
Bengal makes minor tweaks to OBC list struck down by HC

Kolkata: Bengal's new OBC list, tabled by state govt in the assembly on Tuesday, has minor changes compared to the previous list. While the earlier list, struck down by the Calcutta High Court, had 113 OBC subgroups with 77 Muslim and 36 others, the new OBC list has 140 subgroups, 80 of them Muslim.
Supreme Court is hearing a challenge by Bengal govt against the HC scrapping of the earlier list, impacting around 5 lakh OBC certificates. The state had told the SC that it would complete its fresh OBC survey by the end of June. The survey tabled on Tuesday also indicated that state is hearing representations from 50 more OBC groups.
The percentage of Muslims in the new OBC list is 57.1. While there are 73.4% Muslims in the OBC 'A' category (in a total of 49 subgroups, 36 are Muslims and 13 non-Muslims), OBC 'B' has 48.3% Muslims (there are 91 subgroups, of which 44 are Muslims, and 47 are non-Muslims).
The HC ruling had reduced 17% OBC reservations in the state to 7%. The report tabled on Tuesday allows Bengal govt to restore OBC reservation to 17%, allocating 7% for OBC 'A' and 10% for OBC 'B'. This is set to increase slightly with 50 additional groups being evaluated.
The legal deadlock on the OBC issue had an overriding impact in Bengal, from pausing admissions to schools, colleges and universities to state govt recruitments.
CM Mamata Banerjee, speaking in the assembly on Tuesday, had said that the issuance of OBC certificates for college admissions and govt jobs would resume immediately. "Many recruitment boards kept the process on hold due to the legal confusion. That will now be resolved," Banerjee had said, adding, "Backwardness, not religion, was the sole criterion in the fresh OBC survey."
On Tuesday, Bengal leader of opposition Suvendu Adhikari had alleged that the OBC list was flawed and stemmed from "appeasement politics".
He said that there were only 11 Muslim groups out of 66 OBC groups before 2010. Adhikari went on to claim that OBC in Bengal meant 'one-sided beneficiary'.
Questioning Adhikari's facts, Trinamool Congress had said in a statement on Tuesday: "Suvendu Adhikari, we all know that 'divide and rule' is the official policy of BJP, and your only agenda for the 2026 elections is to pit Hindus against Muslims. But CM Mamata Banerjee has made it crystal clear that backwardness, not religion, is the sole criterion for OBC status. The new list was prepared with that principle in mind.

Day after clashes on Kolkata outskirts: 40 arrested, 7 FIRs registered
At least 40 people have been arrested and seven FIRs have been registered within 24 hours of the clashes that broke out in the Rabindranagar area of Maheshtala in South 24 Parganas district, and soon spread to the adjacent Nadiyal area in Kolkata on Wednesday afternoon. Prohibitory orders under 163 BNSS have been imposed in the Rabindranagar PS area in the interest of peace. Representatives of all political parties or groups are advised not to visit the area till 163 BNSS is in place,' it said. The authorities have also appealed for calm and urged citizens to refrain from spreading misinformation on social media. 'Those attempting to incite unrest will be dealt with strictly, in accordance with the law,' the police said. Earlier in the day, police stopped state BJP president Sukanta Majumdar from going to Maheshtala. Majumdar then went to Kalighat to protest outside Chief Minister Mamata Banerjee's residence along with supporters. He was detained, and later released. Police said they arrested five people while they were carrying materials used in bomb-making and are investigating whether it was linked to the clash. Superintendent of Police (Diamond Harbour) Rahul Goswami said: 'Around 8:45 pm yesterday (Wednesday), acting on intelligence inputs, the police intercepted three bikes and recovered a large cache of explosive materials. These included substantial quantities of sodium powder, over 10 kg of aluminium powder, phosphorus dust, red sulphur, and iron dust — all used in making crude bombs.' 'Five arrests have been made in connection with the seizure', the SP said, adding one of them — Nabin Chandra Roy — has admitted, during the questioning, that he is an active RSS and BJP worker. 'On the day of Ram Navami, he was seen at the Bata More, where a verbal altercation occurred over the rally route and barricades. Cops arrest 41, seize bomb raw materials

HC stays new rule for FYJC quotas in minority colleges
Mumbai: Bombay HC Thursday stayed a clause in the May 6 GR that introduced reservations for SC/ST/OBC/SEBC for FYJC admissions in minority institutions in the state. "Till further orders, we direct that insofar as minority institutions are concerned for admissions to FYJC, the mandate of social reservation shall not be made applicable… Consequent steps may be taken by state govt," said Justices Makarand Karnik & Nitin Borkar. They directed the govt to file its reply in 4 weeks and posted the hearing for Aug 6. On Wednesday, the judges had asked state to consider withdrawing the clause and issue a corrigendum. Clause 11 of the GR mentions that social and parallel reservations will apply to vacancies after filling minority seats in minority institutions. However, as govt pleader Neha Bhide said Thursday there are no instructions to withdraw the clause, the HC heard the matter on merits for grant of interim reliefs. The judges heard two petitions challenging the contentious clause of the GR by which govt brought minority institutions under the purview of social reservations. The first petition was filed by Solapur's Shri APD Jain Pathashala, a trust that runs Walchand College of Arts and Science and Hirachand Nemchand College of Commerce. The second was a joint petition by south Mumbai colleges, including St Xavier's, KC, HR, Jai Hind and Maharashtra College, along with Maharashtra Association of Minority Educational Institutions. Senior advocate Milind Sathe, for the Mumbai colleges, and advocate S C Naidu, for the Solapur colleges, relied on Articles 15 (5) and 30 of the Constitution emphasising on the right of minorities to establish and administer educational institutes. They also brought to HC's notice clause 18.9 of the GR that makes social reservations generally applicable to FYJC admissions in all colleges. They cited decisions — including HC's 2017 verdict in the St Xavier's College case — that minority educational institutions, both aided and unaided, are exempt from backward class reservations. In July 2018, Supreme Court upheld the HC verdict. "We are saying, insofar as minority institutions in all seats, there is no cannot be imposed by govt," argued Sathe. Govt pleader Neha Bhide countered that the May 6 GR does not interfere with the rights of minority institutions; they have the right to fill 50% of their seats. It is only when seats remain unfilled and have been surrendered, that the policy is being made applicable to these seats, she said, adding: "Social reservation is an obligation put on state for filling up seats.
