Earlier, the Attorney General's Chambers (AGC) said in a statement that it had examined the investigation papers into Zara Qairina's death referred by the Royal Malaysia Police (PDRM) and decided to charge several suspects involved based on the available evidence. 'The decision to charge the suspects for the bullying offence was made as the charges will not interfere with the inquest proceedings that will take place,' the statement said. The AGC stressed that the decision to charge the suspects for the bullying offence will not affect the ongoing investigation by PDRM, including the inquest proceedings to be conducted in court. During the question-and-answer session in the Dewan Rakyat Monday, Home Minister Datuk Seri Saifuddin Nasution Ismail said the investigation into the death of Zara Qairina, which centred on three elements — bullying, neglect and sexual harassment — had been submitted to the AGC after police completed recording statements from 195 witnesses. Meanwhile, the Kota Kinabalu Coroner's Court on Monday set Sept 3 to commence the inquest proceedings into Zara Qairina's death. Coroner Azreena Aziz also fixed Sept 4, Sept 8 to 12, Sept 17 to 19 and Sept 22 to 30 for the inquest hearings. Former Sabah minister Peter Anthony's appeal rejected in forgery case, remains in prison
PUTRAJAYA: Former Sabah minister Datuk Peter Anthony has failed at the Court of Appeal in his attempt to overturn his conviction and sentence in his forgery case. A three-judge panel, chaired by Justice Azman Abdullah, unanimously ruled that there was no merit in his application. Peter, 54, had filed the revision application to have another panel of the Court of Appeal revise a decision by an earlier panel from the same court that upheld his conviction and sentence. Justice Azman said the court did not find any miscarriage of justice regarding a police report lodged by the third prosecution witness, Mohd Shukor Mohd Din, now deceased, on Aug 9, 2018. "The absence of this issue in the broad grounds of judgment does not amount to failure of justice because it is clear that it had been fully commented on in the full judgment." "It is tough for us to assume that this issue was not considered just because it was not stated or commented on in the broad grounds by the earlier panel as it was the main issue that was submitted during the appeal," Justice Azman said here on Wednesday (Aug 20). He said it was not the duty of the Court of Appeal to re-hear questions that involve matters that have already been decided upon. "We find there is no breach of natural justice as the applicant was given the right to be heard." "We find no merit to this application. The application is dismissed," he said. Other judges on the panel were Justices Noorin Badaruddin and Hayatul Akmal Aziz. Peter was taken away by prison officers after the proceedings ended. He was represented by lawyers Mohamed Haniff Khatri Abdulla and Datuk Rosal Azimin Ahmad. Deputy Public Prosecutors Datuk Wan Shaharuddin Wan Ladin and Haresh Prakash Somiah appeared for the prosecution. On March 14, Peter filed a notice of motion seeking a review and setting aside of his conviction and sentence handed down by the Court of Appeal on March 4. He also applied to quash the warrant of committal issued to Kajang Prison and sought any consequential orders necessary to ensure justice is served in the matter. On March 4, the Court of Appeal ordered Peter to serve a three-year prison sentence after dismissing his final appeal against the conviction and sentence imposed by the Kuala Lumpur Sessions Court in May 2022. On April 18, 2023, the Kuala Lumpur High Court upheld the conviction and sentence imposed by the Sessions Court. Peter subsequently filed an appeal on April 19, 2023, seeking to set aside the said decision. He has since paid the RM50,000 fine imposed by the court. Peter was charged under Section 468 of the Penal Code, which carries a maximum penalty of seven years' imprisonment and a fine upon conviction. He was accused, in his capacity as managing director of Asli Jati Sdn Bhd, of falsifying a letter from Universiti Malaysia Sabah's office of the deputy vice-chancellor dated June 9, 2014, by inserting false statements with the intent to deceive. The offence was allegedly committed at the office of the principal private secretary to the Prime Minister, Perdana Putra Building, Putrajaya, between June 13 and Aug 21, 2014.

Further investigations underway into ‘Geng Budak Sekolah' involving minors
PUTRAJAYA: Police are conducting further investigations into sexual crimes involving children after uncovering a group known as 'Geng Budak Sekolah'. Home Minister Datuk Seri Saifuddin Nasution Ismail ( pic ) said the investigation into the group, handled by the D11 (Sexual, Women and Children Investigation Division) at Bukit Aman, needs to be conducted carefully as it involves children. "There are methods for handling cases involving children. Pictures cannot be shared, names cannot be mentioned, and so on. Managing cases involving children is a complicated process that we need to understand, taking into account their age, level of thinking and what drives them to do such things. "... what makes them decide to even leave school... all that has to be looked into,' he told reporters after the National Day and Malaysia Day Celebration at the Home Ministry level as well as the ministry's monthly assembly here on Wednesday (Aug 20). When asked if there could be masterminds behind the children involved in the sexual crimes, he said this has yet to be ascertained. Saifuddin Nasution said the group's modus operandi was to use WhatsApp as a platform to sell explicit material among its more than 700 members. "Investigations are still ongoing and will certainly take some time, but at least we already know the modus operandi. "What is the purpose? There are those who are motivated to use it as a source of income, but they market only within the group, very secretive," he said. Justice for Zara Qairina must follow legal process says Home Minister
PUTRAJAYA: Home Minister Datuk Seri Saifuddin Nasution Ismail has emphasised that justice and accountability in the case of the late Zara Qairina Mahathir must be fully upheld in accordance with the law. He stated that truth and justice for the victim cannot be determined through conversations on social media or public opinion. 'Those who organise a series of demonstrations, what are they looking for? To seek the truth. To uphold justice. So how? It must be in line with the law and legal process.' 'The truth cannot be established by taking at face value what the pathologist who was detained yesterday said, or by believing the theory of a teacher claiming Zara was murdered and abused with a washing machine.' 'Truth and justice must go through the legal investigation process. Who has the authority to conduct legal investigations? The police, and that is exactly what we are doing,' he told reporters after the Home Ministry's National Day and Malaysia Day celebration and its monthly assembly here today. Saifuddin said the ministry is aware that many rumours surrounding the student's death are being circulated and that such claims will not stop. He said although he had already presented the investigation report on the case in the Dewan Rakyat yesterday, slander and false news would continue to spread. Saifuddin said so far, a total of 195 witness statements have been recorded to ensure the investigation is truly complete and comprehensive. 'Of course, it takes some time for us to properly update the case, and that was what we submitted last Monday, which subsequently led to the Attorney-General's Chambers making an announcement (that five underage teenagers were charged today under Section 507C(1) of the Penal Code in the Kota Kinabalu Juvenile Court).'
