The transformation imperative in South Africa's financial services sector has reached a critical juncture with the recent amendments to the Employment Equity Act 55 of 1998 (EEA), which came into effect on 15 April 2025.
These legislative changes signal a transition from a discretionary compliance model to a more prescriptive and measurable approach. Employers in the financial services sector are now required to actively drive change through clearly defined numerical targets and strategic employment equity planning.
This is particularly important given the slow pace of transformation across all sectors, including the financial services sector. The sector faces challenges such as the underrepresentation of historically disadvantaged individuals in executive roles, skill shortages, and complex corporate structures. As a result, the financial services sector is under increased pressure to demonstrate concrete transformation outcomes.
Sector-specific targets: What employers in the financial services sector must achieve
The key driver behind these heightened obligations is the introduction of section 15A into the EEA. This provision grants the Minister of Employment and Labour the authority to determine sector-specific numerical targets applicable to designated employers.
The amendments introduce five-year sectoral targets tailored to, amongst other sectors, the financial and insurance sector. Designated employers operating within this sector are required to incorporate these into their Employment Equity Plans (EEPs).
For the financial and insurance sector specifically, the sectoral targets require that 63.1% of top management positions be held by members of designated groups. Of these, 27.8% should be occupied by males from designated groups, and 35.3% by females from those groups. At senior management level, the target increases to 77.0%, with 31.7% allocated to males and 45.3% to females within designated groups. For the professionally qualified and middle management category, the target is set at 86.8%, broken down into 40.7% male and 46.1% female representation among designated groups.
For skilled technical positions, 95.6% of these are expected to be held by designated groups, comprising 49.5% male and 46.1% female representation. In addition to these occupational level targets, there is a universal requirement across all levels that at least 3% of positions be filled by persons with disabilities.
These targets are not merely aspirational, they are enforceable. Employers are expected to report progress annually, and a failure to meet these thresholds may result in scrutiny, penalties, or loss of access to state contracts.
While the legislation allows employers to justify non-compliance with sectoral targets, these justifications will be rigorously assessed. Acceptable grounds may include a lack of suitably qualified candidates from designated groups, limited promotion or recruitment opportunities, the impact of business transfers, mergers, CCMA awards, court orders, or adverse economic conditions.
Importantly, these reasons must be thoroughly documented. The onus is on the employer to prove their validity, and unsupported or vague justifications are unlikely to be accepted. Therefore, employers must maintain detailed records and internal analyses to substantiate any departure from their EEP commitments.
For effective implementation, organisations must strengthen their internal employment equity structures. This includes training line managers and employment equity forum representatives, particularly those involved in recruitment and promotion decisions. These forums must be empowered to act as transformation champions within the business.
Additionally, employers should upgrade administrative processes to support accurate data collection, timely reporting, and robust monitoring. Record-keeping is particularly critical where employers rely on justifications for not meeting targets.

Ramaphosa was speaking during his keynote address at the gala dinner of the Black Business Council's annual summit held at the Radisson Hotel and Convention Centre in Kempton Park, Ekurhuleni. The two-day summit concluded on Friday. National dialogue and socioeconomic challenges Delivering his speech, Ramaphosa reiterated the government's commitment to hosting a national dialogue to develop solutions for the country's pressing issues. 'Some of these challenges manifest themselves in a number of problems that people not only in our country are facing. 'Cost of living crises are widespread and they impact largely disproportionately on poor people and even middle-income households,' he said. 'We have the worst unemployment problem, especially youth unemployment.' He highlighted the mistrust in institutions, attributing it to high levels of corruption and state capture. Economic growth through transformation Ramaphosa emphasised the potential of the government of national unity (GNU) in driving transformation. He said growth of the country's economy will happen through transformation. 'That is the reality. Transformation is vital if growth is to be meaningful and is to be inclusive as well as to be sustainable. 'There are those who say, dump transformation, dump the black economic empowerment. READ MORE: Affirmative-action measures must 'not go too far', argues DA in court 'Dump it because it is inhibiting growth and I argue that it is what happened in the past that we have to transform and to change, and we can only do so through transformation to grow our economy.' He referred to the Constitution as the foundation for transformation policies. 'The heart of our Constitution is around the equality clause, which says that steps and measures and laws must be made to redress the injustices of our past and we will not get away from that,' the president told delegates. 'It is what happened in the past that we must never forget, for it must inform what we need to do now, and it must inspire what we should do in the future. That's what we need to do and it's not limited to a few laws, policies or regulations.' Watch Ramaphosa's speech below: Ramaphosa defends BEE Ramaphosa stated that legislative frameworks like the Broad-Based Black Economic Empowerment (BBBEE) and the Employment Equity Act are crucial tools for driving transformation. Despite progress in narrowing the equality gap, the president pointed out that significant disparities remain – with the average income of white households still nearly five times higher than that of black African households. 'Quite often they are the ones who complain about employment equity, black economic empowerment and you often wonder, what is it? 'Is it greed that is driving them or is it jealousy because it should be prosper thy neighbor that should drive them. They should be applauding. 'Yes, people are also moving up the scale and they are often the very first to complain and even to take government to court.' Transformation Fund Ramaphosa called for the ownership, management, and control of key industries, such as construction, to reflect South Africa's demographics. 'We cannot separate our drive for inclusive growth for the drive for economic empowerment. 'And I stress this because the noises that continue to be made against empowerment and transformation are worrying.' Addressing criticism of the Transformation Fund, Ramaphosa reaffirmed the government's commitment to its implementation. 'We suddenly heard negative voices about the establishment of the Transformation Fund and we have said we are forging ahead with the establishment of this fund and we are going to allocate money.' He emphasised that access to finance remains a key barrier for black-owned businesses: 'We therefore as government must make sure that there is access to funding for black-owned businesses.' And when you ask them in what way it is costing the economy, they are not able to explain. We need to demonstrate that it is an investment in the economy.'

With Sars officially opening the 2025 tax filing season from July 7 to October 20, now is the time to get your affairs in order before the inevitable rush. There's good news for taxpayers—Sars has streamlined the process through auto assessments, meaning that a large group of non-provisional and provisional taxpayers will receive pre-completed tax returns based on third-party data from employers, medical aids, and pension funds. Those affected will be notified between July 7 and 20, and if the information is accurate, there's no further action needed. If corrections are necessary, changes can be submitted via eFiling before the October 20 deadline. For those not automatically assessed, tax returns must be submitted manually from July 21 onwards, which is where preparation is key. Sars advises taxpayers to check their banking details to avoid delays in receiving refunds, which can be paid within 72 hours if everything is in order. Now, let's talk about the common mistakes that cost taxpayers time and money. Procrastination is one of them, and I speak from experience. Six years ago, I ignored the deadline warnings and put off filing my return, convinced I had more time. When I finally sat down to do it, I realised there was missing documentation from my medical aid. Panic set in, and I had to chase paperwork in a mad rush. The result? A delayed refund and unnecessary stress. Lesson learned—file early, avoid the headache. Another mistake people make is not reviewing their auto assessment properly. While Sars does a great job pulling data from various sources, your tax situation may have changed—maybe you've started freelancing, received an unexpected income stream, or incurred deductible expenses. Not checking could mean losing out on a refund or unknowingly under-declaring, which could result in penalties. For those in the self-employed or provisional taxpayer category, the filing period extends until January 19, 2026, but that doesn't mean you should delay submitting your return. Filing early means avoiding system crashes, and last-minute errors, and dealing with customer service queues when everyone else is rushing in October. Sars has enhanced support services, including extended customer service hours, updated online platforms, and comprehensive guidance on eFiling. Taxpayers are strongly encouraged to avoid visiting branches, opting instead for digital channels like Sars MobiApp and eFiling to complete their returns. Rhoderic Nel, Sanlam Risk and Savings chief executive, recently pointed out a sobering truth—life-changing financial events can strike at any age. If you're under 35, filing taxes might not seem like a top priority, but missing deadlines or failing to claim rightful deductions could leave you paying more than necessary. So, here's my challenge to you: don't wait until the deadline looms to file your return. Take the time to review your tax situation now, check your documents, and ensure your banking details are correct. If you're lucky enough to receive a refund, it could hit your account within days—and who wouldn't want that? A little preparation now will save you hours of frustration later. At a recent EE workshop held in Sandton, Department of Employment and Labour deputy director, Masilo Lefika said employers will have this option when developing EE Plans and setting annual numerical targets in their workplaces. He added that when developing EE Plans and setting annual numerical targets in their workplaces in terms of legislation, designated employers must take into account the workforce profile, the relevant five-year sectoral numerical targets, and the applicable EAP. 'The five-year sectoral numerical targets are key milestones towards achieving the equitable representation of the different designated groups within the four upper occupational levels in an employer's workforce in relation to the demographics of the applicable EAP, and for persons with disabilities,' said Lefika. This comes as the Department is forging ahead with legislative amendments to the Employment Equity Act (EEA). These amendments have their origins in 2019, when the Department, in collaboration with the Commission for Employment Equity (CEE), began sector-specific engagements aimed at setting employment equity (EE) targets. The goal was to accelerate transformation in the workplace. These efforts culminated in the Employment Equity Amendment Act No. 4 of 2022, which officially came into effect on January 1, 2025. However the changes have been met with mixed reactions as the DA has taken government to court to challenge the amendments, while others have raised concerns about applying national targets at the expense of regional demographics. According to Lefika, a designated employer will incur "no penalty or any form of disadvantage if there are reasonable grounds to justify its failure to comply with any target". Trade union federation Cosatu welcomed the option for employers to choose which demographics to apply when setting their targets. 'Cosatu engaged with the Department of Employment and Labour extensively on the 2023 amendments to the Employment Equity Act at Nedlac as well as with Parliament. We support these amendments, in particular the provisions recognising regional demographic diversity and enabling employers to utilise them or national demographics depending on their own footprint as an employer. This is critical as the demographics of Limpopo differ widely from those of the Western and Northern Cape and those differ significantly from KwaZulu-Natal. 'Enabling employers to utilise regional demographics is important to ensure local workers enjoy full worker opportunities and also to ensure workplaces represent South Africa's full diversity. This is especially important for provinces like the Western and Northern Cape where coloured workers are the largest demographic group and similarly in provinces like Gauteng and KZN. Employment equity includes all South Africans, of all racial, gender and disability categories,' Cosatu Parliamentary Coordinator, Matthew Parks said. The National Coloured Congress (NCC), which had called to meet with minister Nomakhosazana Meth over the issue, added that without proper consideration of provincial demographics, it risks the further marginalising of Coloured communities. 'The Constitutional Court has ruled you can't implement national demographics, regionally. All the labour department is doing is making it easier for businesses with vested interests to discriminate.
