DILG: Elected officials without SOCEs cannot assume office

No elected official shall be allowed to take office unless he or she has complied with the submission of a statement of campaign expenses to the Commission on Elections, the Department of the Interior and Local Government said on Monday.
In a statement, the DILG said it would not recognize the assumption nor acknowledge any oath-taking by officials who failed to file their SOCEs.
The DILG cited its mandate to supervise local governments and implement relevant election-related laws and policies
"Under the law, no elected official shall be allowed to assume office until the required SOCE has been submitted in full compliance with the rules set by the Comelec," the DILG said.
"The DILG will not issue any recognition of assumption or acknowledge any oath-taking for officials who failed to meet the SOCE filing requirement," it added.
"All regional and field offices have been instructed to coordinate with COMELEC for verification prior to acting on any assumption to office at the local level," the DILG said.
Section 14 of Republic Act No. 7166 and Commission on Elections (COMELEC) Resolution No. 10730, all candidates and political parties in the May 2025 elections were required to file their SOCEs by June 11, 2025, without extension.
The SOCE filing requirement applies to all candidates, whether elected or not.
"The failure to file SOCE may also result in administrative fines for both winning and losing candidates. Repeat violations result into stiffer fines and subject the offender to perpetual disqualification to hold public office," the DILG said.
The DILG said the SOCE requirement promoted transparency and accountability in the conduct of elections and in the use of campaign funds. It serves as a post-election compliance measure to ensure integrity in public office and to reinforce public trust in electoral processes.
"The DILG reiterates that full compliance with the SOCE requirement is a condition precedent to the lawful entry into public office," it said.
"Local government units and transition teams are directed to ensure that all legal prerequisites, including the SOCE, are verified and fulfilled before proceeding with any turnover or assumption ceremonies," it added. –NB, GMA Integrated News

Vice President Sara Duterte said her father, former President Rodrigo Duterte, thinks he and his ally, Pastor Apollo Quiboloy, share the same fate as both are in detention. The vice president is currently in The Hague, Netherlands to visit her father in detention after he was arrested for alleged crimes against humanity during his administration's war on drugs. 'Sabi niya na pareho daw sila ng palad ni Pastor Quiboloy, pareho daw sila ng kapalaran. Tapos sabi niya, 'Sana pala hindi na lang kami naging magkaibigan, baka pa hindi kami napunta sa detention,'' Sara said, recalling her conversation with Rodrigo about Quiboloy. (He said he shares the same fate as Pastor Quiboloy. He told me he wished he hadn't become friends with Quiboloy, so that they wouldn't be placed in detention.) 'Nagtawanan kami, tapos sabi ko, 'Wala namang kinalaman 'yung mga guhit niyo sa palad sa inyong ano…sa mga pangyayari ngayon.' Sabi ko sa kanya, 'Politika lahat 'yan,'' she added. Duterte was arrested in the Philippines by local authorities on March 11, 2025 based on a warrant of arrest issued by the International Criminal Court (ICC). He is currently detained in the Scheveningen Prison in The Hague. Quiboloy, meanwhile, was arrested by local authorities six months earlier or on September 8, 2024, inside the Kingdom of Jesus Christ (KOJC) compound in Davao City, where the police had been searching for him for weeks. He is currently detained at Pasig City Jail. The religious leader is facing a non-bailable qualified human trafficking charge under Section 4(a) of Republic Act No. 9208, as amended. He is also facing charges under Section 5(b) and Section 10(a) of Republic Act 7610 or the Special Protection of Children Against Abuse, Exploitation, and Discrimination Act. Recently, a Pasig court has denied the petitions for bail filed by Quiboloy and his co-accused for his qualified trafficking for sexual abuse and labor exploitation case. The Vice President said she has not yet informed her father regarding this development, as she has not read the order of the Pasig Regional Trial Court (RTC), as well as the evidence presented by the prosecution that led to the denial of the bail petition. Call for Abante Sara also urged House of Representatives spokesperson Princess Abante to stop commenting on the ICC case of her father, stressing that she should only speak on behalf of the lower chamber. 'Siguro dapat huwag magsalita si Ms. Abante patungkol sa ICC case dahil spokesperson naman siya ng House of Representatives at wala namang kinalaman ang House of Representatives sa ongoing na kaso ngayon,' the Vice President said. (Maybe Ms. Abante should not comment about the ICC case because she is the spokesperson of the House of Representatives and the House of Representatives has nothing to do with this case.) She said that she went to The Hague as a Filipino and as a Vice President fighting for the rights of someone who was brought to and detained in another country. 'So ako, meron akong right. I have all the right to express my anger against what the administration of BBM did. Pero si Princess Abante, siya ay isang spokesperson ng House of Representatives so ang dapat niyang tina-topic o ibinabahagi sa taumbayan ay kung ano 'yung nangyayari sa House of Representatives. The Bangsamoro government has launched a public screening of a documentary chronicling the six-year transition of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) since its establishment in 2019. Titled 'The Transition: An Inside Look at the Bangsamoro Peace Process', the documentary highlights the rich history of BARMM and the challenges it has faced following the decades-long struggle of the Moro people. It also presents the visions and responsibilities that future Bangsamoro leaders must take on, according to an Unang Balita report on Monday. The BARMM Public Information Office said it plans to screen the documentary in other parts of the country to raise public awareness on the region's rich history and system of governance. The Bangsamoro Transition Authority currently serves as the interim government of the autonomous region. It will conclude its leadership after the first-ever parliamentary elections on October 13, 2025. In 2018, then-President Rodrigo Duterte signed into law Republic Act No. 11054 or the Bangsamoro Organic Law (BOL), which formed the new Bangsamoro Region in place of the ARMM. The law was ratified following a two-part plebiscite in 2019, and five provinces were designated under the political and administrative control of the BARMM: Basilan, Lanao del Sur, Maguindanao, Sulu, and Tawi-Tawi. However, the Supreme Court, in September 2024, upheld the validity of the BOL but declared that Sulu was not part of the Bangsamoro. Imee Marcos eyes new Omnibus Election Code

SANDRA AGUINALDO/ GMA Integrated News Senator Imee Marcos has filed a measure seeking to revise and recodify all the election statutes, paving the way for the New Omnibus Election Code of 2025. In the explanatory note of Senate Bill 425, Marcos, chairman of the Senate committee on electoral reforms and people's participation, said certain provisions of the 1985 Omnibus Election Code are "outrightly ill-suited for modern times." "The [OEC] is well more than three decades old. Since the inception of the OEC, there have been many significant changes in the manner by which elections are conducted," the senator said. "Likewise, regulations and limitations under the OEC have since been proven inadequate to realistically ensure a more level-playing field for candidates," she added. In 2023, the Commission on Elections (Comelec) finished a 964-page draft of proposed amendments to the Omnibus Election Code, according to poll chairman George Garcia. He said the proposed revisions include provisions on the overhaul of the party-list system and changes in campaign finance. The European Union (EU) Election Observation Mission, which sent a delegation to monitor Eleksyon 2025, said in its report that nearly half of the provisions of the Omnibus Election Code, including those for campaign finance and election offenses, are already "outdated." Those provisions, the report said, were already superseded by the 1987 Constitution and by numerous subsequent laws and regulations. BSKE term of office Under Marcos' bill, the Comelec shall have exclusive charge of enforcement and administration of all laws and regulations to the conduct of election, plebiscite, initiative, referendum, and recall for the purpose of ensuring free orderly and honest elections. The measure also provides for the conduct of a hybrid election system—a combination of the automated election system and the manual election system—to ensure transparency and credibility of the electoral processes. This hybrid election system shall be applicable to the May 2028 elections and all national, local, and Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) polls thereafter. The bill also stated that the term of office of all elected barangay and Sangguniang Kabataan (BSKE) officials shall be four years. The BSKE elections will be held on the first Monday of November 2026 and every four years thereafter. No elective barangay official shall also serve for more than three consecutive terms in the same positions, while no elective SK official shall serve for more than one term in the same post. Party-list, substitution The bill also classified the party-list system into: a) political parties or coalition of political parties; and b) sectoral parties or organizations. Each of these classifications shall have 50% of the seats allocated for the party-list. Each registered party, organization, or coalition shall submit to the Comelec a list of names of not less than five nominees from which party-list representatives shall be chosen in case it obtains the required number of votes, together with the certificates of nomination and acceptance of all the nominees in such list. Substitution shall also be allowed for any nominee who dies, becomes physically incapacitated, or has been disqualified. "No substitution shall be allowed for nominees who withdrew their acceptance to the nomination. In the event the list of nominees of a party-list group is exhausted because of the withdrawal of all its nominees, such party, organization, or coalition shall be deemed to have withdrawn its manifestation of intent to participate in the elections," the bill noted. Only a person belonging to and nominated by the same political party may file a certificate of candidacy to replace any official candidate who died, became incapacitated, or was disqualified after the last day of the filing of certificates of candidacy (COCs). In all cases of substitution after the period for filing of COCs, the substitute candidate must have the same surname as the candidate being substituted for. Cha-cha The proposed measure also states that a petition for an initiative on the 1987 Constitution must have at least 12% of the total number of registered voters as signatories, of which every legislative district must be represented by at least 3% of the registered voters. Initiative on the Constitution may also be exercised only once every five years. So far in the 20th Congress, only Senator Robin Padilla has filed a resolution seeking to revise the 1987 Constitution of the Republic of the Philippines through a constitutional convention. — VDV, GMA Integrated News
