NACC issues warning against nepotism hire after corruption finding over $101k job

A former Home Affairs official has been found to have acted in a seriously corrupt manner after she helped her sister's fiance secure a $101,000 job.
The investigation report, which was released by the National Anti-Corruption Commission (NACC) on Monday, revealed a tranche of WhatsApp messages and texts shared by the high-level beurocrat, who was given the pseudonym Joanne Simeson, and her sister, Melissa.
The events, which occurred from 2022 to 2024, were in relation to an international engagement officer position, which Melissa's fiance Mark Elbert was hired with a salary of $101,264.
In one message dating back to December 2022, after Mr Elbert secured an interview, Joanne said she would 'talk [Mark] through the lie (that they did not have a close personal relationship),' to which Melissa wrote back: 'he's so bad at lying he's too honest'.
Investigations also revealed Joanne forged a witness signature on an onboarding form, and used her seniority and 'promoted his candidacy and qualities to other staff, created the recruitment requisition, nominated herself as the delegate approver, and took steps to have the onboarding'.
While Joanne claimed she initially hid her relationship with Mr Elbert because she 'did not want the relationship to be known at work', the NACC said she purposely 'used her position to procure the transfer of her sister's fiance into the Department for the purpose of benefiting her sister's fiance and her sister, knowing it to be improper'.
In another instance, Joanne also misused official information by providing interview questions to her sister, who was applying for a job at another branch at the Department of Home Affairs.
The NACC found Joanne's actions were an 'abuse of her office as a public official,' while repeatedly lying about her relationship with Mr Elberty and her sister, plus the 'benefit conferred on' Mr Elbert mounted to serious corruption.
While Joanne was stood down during the investigation in February 2024, and resigned from the department in June 2024, the NACC said it would have recommended her employment be terminated if she still worked at the department.
The investigation also prompted the NACC to warn that 'nepotism, cronyism and undeclared conflicts of interest in recruitment and promotion is an area of widespread concern,' stating that it 'undermines the merit selection process and erodes morale'.
It also noted that nepotism and cronyism (giving favouritism to friends and business associates) was 'systemic' and was one of the 'most commonly observed types of corrupt conduct,' according to the NACC's 2024 Commonwealth Integrity Survey.
Concluding the report, the commission made three recommendations to restrict access to interview questions to only those with a 'legitimate need to know,' and to call on people involved in recruitment to declare any relationship or association with an applicant and target training to people in senior leadership roles.
It also made specific recommendations to review and change hiring processes related to the Home Affairs Department, especially in relation to department transfers which a facilitated by the head of an agency.

A government worker barred from leaving the country after she allegedly fleeced $49,000 of public money to fund a string of personal overseas trips will be handed back her passport and allowed to travel to China. Quan Liu, 49, allegedly used public funds to purchase flights and accommodation for four overseas trips over a period of 14 months. The Australian Federal Police has also accused Ms Liu of using a falsified visa letter to support claims she was travelling for work, and that she arranged a false document for a foreign national to get a visa to enter Australia. She was charged with official abuse public office to gain advantage, dishonestly intend to obtain a gain, and deliver document containing false statement after the AFP searched her home back in December last year. Ms Liu has not yet entered any pleas. She was required to surrender her passport to the AFP before she was released on conditional bail and is prohibited from applying for a new passport or other travel document. Ms Liu also cannot leave the country or enter any international point of departure. However, she's been handed an exception between August 20 and September 14 of this year that will allow her to collect her passport and hold onto it for more than a month to travel to China. The AFP is set to hand her passport back on August 12, according to varied bail conditions from late June seen by NewsWire. Ms Liu is required to return her passport by September 15 upon her return from China. Should she fail to comply with the bail acnkowledgement, which also requires her to report to her local police station daily with the exception of Sunday, she will need to forfeit $1m. She is expected to front court on July 9.

A mother says she has been living in 'hell' since the unexplained death of her baby daughter in 2019, and will no longer be silent while waiting for answers. Six years later, Kayla Hehir has still not even received a death certificate for eight-month-old Talon. There has been no coronial inquest held or any outcome to an ongoing homicide investigation. After staying patient so long, Ms Hehir has decided to finally speak out to say she feels that 'no one cares' how the little girl came to be found unresponsive in their Melbourne home. 'I felt like I had to be quiet so justice can take its course,' she told 'But justice isn't taking its course at all. 'It's (the case) sitting there and it's just ridiculous.' Do you know more? Email: Ms Hehir said she had breastfed Talon overnight on June 20, 2019. When she woke in the morning at their Frankston home, Ms Hehir knew something was wrong. She came into the loungeroom and saw Talon on the lounge: 'She just didn't look right. 'I don't even know how to explain it. She just did not look right. 'And I picked her up and she wasn't right. It was like kind of limp, but stiff. 'And I started panicking. I started screaming.' The girl was rushed to Monash Children's Hospital where doctors were unable to save Talon's life. Ms Hehir described the shock of how that day unfolded and the devastating news doctors relayed to her: 'It happened so quick and so slow at the same time. 'And even when we were taking her off life support, for some stupid reason, I still thought she was going to be okay.' Victoria Police have confirmed homicide detectives were still investigating the circumstances around Talon's death, which recently past its sixth anniversary. Ms Hehir said she was in contact with police but there had largely been 'silence' from the authorities, robbing her and Talon's siblings of closure or justice. 'People don't realise that, they will say, 'oh, it was six years ago'. But it's every day,' Ms Hehir said. 'I see those moments all the time, like they just happened. 'We can't just keep sitting here like this, it's been a literal hell.' She has now reached out to Sherele Moody, who runs the Australian Femicide Watch and the Red Heart Campaign, to petition authorities and state government ministers to push the case forward. They are calling for a coroner to be appointed and for a reward to be offered for information about the case. Ms Moody told she did not understand how Talon's death was allowed to have 'flown under the radar' for so many years. 'Obviously, for a mum losing her baby, that is really one of the worst things that can happen to a human being,' she said. Ms Moody's petition for an inquest and reward for information about Talon's death has gained more than 2500 signatures. In a statement, Victoria Police said detectives from the Homicide Squad were investigating the death of a baby girl in Frankston in 2019. 'Emergency services were called to a residential property on 20 June after the eight-month-old was found unconscious. 'She was conveyed to hospital where she subsequently passed away. 'The circumstances surrounding the death are still to be determined and the investigation remains ongoing.' Ms Hehir said that since going public she had been dealing with the pain of seeing pictures of her little girl popping up on social media – but she hoped it would be worth it. 'I'm feeling hopefully that maybe people will listen.'

NSW to ban people from appealing if working with children check is denied

New South Wales will move to ban people from appealing the denial of a working with children check, after media reports highlighting cases where sex offenders and other criminals had been granted the checks on appeal. The cases included instances where the NSW Civil and Administrative Appeals Tribunal (NCAT) had upheld appeals for a man who had been convicted of a sex act involving a woman on a train 47 years earlier and a teacher who was charged but never convicted of sexually abusing a foster child. Premier Chris Minns said he was "very distressed" at the reports. "I think it makes a mockery of the working with children check and is a loophole that cannot exist," he said. A working with children check is compulsory for anyone who undertakes any paid or unpaid work involving children in NSW. People must apply through Service NSW for the check, which involves a national police check of their criminal record and a review of reportable workplace misconduct. They are then either cleared to work with children or not, depending on the result. But many of those who are rejected are eligible to appeal through the NCAT. In some cases applicants had been initially knocked back for a working with children check on the basis of unproven allegations, but in others the NCAT weighed issues including the passage of time since an offence and psychological evaluations showing the applicant was a low risk to children. Mr Minns said he would bring legislation to end the appeals process. "When it comes to the safety of children, it's a one-strike policy; we can't have any ambiguity here," he said. "My understanding is we will have to introduce a bill to change the law to stop this appeal mechanism from taking place, but that's exactly what we are going to do." The Office of the Children's Guardian is currently carrying out a review of the laws around working with children.
