The Kerala High Court has directed the police to consider a petition filed by an entrepreneur in connection with the alleged tapping of phones of IPS officers and others.
Kollam-based entrepreneur Murugesh Narendran had earlier approached the police in the wake of alleged claims by former MLA P.V. Anvar that he had tapped their phones. Citing that such tapping was a violation of their privacy and rights, he approached the court seeking a probe by the Central Bureau of Investigation (CBI) 'as the police had not conducted a probe into his complaint.'
While directing the police to consider the petition, the High Court asked whether Mr. Anvar ran a parallel system of governance. The High Court had in December 2024 issued notice to the State government and Mr. Anvar on a writ petition seeking a CBI probe into the alleged illegal tapping of phones by Mr Anvar. Mr Narendran had pointed out that the MLA had publicly admitted to having intercepted telephone conversations of individuals, including police officials, politicians and the petitioner.

The Kerala High Court has said the 24-hour period to produce an accused before a magistrate commenced from the time the person is effectively detained or his/her liberty curtailed, and not from the time of arrest that the police recorded. A Bench of Justice Bechu Kurian Thomas said the non-recording of arrest under one pretext or another was often resorted to under the guise of investigation. Police brutalities generally occured during these periods of uncontrolled authority. Unless there was a check, such unrecorded periods of custody could be the source of human rights violations, the court observed. The Constitution mandates that the person arrested be produced before the nearest magistrate within 24 hours of the arrest. Other than the time needed to reach the magistrate court from the place of arrest, there is a peremptory prohibition that the person arrested shall not be detained beyond the said period without the magistrate's authority, it said and granted bail to Biswajit Mandal of West Bengal, who had been arrayed as accused in a drug case. Mr. Mandal contended that he was detained beyond the 24-hour period, in violation of constitutional and statutory prescriptions and had sought bail. To decide the legal issue regarding when the 24-hour period began, the court had appointed Nikhina Thomas and Neha Babu, second-year students of Ramaiah College, Bengaluru, as amici curiae for providing assistance.

A Surat-based business man has received a message on his mobile phone recently informing him about an e-challan dated April 2025 for violation of traffic rules. The offence: riding a vehicle without insurance. The penalty amount was Rs 2,000. The problem was the scooter mentioned in the e-challan was stolen on November 3, 2021, and he had filed a police complaint way back then, but no action was taken by the police. This is not the first time Naresh Bhola, who runs an embroidery thread material shop in a commercial complex at Ashwani Kumar road in Varachha, Surat, was getting a challan for his stolen scooter. On November 8, 2022, Bhola received an e-challan with a penalty amount of Rs 500 from the Surat police traffic department, for 'talking on a mobile phone while riding his bike at Sosyo Circle in Bhatar area'. 'I did not pay any attention to it as my scooter was stolen and I was not using it, and I had already filed a police complaint,' he told The Indian Express. On 10th April 2023, police men from Katargam station came to his home with a warrant to remain present in the Judicial Magistrate First Class (JMFC) court in Surat on April 12. 'I reached the court and submitted a copy of the application given to the Katargam police station, and told the court that my scooter was stolen in 2021. The warrant was later cancelled,' he said. Bhola said that at that time, he again filed a complaint with Katargam police requesting them to file a theft complaint, but the police didn't take any action. A resident of Dabholi village in Surat, Bhola again filed a complaint with Katargam police on Tuesday stating that his scooter parked outside the shopping complex where he runs the shop was stolen on November 3, 2021. On Tuesday evening, police registered a theft case based on his complaints. Katargam police inspector B K Chaudhary said, 'A theft case has been filed based on a complaint filed by Naresh Bhola. A copy of the FIR will be sent to the JMFC court so that he cannot face any warrant.' He also said that the police will also check why an FIR was not registered in 2021 when Bhola filed a complaint with the police. He added, 'We have intimated the traffic police control room and Surat city police command and control centre to keep an eye on the scooter so that we can catch the rider.' Bhola now hopes that the police will crack the theft case, finally.
