Delhi HC rejects plea to halt razing of Pak Hindu refugee camp
Pakistani Hindu refugees cannot be entitled to seek alternate accommodation as a matter of legal right on account of their foreign nationality, the Delhi high court has held
Dismissing a petition by the refugees seeking to restrain the Delhi Development Authority (DDA) from demolishing a refugee camp at Majnu Ka Tilla, until their resettlement on an alternative land, a bench of justice Dharmesh Sharma said that the petitioners cannot rely on May 2013 direction of the Centre to seek alternate accommodation as a matter of legal right.
The court was hearing a plea filed by an activist Ravi Ranjan Singh against the proposed demolition of a refugee camp by DDA.
Taking up the cause of approximately 800 Hindu refugees from Pakistan, Singh urged the court to restrain DDA from demolishing the camp, until they were allowed an alternate land to reside in view of government's policy to give shelter to non-Muslim minorities from countries such as Pakistan, Afghanistan and Bangladesh as per the Citizenship Amendment Act.
He further asserted that the primary responsibility to accommodate the said refugees rests on the Centre's shoulders, as the plea relied on the Centre's May 2013 statement on extending support to the Hindu community which came to India from Pakistan.
'This Court has no hesitation in holding that the petitioner herein is not entitled to the reliefs sought by way of the present petition. First and foremost, the order dated 29.05.2013 passed in Nahar Singh case does not contain any direction to suggest that an alternate accommodation was promised to the said group of refugees by the Government of India, or that they were entitled to such allotment, thus, the petitioner herein cannot seek alternate accommodation as a matter of legal right,' the court opined.
Additionally, the order stated that even under the Delhi Slum & JJ Rehabilitation and Relocation Policy, 2015, any person sought to be relocated and rehabilitated must first and foremost be a citizen of India to become eligible for the allotment of alternate dwelling units.
'In view of the aforesaid, the position that emerges is that the Pakistani refugees cannot be rehabilitated under the DUSIB Policy on account of their foreign nationality status. The petitioner and other similarly placed refugees have no right to continue to occupy the area in question,' the order said.
DDA in March last year asked the residents to vacate the camp, failing which it will be demolished by the authority concerned. On March 12, the high court by way of an interim order restrained DDA from demolishing the camps.
DDA, represented by advocate Prabhsahay Kaur, submitted that the National Green Tribunal on January 29 this year directed removal of all the encroachment on the Yamuna Flood Plain Zone adjacent to South of Gurdwara Majnu ka Tila on Yamuna River Belt. A cost was also imposed on DDA, and thus the civic authority was bound to follow the judicial orders, the advocate said.
Taking note of the fact that the land fell under the Yamuna floodplains, justice Sharma said, 'It is undeniable that even Indian citizens cannot claim alternate allotment as an absolute right, particularly in cases where the land they occupy falls under specially prohibited areas like Zone 'O' of Delhi, i.e., the Yamuna floodplains. Given the critical condition of the Yamuna River, this court unhesitatingly finds that no interference with the ongoing restoration and rejuvenation efforts of the river can be countenanced at the petitioner's instance.'
While dismissing the plea, the court also vacated its interim order and impressed upon the refugees to acquire Indian citizenship, which would enable them to enjoy rights and benefits available to any ordinary Indian citizen.
'Needless to state, the effect of the acceptance of... (citizenship) application would be that the aggrieved refugees shall be deemed citizens of India and would be able to enjoy all rights and benefits available to any ordinary citizen of India,' the court said.

Tirupati: Tirumala Tirupati Devasthanams (TTD) Board Member G Bhanu Prakash Reddy has written to the Director General of Police (DGP) seeking a detailed investigation into what he described as a deliberate and coordinated attempt by the YSR Congress Party (YSRCP) to malign the TTD and destabilise the newly elected State government. He alleged that YSRCP leaders had used the video to target the TTD administration and incite public anger. Another incident cited by him involved a YSRCP supporter allegedly raising slogans against the TTD chairman while in a temple queue line. He described this as a 'deliberately staged act' aimed at discrediting the TTD and the ruling NDA government. 'These are not isolated events and form part of a larger, carefully planned conspiracy by the YSRCP leadership to undermine the TTD's reputation and destabilise the state government', he said. Bhanu urged the DGP to initiate a criminal investigation into the matter, alleging that misleading content was being deliberately created and disseminated across social, electronic, and print media platforms to achieve political objectives.

After demolitions in Delhi's Madrasi Camp, Tamil Nadu offers support to families
The Tamil Nadu government on Sunday said that it will support families looking to return to their native districts after their homes in the Madrasi Camp in New Delhi's Jangpura area were demolished. The decades-old camp, built overlooking the Barapullah drain near Nizamuddin Railway Station, housed 370 tenements and was predominantly inhabited by families originally from Tamil Nadu. On Sunday, the Delhi Development Authority demolished the homes in the camp on the directions of the Delhi High Court, The Indian Express reported. The Delhi government was directed to relocate the families as the camp was allegedly blocking the Barapullah drain, which was leading to waterlogging. Hours after the demolition, the Tamil Nadu government stated that it was in 'active coordination' with the residents of the Madrasi Camp to ensure every possible support was extended to them without delay. It added that Chief Minister MK Stalin had directed the Tamil Nadu House in New Delhi, the guest house of the state government, to facilitate and oversee the coordination efforts. 'Comprehensive support, including assistance for livelihood and other essential needs, will be extended to them,' said the state government. 'This assistance will be facilitated through the offices of the concerned District Collectors to ensure timely and effective implementation.' Describing the Madrasi Camp as an 'unauthorised encroachment', the High Court on May 9 directed authorities to clear the area along the Barapullah drain. It said the camp was obstructing drainage and causing severe waterlogging in the surrounding areas during the monsoons. The court had also directed that eligible residents be rehabilitated and relocated under provisions of the Delhi Urban Shelter Improvement Board Act and the Delhi Slum and Jhuggi Jhopri Rehabilitation and Relocation Policy, The New Indian Express reported. Subsequently, the Delhi Urban Shelter Improvement Board determined that only 215 out of the 370 residents in the camp were eligible for housing. These families were allotted residential units in Narela, a northern suburb over 35 kms from the camp, The Indian Express reported. The remaining 155 families had reportedly failed to meet documentation or eligibility criteria. The settlement, which is more than six decades old, housed Tamil-speaking migrants who had arrived in the national capital seeking employment as domestic workers, cooks and daily-wage labourers.

25 families from YCP join TDP
Amadaguru: Former minister Dr Palle Raghunath Reddy said that people are turning towards the Telugu Desam Party with the belief that under the leadership of Chief Minister Chandrababu Naidu, along with the development of the state, justice for the people will be done. The rice distribution programme for the poor through the government's grain center was launched by former minister Dr Palle Raghunath Reddy in Amadaguru mandal. He said that the TDP is the party of the people. He said that the people voted for the TDP in the elections thinking that development is possible in Andhra Pradesh under the leadership of Naidu. He said that many people are joining the TDP with the intention that justice will not be done due to the YCP. Later, about 25 families from YCP joined the TDP in the presence of the latter. Abdul Rauf, Shekshavali Shabbir Tailor, Babu Auto Bujji, Abdul Rehman Chicken Bujji, Asif, Babjan, Altaf, Jamir, Peddabbulu Karim, Babjan, Mansur Hussain, Bhasha, Farooq Somu, Aruna and many other YCP workers from Muslim families joined the TDP. He visited the sick TDP workers in Mohammedabad and provided some financial assistance. Later, he inaugurated a cattle water tank at the Vyalrathi Palli Cross. From there, he visited TDP senior leader and former TDP convener Subbaiah in Kandukuri Palli. Several issues were brought to the attention of the former minister. He said that justice will definitely be done to everyone. TDP leaders from Amadaguru, State Director Kale Nayak, former ZPTC Srinivas Reddy, Krishnamurthy, former convener Prabhakar Reddy, Bodeppa, Nanjappa, and others participated in this programme.
