Senthilbalaji said the observations made in the Sept 8, 2022 verdict could influence the trial court in the case and affect his right to fair trial.
The top court observed in its 2022 verdict, "We are constrained to say that even a novice in criminal law would not have left the offences under the PC Act, out of the final report. The attempt of the IO (investigating officer) appears to be of one 'willing to strike but afraid to wound'."
It said the state ought to have undertaken a comprehensive investigation into the entire scam, without allowing the accused to fish out one case as if it was a private money dispute.
Senthilbalaji contended the trial court was likely to be prejudiced since the top court made the observations against him and it would be a violation of his right to free and fair trial under Article 21 of the Constitution.
On April 27, Senthilbalaji resigned from the M K Stalin-led state cabinet after being pulled up by the top court.
The apex court on April 23 asked Senthilbalaji to make a choice "between post and freedom" as it warned him of cancelling bail if he did not step down as minister in Tamil Nadu. PTI

In the first phase, between July 15 and August 15, in all the districts, 3,563 camps would be held. Volunteers are creating awareness among the public in all the districts on the scope of the outreach programme, and the eligibility and documents required to avail specific services offered by the state. Eligible women may apply for the "Kalaignar Magalir Urimai Thogai Thittam" that offers ₹1,000 monthly assistance. In urban areas, as many as 43 types of government services under 13 departments and in rural areas, 46 services under 15 departments would be extended to the people. Issues raised would be resolved immediately wherever possible and in other cases it would be done within a maximum of 45 days. In a social media post, Stalin said: "In order to fulfill the basic requirements of the people, I am sending the government administration to their areas!" Further, the chief minister said that for as many as 46 government services, including those related to family card , Kalaignar Urimai Thogai and patta change, the issues would be resolved within 45 days. But the Yemeni national died due to overdose of drugs, following which Priya, along with her colleague, dismembered his body and disposed of it in a tank. Right to pardon under Islamic law Speaking about the case on Tuesday, Kanthapuram said that he made the family understand the issues. 'Islam has another law. If the murderer is sentenced to death, the family of the victim has the right to pardon. I don't know who this family is, but from a long distance, I contacted the responsible scholars in Yemen,' the scholar said, according to ANI. He said that after his request to the scholars, they said 'they would do what they could'. 'They have officially informed us and sent a document stating that the date of execution has been postponed, which will help facilitate the ongoing discussions,' Kanthapuram said. The Indian government had earlier said they 'cannot do much' about the execution. 'There is a point till which the Government of India can go. We have reached that," Attorney General R Venkataramani told the Supreme Court on Monday. He further said the government had reached out to 'an influential sheikh" to speak to authorities in Yemen, but was not sure of that approach would work either.
