
Lifted ban on issuance of EWS certificates, Delhi govt tells HC
The city government on Monday told the Delhi High Court that it has lifted the ban on the issuance of Economically Weaker Sections (EWS) certificates in the national capital.
The submission was made before a bench of Justice Sachin Datta, as it dealt with a petition challenging the Delhi government's directive to stop the issuance of all EWS certificates indefinitely.
Because of the impugned decision, the petitioner faced difficulty in applying to the advertised post of Assistant Public Prosecutor (APP) by the Union Public Service Commission (UPSC).
As per the advertisement, the UPSC has reserved six out of 66 vacancies for the post of APP for EWS candidates.
In relief to the petitioner, the Delhi HC allowed him to participate in the recruitment process (as of now) without any EWS certificate, in view of the fact that the last date of submission of the application form is May 1.
The single-judge b ench of Justice Datta clarified that the petitioner would produce his EWS certificate at the relevant stage, as per advocate Ashu Bidhuri.
The petition contended that the Delhi government, pursuant to a meeting held on April 9, issued a directive to stop the issuance of all EWS certificates indefinitely "without any statutory notification, legal basis, or transparent procedure, allegedly due to apprehensions regarding misuse or irregularities".
As a result, the petitioner and other similarly placed genuine applicants, applying for the post of Assistant Public Prosecutor, are being denied access to a constitutional benefit enshrined under Articles 15(6) and 16(6) of the Constitution, the plea added.
"The impugned directive, lacking any formal legal sanction, amounts to a blanket prohibition on a welfare measure enacted by Parliament, thereby violating the constitutional scheme of separation of powers. It constitutes executive overreach, frustrates the intent of the Constitution (One Hundred and Third Amendment) Act, 2019, and infringes upon the petitioner's rights under Articles 14, 16, 19(1)(g), and 21 of the Constitution," contended the petition.
It prayed to quash the executive directive halting the issuance of EWS certificates and sought a direction to the authorities concerned to issue the petitioner a valid EWS certificate in a time-bound manner to enable him to apply for the reserved post.

Kerala high court slams Centre over indecision on Wayanad loan relief KOCHI: Kerala HC on Friday pulled up Union government for its delay in taking a definite stand on granting loan waiver to those affected by the July 2024 landslides at Chooralmala and Mundakkai in Wayanad. The Centre cited omission of a relevant section in the Disaster Management Act. The court was hearing a suo motu petition on rehabilitation of the landslide victims. Justices A K Jayasankaran Nambiar and P M Manoj observed the Centre cannot take the position that it lacks the power to waive loans for the landslide victims due to the omission of Section 13 of the Act, which earlier empowered the National Disaster Management Authority (NDMA) to recommend relief in repayment of loans. "We want to know categorically, through an affidavit filed by someone responsible in Union government, whether they are stating that they do not have the power to direct banks to waive loans. We can understand a reluctance to act, but at least have the courage to say so. The decision must be taken by the Union govt. Let the Union take a decision," court said. While NDMA might no longer have the statutory authority to recommend such relief, the Union government still retains residual powers to take a decision, the court said. The landslides had claimed 298 lives and caused extensive property destruction.

Delhi HC stays demolition of 11 properties in Batla House
ANI 14 Jun 2025, 00:22 GMT+10 New Delhi [India], June 13 (ANI): The Delhi High Court granted an interim stay on Friday for the proposed demolition of 11 properties in the Batla House area of Okhla. Residents of these properties have challenged the notices issued by the Delhi Development Authority (DDA). The residents of properties situated at Muradi Road, Batla House, have challenged the notices issued by DDA on May 24 and 26. Single judge bench of Justice Tejas Karia on Friday granted interim stay on proposed demolition till next date. Delhi HC has issued notice to DDA and sought a response. The matter has been listed on July 10 for hearing before the roster bench. Delhi High Court agreed to stay the DDA notice of demolition in Batla House area subject to the petitioner filling an affidavit to withdraw their application from Supreme Court. Mohammad Tamsil Quddusi and 10 other residents have moved a petition through advocate Fahad Khan. It is stated that 9 properties don't fall within the Khasra Number 279. Two properties of Qademul Faraz and Nassu Ahmed fall within the Khasra Number 279 but are eligible under PM Uday Scheme. It was also stated that before pasting notices on the premises of petitioners by the DDA, they were not given an opportunity to be heard or redressal. Petitioner Badruddin has even not received the notice. He was orally informed by the DDA officials that his property will also be demolished. The Delhi High court' division bench on Wednesday allowed Aam Aadmi Party MLA Amanatullah Khan to withdraw his Public Interest Litigation (PIL) filed against the proposed demolition. The Division bench had noted that the petitioner would inform the residents of his area to file an appropriate petition before the single judge bench which have already granted protection to some petitioners. Two FIRs under the Atrocities Act registered against ex-MP Jaleel
Chhatrapati Sambhajinagar: Two FIRs were registered against former MP Syed Imtiaz Jaleel in the 24 hours ending Friday for allegedly using a discriminatory word against district guardian minister Sanjay Shirsat during a press conference, days after he made serious allegations against Shirsat's family over land acquisitions. Police said the two FIRs were registered at Kranti Chowk and Osmanpura police stations. Officers said they also received complaints on similar lines at different police stations, including Vedantnagar, but no decision was made to register fresh FIRs. Jaleel told TOI, "I just want Shirsat to reply to the questions I have raised about the huge moveable and immovable assets he has amassed. Unable to silence me, he is using police machinery to file such cases against me. I am ready to face all the consequences until all such elements are exposed." Police said based on the complaint lodged by Laxman Hivrale, an office-bearer of the Republican Party of India (Athawale), the Kranti Chowk police registered an FIR on Thursday night. In this FIR, Section 3 (1) of the Scheduled Caste, Scheduled Tribe (Prevention of Atrocities) Act was invoked against Jaleel. On Friday, the assistant commissioner of police (City) issued directives to the Kranti Chowk police inspector for conducting a preliminary inquiry into the case and submit a report to him. The FIR was registered after a large number of Shirsat's supporters gathered at the police station on Thursday afternoon. The list of those who gathered included Jaleel's former loyalist Arun Borde, who said he intended to get FIRs registered across the state. "Though the second FIR was registered at Osmanpura police station, it will be merged with the first one registered at Kranti Chowk. The law is clear that there cannot be two FIRs for one violation, for which a person was already booked," said a senior police officer from the city police.
