ED crossing all limits: SC on agency summoning lawyers for giving legal advice
The remarks from an apex court bench of Chief Justice B R Gavai and Justice K Vinod Chandran came during a suo motu hearing initiated by the court to address the implications of such actions on the independence of the legal profession.
This comes in the wake of the ED summoning senior lawyers Arvind Datar and Pratap Venugopal.
'The communication between a lawyer and the clients is privileged communication and how can the notices be issued against them… they are crossing all limits," the CJI said.
'Guidelines should be framed," he said while responding to submissions that recent ED notices to legal professionals like senior advocate Datar could have a chilling effect on the practice of law.
Attorney General R Vennkataramani and Solicitor General Tushar Mehta said the issue had been taken up at the highest level and the probe agency asked to not issue notices to the lawyers for rendering legal advice.
'Lawyers cannot be summoned for rendering legal opinions," the solicitor general said.
He, however, said there have been attempts to malign institutions by creating false narratives.
Advocates stressed that summoning lawyers, especially for giving legal opinions, was setting a dangerous precedent.
'If this continues, it will deter lawyers from offering honest and independent advice," a lawyer said, adding that even district court lawyers were facing undue harassment.
The attorney general acknowledged the concerns and said, 'What is happening is certainly wrong." The CJI responded that the court had also been surprised by reports it came across. However, the solicitor general cautioned against forming opinions based on media narratives.
'There is a concerted effort to target institutions. Please don't go by interviews and news," the law officer said.
'We don't watch the news, haven't seen YouTube interviews. Only last week I managed to watch a few movies," said the CJI, who was indisposed last week.
When the solicitor general referred to politicians, accused in scams, attempting to shape public opinion, the CJI said, 'We said it… don't politicise this." 'The moment I heard about Mr Datar, I immediately brought it to the notice of the highest executive," Mehta said.
The bench directed all parties, including the Supreme Court Bar Association(SCBA), represented by its president and senior advocate Vikas Singh, to file comprehensive notes on the issue and allowed intervention applications.
The matter is now listed for further hearing on July 29.
'Ultimately, we are all lawyers," the CJI remarked, adding that arguments in court should not be viewed adversarially.
On June 20, the ED said it had directed its investigating officers not to issue summons to any advocate in money laundering investigations being carried out against their clients. An exception to this rule can only be made after 'approval" by the agency's director, it added.
The ED, tasked with combating money laundering crimes, issued a circular for guidance of its field formations, stating that 'no summons" should be issued to any advocate in violation of Section 132 of the Bhartiya Sakshya Adhiniyam (BSA), 2023.
'Further, if any summons needs to be issued under the exceptions carved out in proviso to Section 132 of the BSA, 2023, the same shall be issued only with the prior approval of the director, ED," the agency said.
The summons issued to these advocates was condemned by the SCBA and the Supreme Court Advocates-on-Record Association, which called the move a 'disturbing trend" that struck at the very foundations of the legal profession.
The bar bodies had urged the CJI to take suo motu cognisance of the matter.
On June 25, an apex court bench of Justices K V Viswanathan and N Kotiswar Singh said allowing police or probe agencies to directly summon lawyers for advising clients would seriously undermine the autonomy of the legal profession and was a 'direct threat" to the independence of justice administration.

It observed that the legal profession was an integral component of the process of administration of justice.

New Delhi, Jul 21 (PTI) The Congress on Monday condoled the passing away of former Kerala chief minister and veteran CPI(M) leader V S Achuthanandan, with Rahul Gandhi hailing him as a champion of the poor and the marginalised who upheld the values of principled politics through bold decisions. Achuthanandan, one of India's most respected Communist figures and a key presence in Kerala's political history, died on Monday at the age of 101. Congress president Mallikarjun Kharge said ideological differences aside, Achuthanandan's steadfast commitment to his principles earned him respect as a crusader for democracy. 'My deepest condolences on the passing of former Kerala Chief Minister Comrade V S Achuthanandan, who spent decades in public life," Kharge said in a post on X. A founding member of the Communist Party of India (Marxist), Achuthanandan was a lifelong champion of workers' rights, land reforms and social justice. He served as Kerala's chief minister from 2006 to 2011 and was elected to the state Assembly seven times, serving three terms as the leader of opposition. Punjab CM Mann emphasises stronger ties with UK in key sectors
Chandigarh, Jul 21 (PTI) Punjab Chief Minister Bhagwant Mann on Monday emphasised the need for stronger ties with the United Kingdom in key sectors such as textile, horticulture, education, light engineering, sports, bicycle manufacturing and defence. During a meeting with British Deputy High Commissioner Caroline Rowett at his official residence here, the chief minister highlighted the age-old relationship between Punjab and the UK, noting the significant contributions of the Punjabi diaspora to the UK's economy. He also underscored the importance of developing more ambitious and comprehensive agreements, particularly in the aforementioned sectors. In a statement, Mann advocated for the establishment of a structured communication mechanism between the governments of Punjab and the UK. Mann said such a framework would facilitate the exchange of knowledge and expertise, thereby promoting growth and prosperity on both sides. There is tremendous potential for collaboration between Punjab and the UK, particularly in the sectors of mutual importance, Mann said. Raising a pressing concern, Mann drew attention to the exploitation of young people by unscrupulous visa agents who take advantage of their aspirations. He pointed out that these agents often make false promises and employ illegal methods, leading to severe financial and emotional losses for the families of the visa aspirants. Mann also sought the British High Commission's help to check this problem effectively by formulating a joint strategy, especially by making people aware about the correct visa channels. India-US trade deal: American officials to visit New Delhi in August for sixth round of talks
A team of US trade officials will visit India in August for the next round of talks for the proposed bilateral trade pact between the two nations, reported news agency PTI. "For the next round of talks, the US team will visit India in the second half of August," a PTIreport said, quoting an official. Last week, India and the US officials concluded the fifth round of trade talks in Washington. Rajesh Agrawal, India's chief negotiator and special secretary in the Department of Commerce, and Brendan Lynch, Assistant US Trade Representative for South and Central Asia, held the deliberations. In the fifth round of talks, issues related to agriculture and automobiles are learnt to have figured, reported PTI. Matters related to ways to deal with non-market economies, and SCOMET (Special Chemicals, Organisms, Materials, Equipment, and Technologies) also came up for discussion. New Delhi and Washington are looking at finalising an interim trade deal before August 1 deadline, which marks the end of the suspension period of Trump tariffs. The Trump administration has imposed 26 per cent tariffs on India. On April 2 this year, President Donald Trump announced reciprocal tariffs on the US trading partners. According to the report, New Delhi is seeking the removal of this additional tariff of 26 per cent. It is also seeking the easing of tariffs on steel and aluminium (50 per cent) and the auto sector (25 per cent). Certain farmers' associations have urged the government not to include any issues related to agriculture in the trade pact. India is also seeking duty concessions for labour-intensive sectors, such as textiles, gems and jewellery, leather goods, garments, plastics, chemicals, shrimp, oil seeds, grapes, and bananas, in the proposed trade pact. On the other hand, the US wants duty concessions on certain industrial goods, automobiles, especially electric vehicles, wines, petrochemical products, agri goods, dairy items, apples, tree nuts, and genetically modified crops. In the April-June quarter of this fiscal year, India's merchandise exports to the US rose 22.8 per cent to $25.51 billion, while imports surged 11.68 per cent to $12.86 billion.
