the remote control,' the court heard. Police also went to question a peer of Jayden-Lee who was dropped after him. The boy remembered Jayden-Lee was dropped off because he had to open the bus door from the outside. They waited until the boy had entered the complex before they took off. 'Police went back to the complex. They searched the complex and found nothing. They searched the streets of Fleurhof and found nothing. They then went back to the main entrance of the complex at about midnight. They told the family there was nothing more they could do for the day. They stated the investigating officer would be in touch with them and police would assist with searches in the morning,' the court heard. The police sergeant also revealed explosive evidence that contradicted a previous statement made by Meek who claimed to have spent the night at her mother's house in Florida until she was notified of her son's body being discovered the next morning (May 14, 2025). The officer read out the statement of the nightshift security guard who rubbished Meek's claims. 'She (Meek) returned home. She entered the gate, and she was alone. She told me she is going to take a bath. Change her clothes and go back to the police station. I asked her before she went to the police station if she wants to assist with searching vehicles parked in the complex. She agreed and went to her flat. I searched the cars. "As I was searching at about 5.30am, the mother of the missing child told me she could not help with searches as she was heading to the police station. I opened the gate for her and she walked away and disappeared in the dark,' the security guard's statement read. Meek sat in the dock, shaking her head, as the statement was read out. The security guard further told police that shortly after, he was approached by a resident who informed him that Jayden-Lee was found lying on the floor, on the first floor, near the staircase. 'The security guard rushed to the area. When he got there, he was naked, only wearing underwear. He was found just behind the pillar. He said when he looked at the child, his eyes were not moving. The child felt cold. A resident brought a blanket and covered the child. They felt for a pulse but there was no pulse. There were no signs of life," the court heard. It was also established Jayden-Lee's body was found approximately eight to 10 metres from where he lived. The court heard residents made calls to the mother for an ambulance. Police said they were also notified by a resident who left the complex daily at 5.30am stating the child's body was not lying near the stairs at her time of departure. The case continues. Police offer R50,000 reward for armed suspect who entered Bellville school asking for cop's child
Western Cape police are offering a cash reward of up to R50,000 for information that could lead to the arrest and conviction of a man who entered a Bellville, Cape Town, school while allegedly armed, looking for a child of a police officer. 'Detectives attached to the Western Cape serious and violent crimes unit are seeking the assistance of the public for information that will lead to the detention and conviction of an unidentified man who can assist police in an investigation after an enquiry docket was opened,' said police spokesperson W/O Joseph Swartbooi. The incident occurred on June 20 at about 3pm when the man gained access to the school. 'Reports suggested the person in the picture was armed when he gained entrance at a school in Bellville with malicious intent,' said Swartbooi. The man allegedly approached the aftercare teacher and asked about the whereabouts of a pupil who is a child of a SAPS member. 'The learner, however, was already collected on the day. It is imperative that the person be traced and brought in for questioning. 'A reward of up to R50,000 is offered for any information on the whereabouts of the person in the photograph,' said Swartbooi. After a month of investigations the police have urged anyone with information to come forward.

She has been convicted of fraud, cyber fraud, and the unlawful use of access credentials Image: File :Independent Newspapers The Gqeberha Regional Court has handed down a five-year prison sentence to Lusanda Gloria Qose, a former sales and service consultant at First National Bank (FNB), for her involvement in a sophisticated fraud scheme that exploited a vulnerable senior citizen's banking profile. The court's ruling comes in the aftermath of Qose's conviction for fraud, cyber fraud, and the unlawful use of access credentials, a crime which threatened the integrity of the financial sector and allowed her to siphon off a staggering R245,000 over a period of three months. Qose, 35, abused her position at the Pier 14 branch, unlawfully accessing internal bank systems between January 22 and April 24, 2024. With her employee credentials, she manipulated account details belonging to 68-year-old complainant Mlungwana Maranti, changing his registered cellphone number to divert his One-Time-Pin (OTP) authorisations to herself without his knowledge. She was able to create a second bank card linked to Maranti's accounts, subsequently executing unauthorised fund transfers from his Money Maximiser account to his Encore account and conducting multiple ATM withdrawals. Despite the considerable losses borne by Maranti, the bank ultimately refunded him, absorbing the financial damage incurred due to Qose's fraudulent operations. The perpetrator managed to bypass rigorous internal security protocols, including two-factor authentication and online fingerprint verification, exacerbating the breach of trust.
