Can't put judiciary on gunpoint: Top court slams Rajasthan law staff over strike

India Today4 days ago
The Supreme Court on Monday came down heavily on the Rajasthan Judicial Employees Association over their hunger strike and week-long mass leave protesting delays in cadre restructuring and pay revision for subordinate court staff.A bench led by Chief Justice of India BR Gavai expressed serious concern over the disruption caused to judicial functioning in the state, warning that such pressure tactics by court staff cannot be condoned.advertisement'You cannot put the entire judiciary at gunpoint,' the CJI observed sternly, after being informed that over 20,000 judicial staff had taken mass leave for seven days following a hunger strike that began earlier this month.
The court was hearing a plea that raised concerns over the Rajasthan Government's inaction on cadre restructuring and pay revision, despite the High Court approving the proposal in 2022. Petitioners argued that the continued delay had created disparities in pay scales and post categorisation, violating the right to equality and dignity under Articles 14 and 21 of the Constitution.Counsel for the Association informed the court that the agitation had now been withdrawn and all staff had resumed duties. He also objected to the Rajasthan High Court's directive to initiate disciplinary action against those who participated in the strike. The bench, however, was unrelenting in its criticism. 'Seven days of judicial work?' the CJI remarked sharply, pointing out that the High Court was already pursuing the matter with the state government and that such acts of protest had effectively paralysed judicial administration. The petition had submitted that the Association had formally informed the High Court prior to the mass leave, and also appealed for protection of the interests of its members. It was also pointed out that the Bar Council of India had written to the Chief Minister of Rajasthan urging action, highlighting that repeated correspondence on cadre restructuring had gone unanswered, eventually prompting the indefinite hunger strike that began on July 14.Despite these submissions, the court declined to entertain the petition and dismissed it, sending a strong message that disruption of judicial services under the guise of protest will not be tolerated. The protest had impacted subordinate courts across Rajasthan, with advocates and litigants reporting widespread delays and adjournments.- Ends

SC says anticipatory bail cannot be tied to resuming conjugal life, sets aside Jharkhand HC order

NEW DELHI: In a significant ruling, the Supreme Court has set aside an order of the Jharkhand High Court which granted anticipatory bail to a man, allegedly accused of cruelty and attempt to murder of his wife, on the condition that he would resume conjugal life with her and maintain her with dignity and honour. A two-judge bench of the apex court, headed by Justice Dipankar Datta and Justice Augustine George Masih, held that conditioning the grant of pre-arrest bail on the accused resuming conjugal life with his wife is improper and not permissible under the law. The court quashed the order passed by the Jharkhand High Court. 'The spouses seemingly, at one point of time, had drifted apart and resided separately for some time. Imposing a condition that the appellant (accused husband) would maintain the respondent no.2 (wife) with dignity and honour is beset with risk in that it can generate further litigation. In such state of affairs, we are of the considered opinion that the High Court should have considered the prayer of the appellant for pre-arrest bail entirely on its own merit instead of imposing a condition,' the court observed in its order. According to the prosecution, the husband, Anil Kumar, was allegedly an accused in a case registered under Sections 498-A (cruelty), 323 (voluntarily causing hurt), 313 (causing miscarriage without consent), 506 (criminal intimidation), 307 (attempt to murder), 34 (common intention) of the Indian Penal Code, along with Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Former CJI DY Chandrachud vacates official residence, shifts to 14-Tughlaq Road bungalow

After a controversy had erupted over former Chief Justice of India DY Chandrachud's stay at the official residence of CJI in New Delhi beyond permissible time, he has vacated the bungalow. On July 7, Justice Chandrachud had told news agency PTIthat his luggage was packed and he, along with his wife and children, would soon move to a paid government accommodation. "We have actually packed up our luggage. Some of the luggage is already gone to the new house and some are kept here in the storeroom," Justice Chandrachud had said. Justice Chandrachud, his wife Kalpana and daughters Priyanka and Mahi, both of whom are persons with disabilities, were living in the official CJI residence. The former Chief Justice of India had expressed regret over the controversy, citing his daughters' medical condition and the need for a wheelchair-accessible home. He said he was awaiting the completion of the new house before moving in. On July 1, the Supreme Court administration had written to the Union Ministry of Housing and Urban Affairs stating that Justice Chandrachud had stayed in the CJI official residence beyond the permissible period and sought the property to be vacated. The letter requested the MoHUA secretary to take possession of the bungalow from the former CJI without any further delay as the permission granted to him for retention of the accommodation expired on May 31, while the prescribed six-month period of further stay under the 2022 Rules ended on May 10. Earlier, Justice Chandrachud had said that he spoke to his successor CJI Sanjiv Khanna and told him he would return to 14, Tughlaq Road bungalow, where he lived before becoming the CJI. However, Justice Khanna had asked Justice Chandrachud to continue staying in the CJI bungalow as he did not want to shift to the official residence. Under Rule 3B of the Supreme Court Judges (Amendment) Rules, 2022, a retired Chief Justice of India can retain type VII bungalow, a level below the 5, Krishna Menon Marg bungalow, for a maximum period of six months after retirement.

Chief Justice of India Gavai visits chess champion Divya Deshmukh at her home, hails her; recalls old family ties

Chief Justice of India Bhushan Gavai on Saturday (August 2, 2025) visited newly-crowned FIDE Chess World Cup champion and Grandmaster Divya Deshmukh at her residence in Nagpur to congratulate her on her remarkable achievement. Deshmukh (19) became the youngest to win the Women's World Cup title held at Batumi in Georgia on July 28 after she outwitted compatriot Koneru Humpy in the tie-breaker of the final. The victory not just earned her the prestigious title, but also made her a Grandmaster. Incidentally, the CJI is from Amravati and Deshmukh's grandfather late Dr K.G. Deshmukh was once Vice-Chancellor of Sant Gadge Baba Amravati University. Speaking to reporters, the CJI said his father and late K.G. Deshmukh were very close friends. "We have grown up like one family. It was nostalgic for me to visit here. I went back 50-55 years and recollected all those old memories. It was a great reunion for me, specially as I have come to give my best wishes to Divya, who has made us all very proud," the CJI said. Earlier, in the day, the chess sensation was felicitated by Chief Minister Devendra Fadnavis at an event in Nagpur.
