, was hatched by the accused at Bhati's birthday party in Feb 2021 at a suburban five-star hotel.The judge, however, said all statements of witnesses allegedly present at the birthday party, as referred to by the prosecution, are hearsay of sorts.
"Even CDRs (call data records) of contacts between the accused inter-se is not incriminating material against the accused to frame the charges... The statement of a friend of the complainant (businessman) who was demanded money from the accused towards the bill of the birthday party and to whom the accused threatened for money (sic), is also not helpful to the prosecution," the judge said.
The judge further said it is an afterthought. "Neither that friend of the complainant nor the complainant himself complained anywhere against accused Riyaz for such threatening or demand of money towards payment of the bill," the judge said.The case stems from an FIR filed on Sept 26, 2022, accusing Riyaz of extorting money for expenses of a birthday party held in Feb 2021. Seeking discharge, Riyaz's lawyer submitted there is no prima facie case made out against him. "There is no material directly or indirectly on record against him. There is no nexus with the alleged crime... He is innocent. He is falsely implicated. There is no evidence in the entire chargesheet that he is a member of any organised crime syndicate or he acted on behalf of any organisation... (or) that he abetted any accused," the lawyer argued.The prosecution stated Riyaz is named in FIR for threatening the complainant. "The applicant allegedly instructed the complainant to organise their birthday party at Hotel Sahara Star... on February 19, 2021. A statement from the complainant's friend, who arranged the party, has been recorded, and the party's bill receipt of Rs 5.43 lakh has been collected. The FIR indicates that Salim Qureshi (accused) threatened the complainant for Rs 62 lakh and this accused also issued threats," the prosecution said.

A criminal case may also be initiated," said Munish Moudgil, special commissioner (revenue), BBMP. Despite the clear warning, KSCA took no action to remove the illegal LED displays, which were used again during the high-profile RCB event on June 2. The LED boards allegedly contributed to crowd congestion and blocked visibility near key exits, aggravating panic during the stampede, another official said. According to the senior civic official, KSCA was explicitly directed to remove the displays within seven days of receiving the May 13 notice, failing which the civic body would undertake their removal and recover costs along with penalties. The notice also warned of criminal prosecution under Sections 326 and 329 of the BBMP Act. "This was a preventable tragedy," said the BBMP official. "If KSCA had complied with the notice, crowd movement might have been smoother, and we might not be mourning the loss of 11 lives today."

Ahmedabad crime branch nabs female bouncer, auto driver with drugs
Ahmedabad (Gujarat) [India], June 8 (ANI): Ahmedabad Crime Branch arrested a female bouncer and an auto-rickshaw driver with huge quantity of MD drugs near Vinayak Park under Ramol area in the city, said a police statement. Acting on a tip-off, officials seized a mixture of 34 grams and 180 milligrams of Amphetamine and Mephedrone, with an estimated market value of Rs 3.41 lakh. The arrests were made when a team from the Crime Branch intercepted an auto-rickshaw near Vinayak Park. The accused were in possession of the illicit drugs without any legal permit and police recovered 34.180 grams of a mixture of Amphetamine and Mephedrone worth Rs 3,41,800, two mobile phones and an auto-rickshaw, added the police statement. The arrested identified as Ramiz Mohammed (30), and the female bouncer Sirinbanu (28), both residents of Ahmedabad. Investigations reveal that Ramiz is a habitual MD drug consumer and sourced the substances from Tanvir. Meanwhile, Sirinbanu reportedly brought the drugs from Mumbai for retail sale to earn profit. A case has been registered under sections of the NDPS Act at DCB Police Station and further investigations are ongoing to trace the supply chain and apprehend the remaining two accused. Apart from this, on Sunday, Ahmedabad Crime Branch apprehended Abhishek alias Shooter Sanjaybhsinh Tomar, a notorious criminal with a history of violent offences, after a tense standoff at an apartment in Odhav. Tomar, wanted in multiple cases involving assault, rioting, and illegal arms possession, had been evading the law. Acting on a tip-off, the Crime Branch team arrived at Shivam Awas, Building X, Flat No. 505 in Bhavang Flats, where Tomar hid. Tomar refused to open the door and instead climbed onto the kitchen balcony ledge, threatening to jump. After the police broke in, Tomar began livestreaming the standoff on social media, continuing to threaten to jump, said the crime branch in a press note. Authorities quickly mobilised the fire brigade and control room while negotiating with Tomar. Eventually, the police used 'appropriate force' to detain him without any casualties. (ANI)

1 2 Kolkata: Long periods of incarceration work against "reformative justice" and lead to "frustration and depression", the Calcutta High Court observed while granting interim bail to a murder accused. The accused was granted bail so that he could be with his family while his son underwent surgery. The accused was arrested on Nov 8, 2023 at the Titagarh police station. There were 27 witnesses in the case. Of these, only seven had been examined so far. Meanwhile, the accused had spent over one-and-a-half years in custody. A high court vacation bench of Justice Biswaroop Chowdhury granted the accused interim bail for eight weeks because 20 more witnesses were yet to be examined. The accused had sought bail on compassionate grounds, stating that his son was ill and required hospitalisation for surgery. The state opposed the plea stating that there was enough material to show the accused's involvement in the offence. The state further submitted that the accused's son was awaiting an elective surgery and was not hospitalised yet and did not require emergency intervention. The judge noted that interim bail could be granted during trial more than once after a certain period if there was inordinate delay in the completion of a trial. The HC said that in case the accused was convicted, he would need the mental strength necessary to undergo reformation, as the objective of punishment was to reform the guilty. The court further said if the accused was to be acquitted, he would need to have the motivation to resume regular life. "Incarceration for a long period makes a person depressed and frustrated, and may not help him undergo the reform process in case of conviction or resume normal life after acquittal," Justice Chowdhury said. "It was only when a person's detention was relaxed for some period and he was allowed to meet family members or near-relations who could motivate him, or visit any religious institution or undergo counselling, could he gain strength to face trial or undergo reformation process or resume normal life as the case may be," Justice Chowdhury added. Granting interim bail with conditions would prevent the accused from committing an offence upon release, the judge observed. The accused was granted bail on furnishing a bond of Rs 10,000 with two sureties. Other conditions for bail included meeting the officer-in-charge of the concerned police station twice a week, not entering the locality where the incident took place without the trial court's permission and not meeting individuals familiar with the facts of the case.
