Earlier, it was contended on behalf of the State government that some police officers acted like 'servants' of RCB and 'embarrassed' the government due to the death of 11 persons in the stampede that occurred outside the stadium on June 4.
These submissions were made before a division bench comprising Justice S.G. Pandit and Justice T.M. Nadaf during an appeal filed by the State government, which had questioned the Central Administrative Tribunal's July 1 verdict of quashing the government's June 5 order of suspending Mr. Vikash Kumar, who was holding the post of Additional Commissioner of Police (West) on the day of stampede.
Senior Advocate P.S. Rajgopal, appearing for the government, argued that the police officers made some security arrangements without first asking who had authorised the public event.
Pointing out that the senior police officer have the power under Section 35 of the Karnataka Police Act to 'prohibit certain acts for prevention of disorder' Mr. Rajgopal contended that they failed to exercise this power and Mr. Kumar, who was allegedly aware of the request made by the Karnataka State Cricket Association on victory celebrations to the station house officer of Cubbon Park police station, had failed to take proper measure.
Senior advocate Dhyan Chinnappa, appearing for Mr. Vikash Kumar, contended that the senior police officers were made 'scapegoats' as suspension was not based on any material against the police officers but to fix 'accountability' to someone.
Though the order of suspension refers to dereliction of duty, the government has made it clear in its status report submitted to the High Court that it took action (of suspension) against senior police officers 'recognising the need for accountability within the law enforcement hierarchy.' Mr. Chinnappa pointed out.
It was also pointed out that an IPS officer cannot be suspended on the charges of dereliction of duty, sans following procedure, which in the case of Mr. Vikash Kumar has not been followed, argued Mr. Chinnappa. The arguments will continue on Friday.

Madras HC directs TN govt to decide on horizontal reservation for transpersons in education, employment
CHENNAI: Appreciating the Tamil Nadu government for the implementation of the Tamil Nadu State Policy for Transgender Persons, 2025, the Madras High Court has directed the state to take a decision on the request from the community for horizontal reservation in education and employment. The direction was given by Justice N Anand Venkatesh on the request made by a representative of the community pointing to Clause 3.7 of the policy which uses the term "Right to Representation in Employment and Educational Institution". He said it is not clear as to whether the Government wants to provide horizontal reservation to the transgender and intersex persons as it has always been the request by the community and has been reflected in many of the earlier orders passed by the various Courts, Justice N Anand Venkatesh said in an order passed on Monday. 'Hence, the State Government is directed to take a decision in this regard so that the transgender and intersex persons need not knock the doors of this Court every time and seek for reservation in public employment and educational institutions,' the judge said in an order passed on Monday.

Wife can summon bank officials to uncover husband's real income: Delhi HC
NEW DELHI: In a significant ruling, the Delhi High Court has held that a wife has the right to summon witnesses, including bank officials, to establish her husband's actual financial status in a maintenance case. Justice Ravinder Dudeja, in a detailed 11-page judgment, allowed a woman's plea under Section 311 of the Criminal Procedure Code (CrPC), setting aside the family court's earlier order that had denied her this right. 'Matrimonial litigation, particularly where financial dependency and concealment are alleged, demands a sensitive and pragmatic approach,' the court observed. Justice Dudeja emphasized that the evidence and witnesses the wife sought were directly relevant to the determination of maintenance and not collateral or extraneous. He criticised the family court for taking a 'hyper-technical view' and stated that it should have interpreted its powers under Section 311 CrPC in a more purposive manner. The court noted a common pattern in matrimonial disputes, where husbands attempt to hide their actual earnings or transfer assets to evade maintenance obligations. 'It is not uncommon that when there are matrimonial differences, husbands tend to suppress their real income and resort to transferring their assets to avoid payment of legitimate dues to their wives,' the judge remarked. The case involved a couple married on February 16, 2012. The wife alleged that she faced domestic violence and dowry harassment post-marriage and that the husband, along with his family, deserted her, locking the matrimonial home and retaining her stridhan, jewellery, and cash. She sought to summon witnesses to authenticate documents related to a Shakti Nagar property, alleging that the husband had concealed financial information, including the sale of a Noida property and his appointment as a CFO in 2014. In response, the husband argued that the witnesses were not relevant and accused the wife of delaying the proceedings by filing multiple applications. He also claimed that she had approached the court with unclean hands.
