The election was necessitated after Jagdeep Dhankhar's surprise resignation as vice president on Monday evening, citing health issues. His term was to end on August 10, 2027.
In a statement, the Election Commission (EC) said that in consultation with the Ministry of Law and Justice and with the consent of the deputy chairman of Rajya Sabha, it has appointed Mody as the returning officer for the vice presidential election, 2025.
The EC has also appointed Garima Jain, Joint Secretary, Rajya Sabha Secretariat, and Vijay Kumar, Director, Rajya Sabha Secretariat, as assistant returning officers during the course of the election.
The poll authority, in consultation with the central government, appoints a returning officer, who will have his or her office in the national capital, and may also appoint one or more assistant returning officers.
According to convention, either the Lok Sabha secretary general or the Rajya Sabha secretary general is appointed as returning officer by rotation. During the last vice presidential election, the secretary general of the Lok Sabha was the returning officer.
The poll authority has started constituting the electoral college comprising MPs of both Houses of Parliament. Both elected and nominated members are eligible to vote in the vice presidential election.
The Union home ministry on Tuesday formally notified Dhankhar's resignation from the office of the vice president.
According to Clause 2 of Article 68 of the Constitution, an election to fill a vacancy in the office of the vice president occurring due to his death, resignation or removal, or otherwise, will be held "as soon as possible" after it goes vacant.
The person elected to fill the vacancy will be entitled to hold office "for the full term of five years from the date on which he enters... office".
From the day the notification is issued, "calling the electoral college to vote", and till the day of the poll, a period of 30 days is stipulated. A person cannot be elected as the vice president unless he is a citizen of India, has completed 35 years of age and is qualified for election as a member of the Rajya Sabha.
A person is also not eligible if he holds any office of profit under the government of India or a state government or any subordinate local authority.

Choice to marry someone from different faith safeguarded by Constitution: Delhi High Court

New Delhi The choice to marry someone from a different faith is safeguarded under the fundamental right to life and personal liberty, even if it challenges social norms and family expectations, the Delhi High Court has held. (Representative photo) The choice to marry someone from a different faith is safeguarded under the fundamental right to life and personal liberty, even if it challenges social norms and family expectations, the Delhi High Court has held, while directing the Delhi Police to continue protecting an interfaith couple facing threats from their families. A bench of justice Sanjeev Narula made the observation on August 8, while dealing with a plea filed by a 26-year-old Muslim man and a 25-year-old Hindu woman, seeking police protection and accommodation in a safe house. In a petition filed last month, the couple asserted that despite solemnising their marriage after a relationship of over seven years, there was strong opposition from the woman's family. The petition said that despite writing to the deputy commissioner of police for the southeast district on July 23, requesting police protection, the police forcibly separated the woman from her husband and detained her at Nirmal Chhaya Shelter Home on July 24. The plea stated that the woman married the man voluntarily, without any coercion. On July 25, the high court directed the DCP to look into the matter personally and, if the woman affirmed her wish to live with her husband, to ensure appropriate arrangements for the couple's safety. The counsel for the woman's father, on August 8, asserted that his client was deeply troubled by his daughter's decision to marry the man without his consent and that he was concerned for his daughter's welfare. Considering the contentions, the court directed Delhi Police to continue providing them protection and accommodation in a safe house, till they solemnise their marriage under the Special Marriage Act. The bench said that parents' anguish over their daughter choosing her life partner without consultation cannot eclipse the right of an adult to choose a life partner, since Article 21 of the Constitution safeguards an individual's right to marry a person of one's choice. 'The constitutional guarantee under Article 21 enables every adult citizen may shape the course of their own life, free from fear, coercion or unlawful restraint. The choice to marry, especially across lines of faith, may test the resilience of social norms and familial expectations, yet in law, it remains a matter of personal liberty and individual autonomy, immune from any external veto. While the anguish of a parent is understandable, it cannot eclipse the rights of a major to select their life partner,' the court said. It added, 'The court is mindful of the anguish of the girl's father, who opposes the relationship on grounds that he perceives as legitimate and rooted in his concern for his daughter's welfare. However, upon attaining the age of majority, the right to make decisions regarding marriage becomes the individual's personal prerogative. Parental preference, however well-intentioned, cannot legally override that autonomy.' Noting the couple's allegation of being forcibly separated, the court directed the DCP to submit a report on whether any unlawful separation had occurred and, if so, to identify the officer responsible. The direction came after the woman claimed she was taken to a shelter home by the police against her will, while the police maintained that no coercion, unlawful action, or procedural lapse had taken place. The matter will next be heard on September 12. The same bench, in a similar plea filed by another couple, also ruled that a family's disapproval cannot override the right of two consenting adults to choose each other as life partners and live together peacefully. 'The right of two consenting adults to choose each other as life partners and to live together in peace is a facet of their personal liberty, privacy, and dignity protected under Article 21. Family disapproval cannot curtail that autonomy,' the court said in an order on August 5.

After she praises Yogi, Samajwadi Party expels MLA Pooja Pal

After Samajwadi Party MLA from Chail Pooja Pal showered praises on chief minister Yogi Adityanath for bringing the killers of her husband Raju Pal to justice, she was expelled by Samajwadi Party chief Akhilesh Yadav on Thursday for 'anti-party' activities and indiscipline. Pooja Pal. (HT Photo) The letter issued by the SP chief read, 'You have been involved in anti-party activities, however, you didn't stop it even after being warned, which has caused damage to the party. The work done by you is against the party and serious indiscipline, hence you are being expelled from the party with immediate effect. At the same time, you are also being relieved from all the posts of the party.' Pooja Pal was earlier in the news when she had cross-voted for the Bharatiya Janata Party candidate during the Rajya Sabha elections in Uttar Pradesh in February 2024. In June, the SP had expelled three rebel MLAs for cross-voting during the Rajya Sabha polls but spared Pooja Pal then. After her expulsion, Pooja Pal said to the media, 'Perhaps you could not hear the women in Prayagraj, who were even more worried than me. But I am their voice, I have been elected as an MLA and sent to the assembly. I am the voice of mothers and sisters who have lost their loved ones. They have sent me here. All people in Prayagraj, who were disturbed due to Atiq Ahmed, have been given justice by the CM, not just to Pooja Pal. I have been saying this from day one, even when I was in the party.' 'I have been expelled today. I stand by my statement even today. I became an MLA later but I am a victim woman first, a wife could not stand the incident that occurred with us. They speak of PDA. I, too, belong to a backward community, I was troubled, I stepped out of my house because my husband was killed in broad daylight. They have proven that they are completely against PDA,' she said. Pooja Pal, who participated in the 24-hour discussion in the assembly on the Vision Document 2047 by the BJP government, had said during her speech that chief minister Yogi Adityanath gave justice to many women like her. 'Everyone knows who murdered my husband. I want to thank the chief minister for bringing me justice and hearing me when nobody else did. The CM gave justice to many other women like me in Prayagraj by bringing in policies like zero tolerance that led to the killing of criminals like Atiq Ahmed. 'Mere pati ke hatyare Atiq Ahmed ko Mukhya Mantri ne mitti mein milaane ka kaam kiya'... I raised my voice when I saw that no one wanted to fight against criminals like Atiq Ahmed... When I started getting exhausted with this fight, CM Yogi Adityanath gave me justice,' Pooja Pal had said in the state assembly earlier on Wednesday. Meanwhile, deputy chief minister Brajesh Pathak attacked the Samajwadi Party for expelling Pooja Pal on the eve of Independence Day. 'To be expelled on the eve of Independence Day for supporting the vision of Viksit Bharat in the House, shows the poor thinking of the Samajwadi Party. The House unanimously accepted that the Samajwadi Party's policy is anti-woman,' Pathak said

My Bihar yatra is to save democracy, says Rahul

Patna: Congress leader Rahul Gandhi on Thursday announced that the party will launch a direct campaign against the special intensive revision (SIR) of electoral rolls from Bihar on Aug 17 with the commencement of the "Voter Adhikar Yatra". "This is not just an election issue but a decisive battle to protect democracy, the Constitution and the principle of 'one man, one vote'," Rahul declared in a social media post. Asserting the party's commitment to ensuring a "clean voter list" nationwide, he appealed to youths, workers, farmers and all citizens to join what he described as a "people's movement". "This time, the defeat of vote thieves is certain," he said. Congress general secretary K C Venugopal said RJD leader Tejashwi Prasad Yadav and other Grand Alliance leaders would join Rahul on the yatra, which will pass through several districts before culminating in a mega rally at Gandhi Maidan, Patna, on Sept 1. "The rally will send a clear message to drive away the vote thieves," Venugopal said, vowing to keep power in the hands of ordinary people rather than "divisive forces, cronies and the powerful".
