Derogatory remarks in complaints to spouse's employer cruelty: Delhi HC
A bench of Justices Navin Chawla and Renu Bhatnagar in its July 1 verdict said marriage entails mutual respect and adjustment and some parties take less time to adjust with each other while the others take longer time.
The order, however, highlighted both parties were expected to show due respect to each other.
'Irrespective of the merits of these complaints, and regardless of whether the allegations made therein were false or true, we find that making such derogatory and defamatory remarks in the form of complaints to the employer of the spouse are nothing but cruelty," the bench said.
The order termed 'tolerance, adjustment and mutual respect" to be the foundations of a 'sound and healthy marriage".
Dismissing the woman's appeal, the court upheld a family court order of divorce to the husband on the ground of cruelty by the wife.
The couple married in 1989 and had two children before separating in 2010-11.
The wife moved the high court against the divorce decree and claimed her estranged husband resorted to various illegal measures to forcibly evict her and their children from the matrimonial home.
The high court observed the allegations of adultery levelled by the parties against each other.
Both the woman and the man accused each other of adultery.
The court said the woman's complaints to her husband's employer, particulary about the unfounded allegation of adultery, can't be used to address the issues of any wrong done to her for his employer had no role.
The order noted that the woman's complaints were made to harass the husband and humiliate him before his colleagues at workplace.
The bench said the family court rightly dissolved the marriage between the parties by upholding the allegations of cruelty based on the man's evidence.
'The fact that the parties have been living separately for a long time period of time, that is, around fifteen years now, without any resumption of marital cohabitation between the parties, can also be considered as an added ground while deciding the divorce petition," the court said. New Delhi: Opposition MPs, including Leaders of Opposition Rahul Gandhi and Mallikarjun Kharge, took out a protest march on Monday from the Parliament House to the Election Commission against the revision of electoral rolls in Bihar and alleged "vote chori" but were stopped midway by the police and detained amid high drama. Police put up barricades outside PTI Building on the way to prevent the MPs, protesting the voter roll revision in Bihar and the alleged poll rigging, from marching forward. As the MPs were stopped, many of them sat on the road and raised slogans while some women MPs, including saree-clad TMC's Mahua Moitra and the Congress' Sanjana Jatav and Jothimani, climbed the barricading and raised slogans against the EC. They were later whisked away by police in buses lined up along the road and taken to the Parliament Street Police Station. All the MPs were later released. "This fight is not political, but it is aimed at saving the Constitution. This fight is for 'one man, one vote' and we want a clean, pure voter list," Rahul Gandhi said as he was being taken away in a bus after being detained. "They cannot talk as the truth is before the entire nation....," he said. TMC's Moitra and Mitali Bag also fainted during the protest and were helped by Rahul Gandhi. Kharge, who was also detained from outside the PTI building, said the protest against 'vote chori' and SIR is a fight to protect people's right to vote and a struggle to save democracy and the INDIA bloc will expose this BJP's conspiracy. In a post on X, he said, "BJP's cowardly dictatorship will not work!". "This is a fight to protect the people's right to vote. This is a struggle to save democracy," he said. "The allies of the INDIA bloc will surely expose this BJP conspiracy to shred the Constitution," Kharge said in his post in Hindi. Congress general secretary Jairam Ramesh alleged that democracy was being "assaulted and murdered" right outside Parliament, as opposition MPs were stopped from taking out their protest march to the Election Commission office. "Our demand from the EC was very clear, all opposition MPs are staging a peaceful march, at the end of the march, collectively, we wish to present a memorandum on SIR and other issues, we didn't ask for a delegation. The language was clear, collectively, all opposition MPs would like to handover a memorandum to the EC. Now we are not allowed to even reach Nirvachan Sadan, we are stopped at PTI building. Right in front of Parliament, democracy is being assaulted, democracy murdered. This is too clever, cheeky reply by the ECI," he said. Wearing white caps with a red cross on the words 'SIR' and "vote chori", the protesting MPs started their march from Parliament's Makar Dwar raising slogans against the Special Intensive Revision (SIR) exercise in Bihar and "vote chori" while carrying placards and banners. Before embarking on the protest march, they sang the national anthem at Parliament's Makar Dwar. Police had made elaborate arrangements and placed barricades outside the PTI building on Parliament street to stop the protesting MPs from moving forward. The police asked the MPs not to proceed further and made announcement through a loudspeaker that only 30 people are allowed, and they should send their representatives forward, as they were prevented from moving forward to the Election Commission headquarters, a short distance from Parliament House. Prominent among those who participated in the march were NCP-SP's Sharad Pawar, T R Baalu (DMK), Sanjay Raut (SS-UBT), Derek O'Brien (TMC), Congress general secretary Priyanka Gandhi Vadra, Samajwadi Party's Akhilesh Yadav, as well as other MPs from Opposition parties like the DMK, the RJD, Left parties. AAP leaders, including Sanjay Singh, also took part in the protest march.

Bengaluru: Thirty-eight years after the death of a pre-university student in Dharmasthala, her sister has asked the special investigation team (SIT) to reopen the case and exhume the remains to aid a fresh investigation. She said Padmalatha, daughter of the late Devananda, was a II PUC student at SDM College, Ujire, when she went missing on December 22, 1986. 'Thirty-eight years ago, my sister Padmalatha, who was studying in the second PUC at SDM College. She went to college on December 22, 1986 at Ujire, returned to Dharmasthala and went missing in the evening. Her decomposed body was found on the side of a stream on February 17, 1987,' her petition states. She recalled that her father, a CPI(M) leader, led several protests seeking justice, prompting the government to hand the matter to the Corps of Detectives (COD). The case was discussed in the legislative assembly, and then Home Minister Rachaiah visited their home, assuring action. The probe was later closed as 'undetected.' Calling it a likely case of organised crime, Indravati said the family chose burial over cremation to preserve the possibility of future forensic testing. She has now asked the SIT to exhume the remains and expressed readiness to testify if the case is reopened. Meanwhile, the SIT, currently investigating the Dharmasthala mass burial case, is also preparing to deploy Ground Penetrating Radar (GPR) at site number 13, one of several locations marked by a complainant. Officials said the technology arrived in Belthangady on Monday and will be used on Tuesday to check for possible human remains without immediate digging. 'This is a non-invasive method that can give us a clearer idea of what lies underground before we begin digging. Spot 13 has posed challenges because of its location near a dam, multiple power lines, and the main road. The GPR will help us decide if exhumation here is even possible,' an officer who did not want to be named explained. Investigators have dug at 15 marked spots so far, recovering human remains only at spot 6. At another location near spot 11 — now reclassified as spot 14 — a skull and bones were found on the surface. The Dharmasthala mass burial case stems from serious allegations made by a former sanitation worker, who claimed he was ordered to bury multiple bodies near the river between 1995 and 2014, including those of women and girls who he believed had been sexually abused. He has guided officials from multiple government departments to specific locations, offering detailed descriptions of each site. A complaint was lodged on July 3 and an FIR was registered a day later.

The officials said BSF troops noticed some intruders trying to sneak into this side between Chandwan and Kothey border outposts in the Hiranagar sector around 4 pm and were challenged to stop. The intruders paid no heed to the repeated warnings, prompting the BSF personnel manning the forward posts to open fire, resulting in injuries to one of them, the officials said. The injured intruder was arrested and immediately shifted to a hospital for treatment, the officials said, adding he was later referred to All India Institute of Medical Sciences (AIIMS), Vijaypur for specialised treatment but he succumbed to his injuries. The identity and the motive behind his abortive attempt to infiltrate into this side were matters of further investigation, the officials said. They said the body is likely to be repatriated to Pakistan. 'BSF troops observed suspicious movement wherein a Pak National was observed crossing the IB and approaching aggressively towards the border fence in district Kathua, Jammu. 'He was warned by alert troops but paid no heed. BSF troops sensing threat fired on his legs. Later on, he was taken into BSF custody. Kishtwar encounter: Security forces scan jungles, fire UBGL grenades into cave Security forces continued to scan jungles of Kishtwar district for the second consecutive day on Monday to track down two terrorists, said officials. 'Army, which is leading the counter-terror operations in the dense jungles, fired grenades into a suspected hideout on Monday. The soldiers fired grenades with UBGL into a cavity on a steep slope,' said a police officer. The terrorists are believed to be hiding inside a cave on a cliff at Bhagna forest in Dool area, some 25 km from Kishtwar town, he added. The search operation in the forest area started early Sunday following intelligence input about the presence of two most wanted Hizbul Mujahideen terrorists — Riyaz Ahmad and Mudassar Hazari — who are active in the district for the past eight years and carrying a reward of ₹10 lakh each. The hiding terrorists opened fire on the search parties at 6.30 am on Sunday and fled deep into the forest in the face of retaliation. The cordon and search operation was strengthened with the joining of more reinforcements from the army, including para commandos, police and CRPF, and deployment of drones. The police officer said, it appears that the two terrorists have hidden themselves inside the cave on a cliff.
