Suspect in double shooting headed to trial
GOSHEN — A man who faces murder and attempted murder charges in a Halloween party shooting is headed to trial Monday.
Joshua Peter Martinez, 24, is accused of murder and attempted murder in a Nov. 3 shooting outside a north Elkhart auto shop. He allegedly opened fire while attending a party, killing one man and leaving another with multiple gunshot wounds.
Martinez was arrested on Nov. 7 after police interviewed witnesses, viewed videos of the shooting and collected evidence from the scene that included a side mirror cap belonging to a Honda. Martinez allegedly had a black Honda Civic at his residence that was missing a side mirror cap and that had blood on multiple spots on the front.
Attorneys expect a lengthy trial with multiple people lined up to take the stand, Elkhart County Circuit Court Judge Michael Christofeno learned Thursday.
'There are a lot of witnesses in this case, so it's possible we'll need a sixth day of trial,' Elkhart County Prosecutor Vicki Becker said. 'We're all on board for some long days in trial.'
Martinez's lawyer, Donald Schmid, said there's also a lot of footage of the crime for jurors to view.
'I've looked at scores of videos, and I'm still seeing things for the first time,' he said.
Christofeno, who normally has a spate of hearings on Wednesday and Thursday, told the attorneys that he may be able to push some of those off to leave more time for the trial. He expressed a hope that the trial doesn't extend past Friday.
'I want to get this case done,' he said. 'I can't imagine we'll have to go on Saturday. Number one, because the jury will end up hating both of you.'
Elkhart police responded to the shooting at 754 C.R. 3 at around 4:40 a.m. They found one victim, Romulo Jesus Reyes Osuna, in the parking lot suffering from multiple gunshot wounds.
Reyes Osuna died despite officers' attempts at life-saving measures. An autopsy the next day preliminarily ruled the death to be a homicide.
Carlos Martinez was also found in the parking lot suffering from several gunshot wounds and was transported to Elkhart General Hospital in critical condition. It was later learned that he had also been struck by the shooting suspect's vehicle as it fled.
Carlos Martinez told investigators that he heard someone at the party say he was going to get a gun and shoot everyone while running to a Honda Civic parked nearby. Carlos Martinez said Reyes Osuna was running after the man and asked him to come help.
Carlos Martinez said he could hear Reyes Osuna telling the suspect to calm down as he reached the car. He said the suspect had a gun in his hand and Reyes Osuna tried to push the car door closed to keep him inside, according to police.
Carlos Martinez said he remembered being shot and then run over by the car.
Police say security cameras captured the moment the two victims were shot. They could be seen following a man, who was later identified as Joshua P. Martinez based on height and appearance, as he ran to the Civic before multiple muzzle flashes are seen.
Carlos Martinez fell to the ground after the first shot and Reyes Osuna was shot while trying to run away, according to police. The shooter could be seen getting in the car and driving away, running over Carlos Martinez several times in the process.

Arrests made after 2024 fatal shooting in Fort Pierce
FORT PIERCE – Police on June 5 announced two arrests in a 2024 shooting case that left an 18-year-old man dead, records state. Slain in the March 16, 2024, incident just east of North 23rd Street and Avenue C was Jackson Romanello, Fort Pierce Police stated. Over the past year, investigators determined David Harris III, 19, of Fort Pierce, shot Romanello during a drug transaction initiated by Romanello and Jerimah Nelson, 21, who was arrested June 3 in Flagler County on a variety of mainly drug charges. Police found Romanello in the driver's seat of a Honda Pilot with an apparent gunshot wound to the head. The Honda was just south of an apartment building where investigators said Harris lives. Police Maj. Eric Chan on June 5 said two individuals contacted police shortly after the shooting and said they were in the vehicle with Romanello at the time. 'Detectives interviewed them and from them they developed leads which they had to follow through on, which led to the identification of these two individuals (Nelson and Harris).' According to records, investigators determined Romanello and Nelson exchanged text messages for several weeks before the shooting regarding Nelson buying marijuana and Adderall pills from Romanello, who was living in Fort Myers. Chan said the two people in the Honda with Romanello didn't know Harris and Nelson. 'They painted a picture of what was going on so that we could follow up,' he said. Chan said the investigation took more than a year. 'We wanted to make sure that we corroborated any statements and/or other leads that we got,' Chan said. 'We did search warrants and subpoenas to gather information that required analyzing.' He said Nelson moved to Palm Coast. Chan said it was 'a robbery gone bad by David Harris.' According to statements in records, Harris put a gun to the left side of Romanello's head and told him not to move or he would be shot. Romanello put the Honda in gear and Harris fired a single shot. Police found a 9mm cartridge casing at the scene. Where was the father?: Preliminary autopsy of boy who officials said died by mom's hand doesn't contradict mom's account 'Vigorous neighborhood canvass': Police said man entered home, photographed woman after she exited shower Chan said after police identified Harris as a possible shooter, he was arrested in June 2024 on unrelated charges, including possession of a firearm by a felon. He's been in the St. Lucie County Jail since then, Chan said. 'We got him off the streets as fast as we could identify him,' Chan said. Chan said Harris was arrested on a murder charge June 4 regarding the Romanello death. Will Greenlee is a breaking news reporter for TCPalm. Three people killed in crash on interstate in South Carolina, cops say
Three people were killed early Sunday morning in a crash on Interstate 85, according to the South Carolina Highway Patrol. The three-vehicle collision happened at about 12:15 a.m. in Spartanburg County, said Master Trooper William Bennett. A 2015 Honda sedan was driving south in the northbound lanes of I-85, according to Bennett. At the 75 mile marker the Honda collided head-on with a 2019 Toyota sedan that was driving north on I-85, Bennett said. After that collision, the Honda then crashed into a 2024 Ford Expedition that was also heading north on the interstate, according to Bennett. The driver, who was the only person in the Honda, as well as both the driver and a passenger in the Toyota died at the scene, Bennett said. The Spartanburg County Coroner's Office has not publicly identified any of the victims. In addition to the Ford driver, there were five passengers in the SUV, but none of those occupants were hurt, according to Bennett. No other injuries were reported. There was no word if anyone involved in the crash was wearing a seat belt. Information about how the Honda came to be driving toward oncoming traffic on I-85 was not available, but the wreck continues to be investigated by the Highway Patrol. Through June 1, at least 316 people had died on South Carolina roads in 2025, according to the state Department of Public Safety. Last year, at least 948 people died in crashes in South Carolina, DPS reported. At least 38 people have died in Spartanburg County crashes in 2025, according to DPS data. There were 60 deaths in the county in 2024, DPS reported. That includes a fatal crash on Saturday afternoon. At about 1:50 p.m., both a 2007 Dodge Ram and a 2008 Yamaha motorcycle were driving north on S.C. 11, Bennett said. When the pickup truck turned left onto Cannon Ford Road it was hit on the driver's side by the motorcycle, according to Bennett. The motorcycle driver, who died at the scene, has not been publicly identified by the coroner's office. Bennett said the pickup driver, who was the only person in the truck, was not hurt, and no other injuries were reported. This crash also continues to be investigated by the Highway Patrol.

Man shot to death in Bronx park boasted he ‘beat the odds' after Rikers release
A 21-year-old man shot to death in a Bronx park less than three months after being released from Rikers Island recently bragged on Instagram he 'made it out' and 'beat the odds.' Irvin Provitt was about to start classes in a court-ordered education program through the Fortune Society, hoping to resolve a pair of ongoing robbery cases after spending more than a year in jail, his lawyer Paul London told the Daily News. 'The only thing he wanted was to get get out of jail because he feared Rikers,' London said. 'He was a kid. He was 21 … He still needed to grow up.' But all Provitt's future dreams were dashed when he was shot in the head in Crotona Park near E. 173rd St. about 12:45 p.m. May 30. 'He was a young kid who was trying to turn his life around. He was about to be enrolled in a program,' London said. 'To hear that happened was devastating. To lose a young person like that is not a way to lose a young person.' On April 14, Provitt posted photos of himself with a stack of cash on Instagram with the caption, 'I MADE IT OUT. I BEAT THE ODDS.' But Provitt was still reeling from the death of his mother a few years back when he was killed, London said. He was proficient with sign language, the lawyer said, interpreting for his father and his brother, who are both deaf. He was due back in Bronx Criminal Court on June 18 as he continued to fight the two robbery cases he was arrested for at age 19. On Oct. 27, 2022, he and an accomplice allegedly jumped two victims on a Bronx street, with Provitt punching one in the head while his accomplice took the other victim's cell phone, according to the criminal complaint. A second accomplice was present while a third waited behind the wheel of their getaway silver Honda, according to court papers. On Feb. 14, 2023, Provitt piled into a cabbie's SUV with four pals and argued with the driver about the fare after trying to pay with counterfeit money, prosecutors say. Provitt then pulled a gun on the driver while his pals stole $750 from the cabbie's pockets, the criminal complaint charges. 'The robbery case is not as crystal (clear) as the D.A. wants to make it,' London said, adding that his client got hit with the charges merely because he was present for the crimes. Provitt was locked up on $100,000 bail in July 2023 after a bench warrant was ordered in the cases. He was released from Rikers Island on March 7 after posting bond. A series of photos and videos on Instagram after his release captioned 'Fresh start' show Provitt with U.S. Treasury checks made out to other people and bank ATM receipts showing several thousand dollars in his account. Provitt was wearing a surgical mask hanging out with a group of about 20 people inside a playground in the park when he was shot, witnesses said. He died at the scene. Comments left on his Instagram posts after his slaying range from heartfelt condolences to messages and GIFs celebrating his murder, including one saying he 'went poof.' 'I'm sure it does have to do with it,' London said when asked if he thought the negative messages were linked to his unsolved murder. 'The crime in the city has changed dramatically with young kids, where it has become extremely personal with mocking each other.' Provitt's friends were devastated by his slaying. 'He was living his life. He was happy,' said a 20-year-old friend who declined to give her name. 'He was a good kid. Stayed out the way. He was trying to change his life.' That sentiment was echoed by two other pals. 'I grew up with him. That's f—ed up,' one of them said. 'He just came home.' One neighborhood resident, Jennifer Ramos, 34, said the playground where the shooting happened is a trouble spot. 'It's always hot,' she said. 'There's always a lot of gang activity. Especially in the summer time.'
