All 7 prime accused in Hangal gangrape case granted bail
Hangal gangrape case
took a dramatic turn 17 months after the gruesome crime, with all the seven prime suspects granted bail by the additional district and sessions (FTSC-1) court of Haveri on Tuesday, following the survivor's inability to identify the suspects in court.
The seven prime suspects — identified as Aftab Chandanakatt, Madarasab Mandakki, Samiulla Lalanavar, Mohammad Sadiq Agasimani, Sohib Mulla, Tousif Choti, and Riyaz Saviker — had their bail pleas rejected multiple times in the past.
Of the 19 suspects initially arrested, including the seven prime suspects, 12 were granted bail and released from Haveri sub-jail 10 months ago.
The 26-year-old survivor had previously complained to the media that she was gang-raped by seven men.
She had made the same statement before a magistrate under CRPC section 164, and even identified the suspects during an identification parade in the presence of Hangal tahsildar.
However, public prosecutor Vijaykumar Patil confirmed that the survivor's reluctance to maintain her previous statements led to the court granting bail to all seven primary suspects.
C Gopal, the then additional SP of Haveri, had prepared a chargesheet that included statements from around 80 witnesses, including forensic experts, doctors, staff members and the owner of the private lodge where the survivor and her male companion were residing before the crime, and others.

The documenting of evidence spans roughly 1,000 pages, detailing the accused persons' involvement established through DNA samples, hair strands, blood samples, undergarments recovered from the crime scene, identification parade, and CCTV footage.
Moral policing turns into gangrape
Initially, a case of moral policing was filed, involving an interfaith couple residing at a private lodge. However, later, police added the gangrape charge after the survivor confirmed the crime before the magistrate on January 11, 2023.
The survivor, who was with her male companion at the time of the crime, said she was dragged to a forested area near Nalkuru Cross and sexually assaulted by the seven prime accused, who were later arrested from Akkialuru village. During the course of the inquiry, 12 others were arrested who had allegedly assaulted the victim and turned facilitator to the prime accused.

Picture Credit: X Kannada actor Darshan Thoogudeepa, along with actress Pavithra Gowda and others, faced scrutiny in connection with the murder of 33-year-old Renukaswamy in June 2024. In the latest development, the Supreme Court on Thursday cancelled the bail granted to Kannada actor Darshan Thoogudeepa, calling the earlier decision by the Karnataka High Court a "mechanical exercise of power." Court warns of witness influence in high-profile case According to reports by NDTV, a bench comprising Justices JB Pardiwala and R Mahadevan passed the order, setting aside the High Court's ruling that had allowed Darshan and other accused to walk free on bail. Justice Mahadevan, who authored the judgment, observed, "The grant of bail will impact the trial, and the witnesses can be influenced." The court stressed that in such a serious case, releasing the accused posed a significant risk of interference in the judicial process. Justice Pardiwala, while praising Justice Mahadevan's detailed order, remarked during the hearing, "It is ineffable. It conveys a message that, however big the accused may be, he or she is not above the law.' Darshan's bail cancelled: Why is Supreme Court unhappy with Karnataka HC order?
The Supreme Court on Thursday pulled up the Karnataka high court while cancelling the bail granted to actor Darshan in the Renukaswamy murder case. Actors Darshan and Pavithra Gowda. A bench of Justices JB Pardiwala and R Mahadevan set aside the Karnataka high court order, saying it suffers from various infirmities. 'We considered everything, the grant of bail as well as cancellation. It is evident that the order of High Court suffers from serious legal infirmities,' the Supreme Court said. 'The order fails to record any special or cogent reasons for granting bail under Sections 302, and 34 IPC. Instead, it reflects a mechanical exercise of discretion formed by significant omission of legally relevant facts. Moreover, the high court undertook an extensive examination of witness statements at pre-trial stage, highlighting alleged contradictions and delays, issues that are inherently matters for the trial court to assess in cross-examination. The trial court is alone the appropriate forum for evaluating the credibility and liability of the witnesses,' the apex court bench added. The Supreme Court further said that granting bail in 'such a serious case' without adequately considering the nature and gravity of the offence, the accused's role, and the tangible interference with the trial are among the prerogatives and unwarranted exercise of discretion. 'The well-founded allegations of witness interpretation, coupled with compelling forensic and circumstantial evidence further reinforce the cancellation of bail. Consequently, the liberty granted under the impugned order poses a real and eminent threat to the fair administration of justice and risk derailing of the trial. In light of these circumstances, this Court is satisfied that it calls for the extraordinary jurisdiction under Section 439 14 guarantees equality before law and prohibits arbitrariness. It mandates that all persons regardless of their popularity or privilege are equally subject to law. In view of the foregoing, all these appeals are allowed. The order dated December 13, 2024, is set aside and the bail granted to the accused person is hereby cancelled,' it said in the order. The judgment came on an appeal filed by the Karnataka government against the state high court's December 13, 2024, order of bail to Darshan and the co-accused. Meanwhile, Justice Pardiwala warned the state that if the court comes across any evidence by way of video or photograph showing that the accused was enjoying special privileges in jail, the court will summon the state officials. 'Justice delivery system at any level should ensure the rule of law is maintained. Howsoever big a person may be, he cannot be above law. The day we know that the accused are provided with special or 5 star jail facilities, the first thing will be to put the jail superintendent under suspension', he said. The court, while cancelling the bail of Darshan and others, directed the trial to be expedited. Darshan, along with actress Pavithra Gowda and several others, is accused of abducting and killing 33-year-old Renukaswamy, a fan who allegedly sent obscene messages to Pavithra. The state government moved the apex court against the bail to Darshan and six other accused on January 6. Darshan was arrested on June 11, 2024, two days after the body of Renukaswamy was discovered in a drain. In the police charge sheet, filed in September 2024, Gowda is named as the prime accused and Darshan as the second accused. Police alleged that Renukaswamy was harassing Gowda with lewd texts and images, apparently blaming her for Darshan's marital discord.
