
Spokane County facing unfair labor practice complaints following decision to expand agreement with company providing care to detainees
Feb. 11—Spokane County has been accused of unfair labor practices after renewing and expanding a medical services contract with a private company to treat county jail inmates.
In late January, the Spokane County Commissioners voted 3-2 to award a three-year, multimillion-dollar contract to Everhealth, a subsidiary of NaphCare, which has provided medical, dental and pharmaceutical care in the Spokane County Jail since 2017.
The vote split along party lines, with Commissioners Chris Jordan and Amber Waldref, both Democrats, voting against awarding the contract to NaphCare.
"I'm very concerned, because we've been told by our budget office here at the county that we're expecting budget deficits in the next several years, multimillion-dollar deficits that we're going to have to manage to provide the services that everyone in the county is looking for us to provide," Waldref said. "This contract is costly; I'm not sure how we're going to pay for it."
The new contract expands NaphCare's responsibilities to include behavioral health services, which county employees provided in the past.
Greg Beeman, a representative of the largest union for county employees, said that addition has left 10 employees out of a job. The county's mental health team will be disbanded on April 30 to make room for NaphCare's behavioral health specialists starting April 1.
Beeman said the union has filed two unfair labor practice complaints with the state, as well as two grievances with the county, all related to the county's failure to negotiate with the union prior to awarding the medical services contract.
"They first started having conversations about this way back in March of last year," Beeman said. "So we're almost a year down the road, and they really only started talking to us beginning in early November. I think they were seriously behind the times on all this."
The county failed to do its due diligence in working with the union prior to the contract being awarded, as well as in negotiating measures to mitigate the impacts on those being let go, Beeman said.
Last March, with NaphCare's prior contract set to expire soon, Spokane County issued a request for proposals for medical, dental and pharmaceutical services. Not a single provider responded, Spokane County CEO Scott Simmons said.
Everhealth and parent company NaphCare declined to make anyone available for an interview, instead providing a written statement. Company officials declined to say whether they planned to interview any of the outgoing behavioral health team members for jobs.
Simmons said that after the first request for bids drew no interest, the county consulted with the National Commission on Correctional Health Care. The nonprofit organization advised that the best practices would include all services integrated under one operator.
"You have to have really, really tight handoffs on patient care and what the inmates are experiencing, and being able to have integrated solutions so that you don't have any misses in information handoffs between shifts, between personnel," Simmons said. "The flow of data, similar systems, are all beneficial to have under an umbrella approach."
The county reissued its request, this time with behavioral health included. NaphCare was the only company to respond out of 19 providers that showed some interest, according to county records.
On Jan. 21, Mike Sparber, senior director of law and justice for Spokane County, came to the county commissioners with a choice: In a week's time, they could award the contract to NaphCare or revert services back in-house, as they were prior to the initial agreement with NaphCare in 2017.
Sparber told the board the latter was a verbal proposal from the union. Simmons added in an interview that the county offered the union the opportunity to respond to the request for proposals and that the response was "very limited."
Beeman contends that the proposal to revert to the pre-2016 model was only a "suggestion" of the options available to the commissioners. Union members have not provided medical services for roughly eight years, and have no control over the work conducted in the Spokane County Jail and Geiger Correctional Facility.
"This is kind of a strawman argument that they've created: 'Well, this is the union's solution or how the union is going to get it done,' " Beeman said. "That was merely us saying you do have a different option."
NaphCare will be paid $15.9 million for the first year, $16.8 million for the second and $17.3 million for the third. That agreed-upon rate is in addition to a $700,000 contract extension to cover January while a larger contract was fleshed out, as well as $250,000 for an upgraded health records system.
The county will pay the company an additional $850,000 over the next three years for the implementation of an agreement between the state and the federal government to offer Medicaid coverage to youth and adult detainees up to 90 days before they are released.
The rate for the first year of services, with the January extension, transition costs and off-site medical claims included, is a nearly 62% increase from what the county paid last year for its in-house behavioral team and NaphCare's medical services combined.
Part of that rise in costs may be attributed to the current legal landscape for providers who serve incarcerated populations. Like many companies that provide medical services to prisons and jails, NaphCare has faced dozens of lawsuits over the years.
In 2022, a federal jury awarded $27 million in damages to the family of a woman who died in the Spokane County Jail. Simmons said the county contacted similar municipalities to compare rates, and that the county's increase is less than that of others in the state.
"I can't say for certain that our contract increase as a result of a past settlement, but from any common sense and logical way to look at this thing, when businesses are faced with challenging litigation environments, and they do have unfavorable claims against them, it goes back into the cost of delivering services," Simmons said.
Simmons said the rise is also due in part to the addition of more staff and services.
Waldref and Jordan voiced concerns about the large cost increase, and how the county will manage it amid financial challenges facing the county.
"I also share the concern about any potential impact for county employees in our jail's mental health services department going forward," Jordan said. "As the board knows, we have a really exceptional, dedicated, talented team of staff in that unit, and they've built relationships and partnerships throughout the criminal justice system over the years, including in juvenile detention, therapeutic courts and many other places."
If the county commissioners had decided to bring services back in-house, it would have its own associated costs, Simmons said.
It would cost $9.4 million per year to staff to the levels prior to the new contract, according to county calculations. Also included in the county's cost analysis is an estimated $500,000 to $750,000 in additional liability coverage, which would need an extra allocation of $10 million to create a liability fund. That's on top of an estimated $350,000 to $500,000 for additional policy coverage, and upward of $1.2 million for IT costs.
Concerns about being able to fill all 52 positions, or 60 under the new contract, were also part of the equation for the commissioners, just as it was when NaphCare first arrived in Spokane.
The jail couldn't find enough nurses in 2016, so the county signed a six-month, $2.6 million contract with NaphCare.
The county's existing nurses initially worked alongside NaphCare staff. That didn't last long. Nearly all of the original nurses left within months, citing concerns about the level of care and cost-cutting measures NaphCare had taken. The company eventually hired a few of those nurses.
Simmons said it would take a multiyear effort to get services to the level provided by NaphCare.
"Then you have to measure the successes, going back to retention, recruitment and doing things outside of our core competency," Simmons said. "And we're competing for the same group of people that those in the profession, that really focus on health care, do on a daily basis."
Beeman said the union's focus is on the mental health team, which is why they suggested keeping those individuals on by bringing all services in house. NaphCare is a for-profit company, so he understands their desire to expand services, and how the county was stuck between a rock and a hard place.
Spokane County's difficult situation does not preclude it from taking the legally required steps of negotiating with the union about the request for proposals, and then the impacts for the union members on the behavioral health team.
"NaphCare is playing hardball with them, no question, but there may be other solutions for this," Beeman said. "At the very least, we wish that they had started talking to us early on about this, so that for one thing, we might have been able to do more to cushion the blow for the affected employees, and figure out some things in a more timely manner."
The county is working through the grievance process and impact negotiations with the union, which may go to arbitration in the coming weeks, Beeman said. The state's Public Employment Relations Committee will run down the unfair labor practice complaints, and could have the power to send the county back to square one in securing a contractor, he added.
Simmons said there is not much he can disclose as the process is ongoing, but that the county is committed to seeing it through.
"At the end of the day, we care about our employees, and we want to make sure their well-being and impacts are at the forefront," Simmons said.

What's in RI's proposed $14.3B budget? Help for primary care, RIPTA funds and 'Taylor Swift tax'
PROVIDENCE – Rhode Island House Democrats have unveiled a new $14.3 billion state budget that seeks to bolster the finances of primary care doctors, hospitals and nursing homes without raising income taxes on the wealthy. The proposed tax and spending plan for the year starting July 1 would raise Medicaid reimbursement rates to inject, including federal dollars, $45 million into primary care, $38 million into hospitals and $12 million into nursing homes. Funding for primary care practices would come in part from a new health insurance fee estimated to generate $30 million per year. Although it spares the well-heeled an income tax hike, the House budget resurrects a tax proposed a decade ago on second homes worth more than $1 million, branded the "Taylor Swift tax" after the Watch Hill vacation home of the famous pop star. Proceeds would go to fund the state's low-income housing tax credit. The budget would inject $15 million into the Rhode Island Public Transit Authority, the same amount of money lawmakers added to the statewide bus system a year ago but less than half of the $33 million the agency says it needs to plug a budget hole and avoid service cuts. The extra RIPTA funding will come from a 3-cent-per-gallon hike in the gas tax slated to go into effect July 1 and tweaks to the formula that distributes transportation funds. A 1-cent-per-gallon increase in the gas tax is already set to go into effect in July. The budget, a rewrite of the $14.2 billion tax and spending plan Gov. Dan McKee proposed in January, was quickly passed on an 11-3 vote by the House Finance Committee on June 10, setting it up for a vote before the full House on June 17. "All our colleagues have heard, the Senate has heard and we decided that we needed to take action now," House Speaker K. Joseph Shekarchi told reporters about the money for primary care. "We've heard that our reimbursement rates are low, and that's the primary cause of the health care shortage. We wanted to address that immediately." Senate President Valarie Lawson in an email applauded budget investments in healthcare, RIPTA and child care, suggesting it won't have much trouble passing that chamber. As expected, the House abandoned several of McKee's proposals, including a 50-cent hike in the cigarette tax, buying an office building from Citizens Bank in East Providence and a tax on digital advertising that the governor hoped would pull in $9.5 million next year and $23.5 million annually by 2030. But the House budget agreed with the governor on other proposals, including a new fee on electric vehicles and charging the state's 5% hotel tax to short-term rentals of whole homes on sites such as Airbnb. Other budget highlights include: Truck tolls. The House accepted McKee's plan to turn on the legal-again tolls on tractor trailers in the first half of 2026 and collect an estimated $10 million in state revenue. Washington Bridge: $22 million in state dollars to match federal funds to build a new westbound Washington Bridge. Education: The House proposal would spend $16.5 million more on education than McKee proposed and $59 million more than the current-year budget. Conveyance tax: A 63% increase in the real estate conveyance tax on all home purchases, which doubles for the portion of a sale over $800,000 is proposed with proceeds going to services for homeless Rhode Islanders. The tax increase is projected to raise $8.4 million next year. Airbnb: Extends the 5% state hotel tax to whole-house rentals, something lawmakers rejected last year but McKee's budget expects will generate $4.7 million per year, with a part of the collections also going to homeless services. DMV: A $1 hike in the Division of Motor Vehicles "technology fee" to $3.50 per transaction. Superman Building: The House budget included a provision, already passed as a standalone bill in the Senate, that would exempt the owner of the vacant Industrial Trust Tower in Providence from sales tax on construction materials while claiming a maximum in other state incentives. Parking: The state's 7% sales tax would be charged to parking, generating $3.2 million per year. Nicotine pouches: The tax applied to the wholesale cost of tobacco products would be expanded to synthetic nicotine pouches such as Zyn, generating $12 million per year. Vacation home tax: The "Taylor Swift Tax" would not go into effect until the fiscal year that starts July 1, 2026 and no estimate was provided of how much it would eventually raise. Longtime advocates of increasing taxes on Rhode Island's highest-earning residents hoped the budget pressure facing the state this year would convince top lawmakers that the time was now right to do it. They proposed a 3% surcharge on income above $625,000, which was estimated to generate $190 million in annual revenue. And as lawmakers waited for the final details of the budget to be hammered out on June 10, the Working Families Party camped outside the State House with a box truck showing illuminated messages of support for a tax hike, such as, "Save Rhode Island. Tax the Rich." But Shekarchi told reporters that lawmakers decided against a tax hike, at least until the state knows whether Congress is going to pass a tax cut bill that could slash Medicaid funding and shift more costs to states. "We don't know what's going to happen in Washington," Shekarchi said. "We don't know what changes are going to be made in the federal tax code. We felt comfortable enough to do the non-owner-occupied taxes over a million dollars at this time, and we will revisit that issue when we have more clarity from Washington." But Working Families Political Director Zack Mezera said what's happening in Washington is even more reason to make the "1% pay their fair share," not an excuse. 'Today's budget shows that state leadership would rather raise gas taxes for working families than increase taxes on millionaires," Mezera wrote in a news release. "As President Trump and his allies advance destructive cuts that could cause over 240,000 Rhode Islanders to lose Medicaid and hundreds of educators and care workers to lose their jobs, we need bold action to raise revenue now – otherwise working people and small businesses will be paying the price for years." With $15 million from the budget to fill a $33 million projected shortfall, it looks as though RIPTA is going to need to scale back what it does, but Shekarchi said it would not necessarily mean large layoffs or route cuts. "I think they need to look at everything," he said. "Maybe it's smaller buses, maybe it's addressing the ride schedule, maybe it's a slight fare increase, maybe it's looking at management positions. That's why we mandated, when we gave them $15 million last year, they do an efficiency study and find out the solutions." Despite the prospect of having to make painful cuts this summer, RIPTA CEO Christopher Durand said the bus system is "grateful" for the additional permanent state revenue. "The agency has long needed a consistent funding stream to allow us to better support getting Rhode Islanders to work, school and healthcare," he said in an email. "The last time the agency saw a permanent change in its funding structure was over ten years ago; this is a needed improvement, which we are thankful for." Van Hollen, other Dems push legislation to boost Medicaid and counter Trump cuts

Sears/Maryland Matters) Senate Democrats unveiled a package of bills Thursday aimed at expanding access to health care coverage, including one bill modeled after a successful Maryland law that lets taxpayers use their tax returns to enroll in care. Sen. Chris Van Hollen's (D-Md.) 'Easy Enrollment in Health Care Act' is one of about a dozen bills — including one from Sen. Angela Alsobrooks (D-Md.) requiring Medicaid and Medicare to provide dental, vision and hearing coverage — put forward by Democratic senators as a response to the Trump administration's efforts to cut federal health care spending. 'We're all here for those two reasons,' Van Hollen said Thursday at a Capitol Hill news conference to unveil the bills. 'One is to shine a light on the great damage and harm the Trump Republican plan will do. But also to put forward some ideas about what we could be doing to actually make health care better for more Americans.' Van Hollen joined Sen. Ron Wyden (D-Ore.), the ranking member of the Senate Finance Committee, and Democratic Sens. Catherine Cortez Masto of Nevada and Ben Ray Lujan of New Mexico to unveil the bills. The Democratic legislation comes at a time when the Senate is deliberating the Republican-backed 'One Big Beautiful Bill.' The budget reconciliation bill would implement a number of Trump agenda items, including drastic cuts to Medicaid and other supports that backers say are needed to rein in what they call 'waste, fraud and abuse' in those programs. With a Republican majority in both the Senate and the House, Wyden acknowledged that the Democratic bills have little chance of passage. But. he said, Democrats still hope Republicans will work with them on the legislation and 'do the right thing.' Report: Up to 100,000 Marylanders could lose coverage if Medicaid imposes work requirements Democrats and health care advocates say the budget reconciliation bill would create more administrative hurdles for Medicaid recipients and will result in millions of people losing coverage, even if they would be eligible for the joint state-federal health care program. 'It's 'beautiful' if you're a billionaire or a very wealthy person. For everybody else, it's an ugly mess,' Van Hollen said of the GOP bill. 'It comes at the expense of everybody else in America. And that's especially true when it comes to attacking health care … In fact, it will kick 16 million Americans off their health insurance plans.' He said his bill, modeled after Maryland's 'Easy Enrollment' program, would do the opposite. In Maryland, Easy Enrollment lets people check a box on their state tax forms to allow the state to use information on the return to see if their household qualifies for Medicaid. Those who qualify then get further information on what options they qualify for, reducing administrative hurdles to Medicaid and other programs in Maryland. 'What we should do is make it easier for eligible individuals to get the Medicaid that they are eligible for,' Van Hollen said. This is the second time he has introduced the bill in Congress. A version introduced in the last Congress never even got a committee hearing. The other Democrats at the press conference offered their own bills to strengthen Medicaid. Cortez Masto's bill would increase funding for health care fraud investigation units to help catch more waste, fraud, and abuse in the system. She says that is more productive than just cutting funds to Medicaid. Luján is sponsoring a bill to temporarily expand federal funding to Medicaid programs for home- and community-based services that help support people with intellectual and developmental disabilities. Wyden also highlighted his own legislation to address hospital labor and delivery unit closures by supporting rural hospitals with additional Medicaid dollars. 'Fact of the matter is that Democrats want to make it easier for Americans to get health care, rather than put people who desperately need health care through bureaucratic water torture if they're going to get the health care they need,' Wyden said.
