Undressing woman for sexual assault amounts to attempt to rape: Allahabad HC

The Lucknow bench of the Allahabad high court has observed that undressing a woman in a bid to rape her amounts to the offence of attempt to rape under Section 511 of the Indian Penal Code (IPC). Justice Rajnish Kumar passed the judgment on July 1, rejecting an appeal filed by a convict in the offence of attempt to rape a victim.
Since the case is from 2004, it was decided as per IPC and now the appeal has been adjudicated by the high court.

In this case, one Pradeep Kumar in 2004 had forcibly abducted the victim and kept her confined to a house for nearly 20 days. Later, he had attempted to rape her by undressing her. He was convicted by the trial court and sentenced to 10 years' imprisonment. The convict had filed an appeal against the verdict but the high court upheld the decision of the trial court.
The prosecution had alleged that the accused Pradeep Kumar forcibly took the victim in a van, confined her to a relative's house for about 20 days and during that time, he undressed her and attempted to sexually assault her. However, he failed to commit the offence of rape due to her resistance, the prosecution added.
The court noted that it was proved by the prosecution that the victim was forcibly kidnapped by the appellant with the intention of raping her.

'He with the said motive kept her at the residence of his relative for about 20 days, where he not only outraged the modesty of the victim but also attempted rape by undressing her. However, he could not commit intercourse on account of her protest. The victim has stated that the appellant had done bad work with her. The victim reiterated and supported the statement given under Section 164 CrPC before the magistrate in her evidence during trial also,' the court observed.
The court relied on several Supreme Court judgments in which it was held that the removal of the victim's clothes by the accused constitutes an attempt to rape.

It also dismissed the appellant's contention that the delay in filing the complaint weakened the prosecution's case, noting that the delay had been adequately explained.
The high court further rejected the argument that the accused was falsely implicated due to enmity, stating that the appellant had failed to substantiate this claim.

: The Lucknow bench of the Allahabad high court has directed the Uttar Pradesh chief secretary to apprise all the district magistrates of the guidelines and directions issued by the high court and the Supreme Court regarding the preparation of a gang chart for the invocation of the Gangsters Act. The court ordered, 'However, in the present case the authority concerned is at liberty to initiate fresh proceedings under the U.P. Gangsters and Anti-Social Activities (Prevention) Act (For representation only) With this direction, the court allowed a petition, quashing the impugned FIR registered under Sections 2(b)(i) and 3 of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, against two petitioners. A vacation division bench of Justice Alok Mathur and Justice Arun Kumar Singh Deshwal passed the order on June 27 on a petition filed by Shabbir Husain and another person seeking directives to quash the FIR lodged against them at Bhira police station in Lakhimpur Kheri district. The court directed, 'A perusal of the gang chart also shows that the District Magistrate, Lakhimpur Kheri has approved the gang chart on 21.03.2025. This fact shows that a training programme conducted by the State Government has no effect on the District Magistrate, Lakhimpur Kheri and even she ignored the guidelines of the State Government dated 02.12.2024 and approved the gang chart in utter violation of the direction issued by the High Court Allahabad as well as Supreme Court. Therefore, Chief Secretary, Govt. of U.P. is directed to look into this issue and shall apprise all the District Magistrates about the guidelines and directions issued by the High Court and Supreme Court regarding preparation of gang chart for invocation of Gangsters Act and if required, a fresh training programme be initiated for the competent authorities under the Gangsters Act.' The court said, 'In the present case, from the perusal of the gang chart, it is clear that while approving the gang chart, the District Magistrate simply mentioned 'discussed with Superintendent of Police and Committee and proposal approved'. 'This is absolutely non-application of mind and also not in consonance with the U.P. Gangster Rules as well as clear violation of judgements of this Court in Sunni Mishra @ Sanjayan Kumar Mishra (supra) and Abdul Lateef @ Mustak Khan (supra) as well as the judgements of Supreme Court in the case of Vinod Bihari Lal (supra) and Lal Mohammad (supra).' The court ordered, 'However, in the present case the authority concerned is at liberty to initiate fresh proceedings under the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 after preparing the gang chart in accordance with the law as mentioned above.' Accordingly, the high court allowed the petition quashing the impugned FIR lodged against the petitioners along with the gang chart.

New Delhi [India], July 5 (ANI) Nehal Modi, the brother of fugitive diamond merchant Nirav Modi, has been arrested in the United States on the basis of an extradition request made by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED), officials confirmed on Friday. The arrest marks a significant development in India's efforts to bring to justice individuals involved in the Rs 13,000 crore Punjab National Bank (PNB) fraud case. The United States Department of Justice has informed Indian authorities that Nehal Modi, brother of fugitive economic offender Nirav Modi, was arrested by U.S. authorities on July 4, 2025, the officials privy to the development told ANI. 'The arrest has been made pursuant to an extradition request jointly submitted by the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI),' said the officials. As per the complaint filed by the U.S. prosecution, extradition proceedings are being pursued on two counts: one count of money laundering under Section 3 of the Prevention of Money Laundering Act (PMLA), 2002, and one count of criminal conspiracy under Sections 120-B and 201 of the Indian Penal Code. Nehal Modi is wanted in India in connection with the multi-billion-dollar Punjab National Bank (PNB) fraud case, one of the largest banking scams in the country's history. Investigations by the ED and CBI have revealed that Nehal Modi played a key role in laundering proceeds of crime on behalf of Nirav Modi, who is also facing extradition from the UK. He is alleged to have assisted in concealing and transferring large sums of illicit funds through a web of shell companies and overseas transactions, in violation of Indian laws. The next date of hearing in the extradition proceedings is scheduled for July 17, 2025, when a status conference will be held. Officials further said that Nehal Modi may apply for bail during this hearing, which the U.S. prosecution has stated it will oppose. (ANI)
