Lawyer wants BM version of constitution declared as authoritative text
PETALING JAYA : A lawyer has filed a suit against the government in the Kuala Lumpur High Court, seeking a declaration that the Bahasa Malaysia version of the Federal Constitution is the authoritative text.
Haniff Khatri Abdulla said he filed the writ of summons and statement of claim through the law firm Ahmad Fuad Abi & Aidil.
The suit names the government as the defendant and is aimed at getting the High Court to declare that the Bahasa Malaysia version of the constitution should take precedence over the English version.
'This suit is based on Article 160B of the Federal Constitution, which provides that if and when the constitution has been translated into the national language, the Yang di-Pertuan Agong may prescribe the national language text as the authoritative text.
'After that, if there is any conflict or inconsistency between the national language and English text, then the national language text shall prevail,' he said.
Although the Agong had launched the BM version of the constitution on Sept 29, 2003, Haniff said, the government has yet to make it the authoritative version.
'Even more than two decades later, the government continues to fail, refuse and/or neglect to enforce the position of the text in the national language as the authoritative version,' he said.
He claimed this was a breach of the government's constitutional duty to ensure that it took the necessary steps to uphold and dignify the national language.
'It is highly unreasonable that a sovereign and independent nation like Malaysia still does not have an authoritative constitutional text in its own national language, more than six decades after achieving independence,' he said.
In 2023, then attorney-general Idrus Harun said the Attorney-General's Chambers planned to suggest that the government make the Bahasa Malaysia version of the constitution the authoritative text.
However, he said, this was subject to the approval of the king.
This proposal was met with opposition from an interfaith council, which said relying on the Bahasa Malaysia text would have an effect on the Federal Court ruling on unilateral conversion.
An MP also said such a move must first obtain Sabah and Sarawak's approval.

MCMC to record Muhyiddin's statement over RON95 subsidy claim

In a statement MCMC said that Muhyiddin would be questioned as a witness. 'The focus of the probe is to confirm the context of the content that was uploaded. 'The probe does not include any claims or allegations levelled against him.' MCMC also said it would be contacting the relevant individuals to complete its probe. Yesterday, Prime Minister Anwar Ibrahim ordered MCMC to look into his claim that Muhyiddin had defended the distribution of government subsidies to foreigners. In a statement, the Prime Minister's Office said it acknowledged the Perikatan Nasional chairman's denial of ever making such a statement involving targeted RON95 petrol subsidy. On Tuesday, Sinar Harian quoted Anwar as saying that Muhyiddin, who is also the Bersatu president, had questioned the government for burdening foreigners when they have also made significant contributions to the country. Anwar said the government had decided on targeted subsidies for electricity and RON95 petrol so that it could continue helping Malaysians while reducing the nation's fiscal deficit. Muhyiddin later denied having made such a statement and urged Anwar to furnish proof of his claim. The former prime minister said Anwar's claim was slanderous and that his stand from the beginning was that government subsidies should be for Malaysians, not foreigners.

Migrant worker protection is about human rights, not just ILO rules, says Sim
Human resources minister Steven Sim said the government is still committed to reducing reliance on migrant workers as outlined in the 13th Malaysia Plan, from the current 15% to 10% by 2030. (Bernama pic) KUALA LUMPUR : The human resources ministry does not view migrant worker protection as a matter of mere compliance with International Labour Organization (ILO) conventions, but as one of human rights, says its minister. Steven Sim said the government's commitment to protecting migrant workers' rights is rooted in humanity. 'Beyond altruism, a system that exploits migrant workers will ultimately harm local communities as well. 'Just because Singapore isn't following (ILO conventions), doesn't mean we shouldn't. 'We must ensure all workers in this country are fairly treated,' he said at an event organised by the Institute of Strategic and International Studies Malaysia. Earlier this week, Malaysiakini reported former finance minister and DAP adviser Lim Guan Eng as saying in the Dewan Rakyat that there was 'no need to mandate the RM1,700 minimum wage and 2% EPF contributions for migrant workers' already in the workforce. Lim had pointed to Singapore's policy of not requiring Central Provident Fund contributions for migrant workers since 2003, without repercussions from the ILO. In response, PSM's deputy chairman S Arutchelvan slammed Lim's remarks yesterday as a 'blatant endorsement of modern-day exploitation'. Earlier today, former MP and Suaram director Kua Kia Soong also questioned whether DAP's stance on social justice and equality had changed. He said the party, which has long styled itself as 'the conscience of Malaysian politics', risked appearing like a 'hollow vessel' when it comes to defending labour rights. Meanwhile, Sim said the government is still committed to reducing reliance on migrant workers as outlined in the 13th Malaysia Plan, from the current 15% to 10% by 2030. 'We are now in the final stage of implementing a multi-tiered levy mechanism (MTLM) where employers pay more if they hire more foreign workers,' he said. According to the 13MP, the additional levy collections from the MTLM will be channelled into a newly established trust fund to promote automation and mechanisation.

Lawyers urge prosecutors, media not to link Guan Eng to witness's assault
Lim Guan Eng's lawyers said the DAP adviser remains confident in the judicial process and is fully committed to defending himself through lawful means to prove his innocence. PETALING JAYA : DAP adviser Lim Guan Eng's lawyers have criticised recent media reports and prosecutorial remarks that allegedly link him to the assault of a key prosecution witness in his ongoing graft trial. In a statement issued today, law firm Haijan Omar & Co, acting on behalf of the Bagan MP, condemned what they described as 'premature and misleading' speculation surrounding the incident. They also urged the media to refrain from reporting unverified claims about the assault, warning that such reports risk undermining the judicial process and Lim's presumption of innocence. 'The insinuation of any connection between the incident and our client – echoed by remarks from the lead prosecutor – is baseless, unfair and prejudicial,' the statement read. Yesterday, a prosecution witness in Lim's trial was reportedly attacked by 10 unidentified individuals at his home near here. According to Malaysiakini, lead prosecutor Wan Shaharuddin Wan Ladin said he was awaiting instructions from MACC chief commissioner Azam Baki on the next course of action, including whether to seek court protection for the witness. While Lim's legal team acknowledged the need for protective measures in cases where safety was a genuine concern, they emphasised that such action should not be based on 'speculative and tendentious assumptions' that unfairly associate their client with the assault. The lawyers also took issue with Wan Shaharuddin's statement, suggesting it was made while a police investigation was ongoing and without full knowledge of the facts. They said it was unclear whether Wan Shaharuddin had sought clarification from the police regarding the motive behind the incident prior to making his remarks. The lawyers cited a clarification by Petaling Jaya police chief Shahrulnizam Ja'afar, who confirmed that the case was a 'clear-cut robbery' with no element of witness tampering. 'We welcome the swift clarification by the police confirming that the incident was an armed robbery, wholly unrelated to the trial,' the statement added. Lim's legal team said they intend to raise the 'prosecutorial impropriety' in court when the trial resumes at the Kuala Lumpur sessions court on Aug 19. The lawyers said their client has confidence in the judicial process and is fully committed to defending himself through lawful means in order to prove his innocence against all 'baseless charges'. Lim is charged with using his position as then Penang chief minister to ask a businessman for a 10% cut of the profits from the undersea tunnel project and accepting RM3.3 million in kickbacks. He is also accused of two counts of dishonestly misappropriating RM208.7 million worth of state land.
