
At least 5 law firms helping House prosecution in VP Sara's impeachment trial

At least five law firms will help the House prosecution panel in the impeachment trial of Vice President Sara Duterte, one of the prosecutors told reporters on Thursday.
San Juan Rep. Ysabel Maria Zamora said the panel met on Thursday to discuss its preparations for the trial, including the presentation of the articles of impeachment before the Senate impeachment court on June 2.
Asked how many private lawyers were helping the House prosecution team, Zamora said, "Hindi ko masabi just because I don't know if they're complete."
"We have, you know, we have many lawyers, some of them coming from the same firm. So we can count that as one or as several... But definitely more than the public prosecutors," Zamora said.
How many law firms are involved? "Hindi ko masabi (I can't say). Definitely, at least five. Maybe ten."
'We're doing the same preparations that we've been doing. For example, we've had a mock trial before. We prepared the judicial affidavits for the witnesses. We examined witnesses," Zamora said.
"We're not interviewing witnesses now, at least in the article that I'm handling. But we're reviewing all of the documentary evidence that we already have on hand,' she added.
Among the pieces of evidence that will be presented are the reportedly fictitious names that received confidential funds from the Office of the Vice President and the Department of Education.
'I think it will be difficult to acquit the vice president in view of the numerous pieces of evidence that we have. Kumbaga, yung senators for us, sila yung haharap sa public kapag nag-acquit sila sa dami ng ebidensya na nakalap na namin,' Zamora said.
The impeachment complaint provides for seven Articles of Impeachment, namely:
conspiracy to assassinate President Ferdinand Marcos Jr. First Lady Liza Marcos, and Speaker Martin Romualdez; malversation of P612.5 Million in confidential funds with questionable liquidation documents; bribery and corruption in the DepEd during Duterte's tenure by handing out cash to former DepEd Undersecretary Gloria Jumamil-Mercado (Procurement Head), Bids and Awards Committee Member Resty Osias, DepEd Chief Accountant Rhunna Catalan and Special Disbursing Officer Edward Fajarda; unexplained wealth and failure to disclose assets in the Vice President's Statement of Assets, Liabilities, and Net Worth where her wealth increased by four times from 2007 from 2017; involvement in extrajudicial killings in Davao City; destabilization, insurrection, and public disorder efforts, which include: boycotting the State of the Nation Address (SONA) while declaring herself "designated survivor," leading rallies calling for Marcos' resignation, obstructing congressional investigations by ordering subordinates not to comply with subpoenas, threatening bodily harm against the First Couple and Romualdez, among others; the totality of the Vice President's conduct as the second highest official of the land.
The president's offer of reconciliation to the Dutertes was not discussed in the meeting.
'It wasn't even mentioned but I would think everyone present in our meeting, the prosecution, the prosecutors, the private lawyers also are, I would think that everyone's in agreement that we will proceed with the impeachment simply because it's our duty to do so,' Zamora said.
Senate President Chiz Escudero's letter to the House of Representatives regarding the presentation of the Articles of Impeachment to the Senate on June 2 was one of the topics of discussion when the House Prosecution Panel resumed its weekly meeting this morning.
Of the 11 prosecutors, five attended - Reps Romeo Acop of Antipolo City 2nd district, Jonathan Keith Flores of Bukidnon 2nd district, Arnan Panaligan of Oriental Mindoro 1st district, Ysabel Maria Zamora of San Juan, and Ramon Rodrigo Gutierrez of 1-Rider Partylist.
'So we resumed our meeting after the elections and we discussed the letter of the Senate President sent to the House of Representatives, that we will present the articles of impeachment on June 2 before the Senate,' Zamora told reporters in an online interview.
'They expect us to read the Articles of Impeachment. In fact, the Senate, I believe it was the Senate who sent the Congress video of how it is done in the States. So while hindi naman namin siyempre eksaktong magagaya yun, there's a reading of the Articles of Impeachment,' she added.
The House Prosecution Panel has yet to discuss how the Articles of Impeachment will be presented, if there will be only one prosecutor who will read all seven articles or if a prosecutor will be assigned for every article.
ML Partylist Rep-elect Leila de Lima and Akbayan Partylist Rep-elect Chel Diokno were not present in this morning's meeting as their term will start on June 30 and they need to be elected in plenary.
Zamora said each prosecutor has been assigned to handle three Articles of Impeachment. –NB, GMA Integrated News

78% of Pinoys want VP Sara Duterte to face impeachment trial —OCTA survey
Majority of Filipinos believe Vice President Sara Duterte should face a Senate trial or impeachment court, according to survey results released Monday. Based on OCTA Research's Tugon ng Masa (TNM) survey, 78% of Pinoys want Duterte to face a Senate trial or impeachment court to respond to the charges and formally clear her name. Only 13% disagreed while 9% said they did not know the answer or have no answer. 'These findings reflect strong public support for accountability and due process in addressing the allegations against the Vice President,' OCTA said. The non-commissioned survey was conducted from April 20 to 24 through face-to-face interviews with 1,200 male and female respondents aged 18 and above. According to OCTA, the survey has a margin of error of ±3 % at a 95% confidence level. "Subnational estimates for the geographic areas covered in the survey have the following margins of error at a 95% confidence level: ±6% for Metro Manila, Balance Luzon, Visayas, and Mindanao," OCTA said. The House impeached Duterte on February 5, with over 200 lawmakers endorsing the complaint. On the same day, the Articles of Impeachment were transmitted to the Senate but the upper chamber adjourned without addressing the case. On February 25, Senate President Francis 'Chiz' Escudero said the processes related to Duterte's impeachment trial would start on June 2. However, Escudero on May 29 said the presentation of the Articles of Impeachment before the Senate was moved to June 11 to prioritize the passage of the items in the administration's legislative agenda before the end of 19th Congress. Senator Ronald "Bato" dela Rosa recently said that he and other senators are working on their drafts of a Senate resolution seeking to dismiss the impeachment case against Duterte. Duterte was accused of betrayal of public trust, culpable violation of the Constitution, graft and corruption, and other high crimes. The complaint also includes her 'assassination' remarks against President Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos and Speaker Martin Romualdez. Should the impeachment trial not push through, De Lima said there would be an 'erosion of public trust' in the Senate 'Marami pong aalma dyan. Maraming mawawala ng respeto sa Senado bilang institusyon, which is very sad and unfortunate,' said De Lima, a former senator. (Many would be angered by that. 'Wala namang choice ang Senado. Hindi ito desisyon ng mga senador. Ito ay constitutional responsibility ng mga senador,' Gatchalian told Super Radyo dzBB. (The Senate has no choice. This is not the decision of senators. It is a constitutional responsibility of senators.) 'Walang uncertainty kasi dapat namin sundan ang Constitution. Klaro sa Konstitusyon na kailangang i-convene ang impeachment court once na na-transmit na sa Senado ang Articles of Impeachment,' he added. (There's no uncertainty because we need to follow the Constitution. It is clear in the Constitution that we need to convene the impeachment court once the Articles of Impeachment has been transmitted to the Senate.) Tolentino shared the same sentiments as Gatchalian. 'Dapat mag-convene kasi tatanggapin namin ang Articles of Impeachment formally. 'Yung pagko-convene is part of the trial itself; 'yun 'yung simula when you take an oath,' Tolentino said in a separate dzBB interview. (We need to convene because we will formally accept the Articles of Impeachment. Convening is part of the trial itself; it starts when you take an oath.) Tolentino said it is possible to finish the impeachment trial in 19 days, until June 30. He presented the possible schedule the Senate may use for Duterte's impeachment trial proceedings: June 11: Constitutes impeachment court; 10 days for submission of the respondent's response June 22: Reply of prosecutor June 23: Submission of trial brief; Opening statement in the afternoon June 24-25: Presentation of evidence on the part of prosecution June 25-26: Defense June 27: Rebuttal; prosecution in the morning and defense in the afternoon June 28: 1 hour each for oral argument, defense, and prosecution June 29: Closed door meeting June 30: Render of judgement However, Tolentino has yet to present this to the Senate. Tolentino also said the prosecution can narrow down the seven Articles of Impeachment, just like during the impeachment of Chief Justice Renato Corona, where it was narrowed down from eight articles to three articles. Integrity issues Both Gatchalian and Tolentino also agreed that failing to convene Duterte's impeachment court could cause integrity issues for the Senate. 'Ang Senado ay guardian of democracy. Dapat itong panindigan, dahil isa 'yan sa pinakamahalagang trabaho ng Senado para may pananagutan o accountabilty 'yung mga mataas na personalidad,' Gatchalian said. 'Ayaw nating magkaroon ng credibility problem at integrity issues,' he added. (The Senate is the guardian of democracy. We need to uphold it because this is one of the most important jobs of the Senate, so that high-ranking personalities have accountability. We don't want to have credibility problem or integrity issues.) 'I totally agree [that the image of the Senate may be ruined if we don't convene the impeachment],' Tolentino said. Tolentino, however, maintained that unfinished business of the 19th Congress does not carry over into the 20th Congress, noting that Duterte's impeachment case will be considered 'functionally dismissed' if the Senate impeachment court is unable to finish the trial before June 30, 2025. He said there is no provision stating 'carry over' in the Philippine Constitution. 'Ang salitang 'forthwith' ay command na naka-attach sa 19th Congress. Hindi 'yun constitutional command sa 20th Congress,' Tolentino said. (The word 'forthwith' is a command attached to the 19th Congress. It is not a constitutional command to the 20th Congress.) On the other hand, Gatchalian believed that the impeachment case cannot be done in one month and, therefore, will be transferred to the 20th Congress. 'Hindi ito matatapos ng isang buwan lang. Talagang tatawid ito sa 20th Congress. Sinabi na ng Korte Suprema na ang Senado ay isang continuing body. Puwede itong tumawid sa mga ganitong sitwasyon,' Gatchalian said.
