Constitute student safety panels in schools within two months, Madras HC tells TN government
A bench of justices SM Subramaniam and AD Maria Clete gave the direction recently on a Public Interest Litigation (PIL) petition filed by an advocate G Shabna of Theni, seeking formation of the committees.
According to Shabna, the state school education department had passed a G.O. on June 17, 2021, introducing safety guidelines to protect students from sexual harassment. One of the measures mandated through the above G.O. included the formation of SSCAs.
The committees should consist of the school principal, two teachers, two parents, a management representative, non-teaching staff, and optionally, an external person, as members. The principal should be a permanent member and half the committee members must be replaced annually, Shabna said.

Orissa HC takes strong exception to misuse of National Emblem
Bhubaneswar, Aug16 (UNI) Taking strong exception to the misuse of the national emblem, the Orissa High Court has called for greater awareness among the general public, including government officials, regarding the proper use of the State Emblem of India. The Court was hearing a Public Interest Litigation (PIL) filed by a civil society group from Ganjam district, which highlighted multiple instances of blatant and apparent misuse of the emblem. A Division Bench comprising Chief Justice Harish Tandon and Justice Murahari Sri Raman took serious note of the matter. The PIL raised concerns over the rampant misuse and violations of the State Emblem of India (Prohibition of Improper Use) Act, 2005, which strictly prohibits the improper use of the national emblem for professional and commercial purposes. The State Emblem of India, an adaptation of the Lion Capital of Ashoka dating back to 280 BCE during the Maurya Empire, serves as the national emblem and is used by the Union Government, State Governments, and other government agencies. 'There is no fetter on the part of the Court in passing a direction for initiation of a proceeding against the persons, who violate any of the provisions of the said Act or misuses the State Emblem of India but this Court feels that the larger issue is required to be addressed so that the misuse of such Act can be prevented and there should be a spreading of awareness into a common citizenry of the State, including the officials while using the State Emblem of India', the Division Bench ruled in a order pronounced on 12 August. 'We, therefore, appoint Manoj Kumar Mishra, Senior Advocate, the President of the Orissa High Court Bar Association and Subir Palit, Senior Advocate to act as Amicus Curiae to assist the Court in achieving the main object, more particularly, the prevention of misuse of the State Emblem of India and spreading of awareness amongst the people of the society throughout the country', the Division Bench said in a ruling. Rs 15k cost imposed on man for ‘vexatious' petition
MADURAI: The Madurai Bench of Madras High Court recently imposed Rs 15,000 cost on a litigant for filing a 'vexatious' petition seeking to restore a portion of his property which was demolished by the state highways department as it was encroaching highways land. A bench of justices SM Subramaniam and AD Maria Clete observed that the petitioner, Kamaraj, has moved the court even though the surveyor clearly stated in his report that the petitioner has put up an unauthorized construction by encroaching highways land in Kariapatti, adjacent to Madurai-Thoothukudi NH. The bench noted that Kamaraj had previously moved the court for the same dispute and upon finding that his property was demolished by the authorities without issuing a show cause notice, the court had imposed Rs 10,000 cost on the highways department, adding that if it is found that there is no encroachment, the authorities should restore the construction and also pay Rs 1,00,000 to Kamaraj. The judges observed that despite having knowledge of the survey report, the petitioner has moved the court with an intention to make the authorities restore his demolished property and claim Rs 1,00,000 from them. Calling it a vexatious litigation, the judges imposed Rs 15,000 on Kamaraj and directed him to pay the amount to the assistant divisional engineer of highways, Aruppukkottai within 10 days.
