Arrest in Magaqa murder case brings family relief

The family of the assassinated former ANC youth secretary Sindiso Magaqa has welcomed the arrest of a former Umzimkhulu municipal manager.
The manager was arrested by the Political Killings Task Team on Monday and will appear in the Umzimkhulu Magistrate's Court Tuesday.
National police spokesperson, Athlenda Mathe, said the 55-year-old suspect was arrested on Monday in Malvern, Durban, KwaZulu-Natal.
The manager was named by the convicted hitman, Sbusiso Ncengwa, alongside the late provincial legislature deputy Speaker, Mluleki Ndobe, as the ones who masterminded Magaqa's murder.
Reacting to the news, Dr Lwazi Magaqa said the family was happy that the real alleged mastermind behind his brother's murder has been finally arrested, adding that the family will provide a comprehensive comment after his appearance on Tuesday.
'We are happy that he has finally been arrested; however, we will give our full comment after his appearance tomorrow," said Magaqa.
Ncengwa was recently sentenced to 25 years in prison following his confession to the murder and implication of several people, including the two accused, Sibonelo Myeza and Mbulelo Mpofana.
The third accomplice, Mlungisi Ncalane, will not see his day in court as he had been declared mentally unfit to stand trial and has been confined to a mental institution.
Ncengwa is now expected to testify against the two other accused, who were allegedly present during Magaqa's shooting on July 13, 2017. Magaqa died in September of the same year.
Two councillors, Jabulile Msiya and Nonsikelelo Mafa, who were with Magaqa during the attack at a car wash, were also shot but survived.
Another alleged accomplice, Jabulani Mdunge, who allegedly sprayed Magaqa and others with AK-47 bullets, died in a shootout with police.
During the mitigation of his sentence, Ncengwa confessed that a day before the shooting, he went to Umzimkhulu from Durban to confirm Magaqa's identity.
On the day of the murder, he spotted Magaqa arriving at the car wash he often frequented.
The assailants were paid a total of more than half a million rand for the murder.
Magaqa was killed for speaking out against a corruption-riddled tender to construct a local memorial hall.

When politicians and criminals blur lines
The presence of politicians near murder suspects and failure to act on Zondo's report signal deep systemic decay. Two recent events highlighted a perceived intermingling of South African politicians with the criminal underworld – and the ANC's utter inability to fix this. The first event was Kenny Kunene pitching up at the home of a murder suspect at the centre of a web of alleged politically tainted criminality. The second was former chief justice Raymond Zondo's critique of President Cyril Ramaphosa's failure to implement recommendations of the commission of inquiry into state capture. Kunene's stated reasons for being at Katiso Molefe's home were implausible to radio, TV and social media audiences. Even his long-time friend and political boss, fellow ex-convict Gayton McKenzie, knew the position was indefensible. ALSO READ: Why the ANC remains a safe haven for corruption Molefe was mentioned in KwaZulu-Natal police commissioner Lieutenant-General Nhlanhla Mkhwanazi's media conference on 6 July, where allegations were made about senior police machinations. Molefe should have been off-bounds for any media-savvy politician. Kunene has not only reinforced the common perception that politicians are not to be trusted. It goes deeper. In an environment where whistle-blowers are slain with impunity, the link to a murder suspect could give rise to more sinister inferences. Impunity is also at the heart of Zondo's concerns, where he detailed failures of the justice system. As chief justice, he found it painful to swear-in Cabinet ministers who had serious state capture findings against them. ALSO READ: Now we wait for accountability, Mr Mayor 'It was like the president was saying: 'I don't care what you have found about these people. I think they are good enough to be promoted.'' Zondo's words are a vote of no confidence in Ramaphosa by arguably the most respected judge in the country. Zondo lacks faith that crooks will be brought to book under Ramaphosa's presidency. Indeed, in South Africa, most culprits get away with murder and much else. Only around 6.8% of murder cases with arrests lead to convictions. In many cases, there are no arrests. So, the percentage of murder convictions per total number of murders (with and without arrests) will be lower. This picture contributes to the impunity with which criminals, including politicians, operate. In every sphere, crooks carry on because they know the chances of being convicted are slim. Proper implementation of Zondo's recommendations would have changed this perception. ALSO READ: The real national dialogue has begun On Monday, the Presidency reported 'significant progress' in implementing reforms. Ramaphosa claimed 48% completion of actions from Zondo's recommendations, adding that high-profile cases are scheduled for 2025-26. Given the lack of success in cases thus far, it is hardly reassuring to hear that cases are pending. Where are the significant arrests? Why did Ramaphosa choose for his Cabinet from people implicated in Zondo's report? Zondo has every right to feel disappointed. After sitting for four years, hearing 300 witnesses, producing 8 655 530 pages of documents and spending R1 billion of taxpayers' money, implicating more than 1 438 people, his team felt 'their efforts were for nothing'. Many South Africans will agree. Why are so many of the people implicated in the Zondo report now sitting in parliament instead of being in court or in jail? When politicians and criminals are indistinguishable from each other and the underworld are overlords, it's time to revolt.

Police probing 10 high-profile cases in connection with AK-47 linked to Katiso Molefe
JOHANNESBURG - With an AK-47 rifle being used to connect controversial businessman Katiso 'KT' Molefe to several crimes, the police said they are investigating ten high-profile cases linked to the weapon. On Tuesday, Molefe was charged with the murder of another musician, Hector Buthelezi, known as DJ Vintos. ALSO READ: Ballistic testing links Katiso 'KT' Molefe to AK-47 rifle used in murders of DJ Sumbody, DJ Vintos This is in addition to the murder of Oupa Sefoka, known as DJ Sombody, and Armand Swart, a Vereeniging engineer who was killed in a mistaken identity hit. His accused, who are the alleged hitmen, have also been charged with the murder of a man identified as Don Tindleni. Molefe's charge sheet is getting longer as he was slammed with a third murder case, which is also a hit, for the 2022 killing of Buthelezi. Buthelezi was shot outside a nightclub in Orlando East, Soweto, with the suspects firing shots while driving by. Police said his murder has been linked to that of DJ Somebody and Swart, who was mistakenly shot during a hit with an AK-47 rifle and two pistols. Spokesperson Athlenda Mathe said more links could be made. 'I had indicated that we are investigating 10 high-profile cases where these firearms are being linked to, so now we are at number 4.' Meanwhile, Molefe's bid for bail will continue in the Alexandra Magistrates Court next week.

Former KDM mayor Lindile Nhaca expected to be reinstated this week The African National Congress (ANC) is expected to reinstate Lindi Nhaca as KwaDukuza mayor, less than eight months after her controversial exit. Sources within the ANC have told the Courier that Nhaca is the front runner for the mayoral election in Thursday's highly anticipated council meeting. Former iLembe District mayor Sduduzo Gumede is said to be the most likely candidate to be appointed as her deputy. This follows the resignations of mayor Ali Ngidi and his deputy Sicelinjabulo Cele earlier this month. The pair stepped down under mounting political and public pressure, stemming from a series of scandals and persistent service delivery failures. Ironically, Ngidi assumed office following Nhaca's own controversial departure at the end of September last year. Ngidi and Cele, who were elected just over a month later on November 5, tendered their resignations following a directive from the ANC, although they will remain in their roles until their successors are officially elected. According to ANC provincial task team co-ordinator Michael Mabuyakhulu, the recall decision forms part of the party's broader strategy of 'rebuilding and renewal.' Ngidi's brief tenure was dogged by controversy. Public dissatisfaction surged in the wake of multiple scandals, including a car hire debacle that saw more than R1-million spent on vehicles, along with a monthly personal security bill exceeding R173 000. Both Ngidi and Cele have been ordered to repay a portion of the car hire expenses, particularly those incurred before formal council approval was granted. The administration also struggled with a wave of crises including widespread and prolonged electricity outages, labour unrest involving hundreds of municipal workers and the embezzlement of R35.7-million in January. Multiple investigations into the municipality's affairs are currently under way, led by the Special Investigating Unit (SIU), the Department of Co-operative Governance and Traditional Affairs (Cogta), and the National Energy Regulator of South Africa (Nersa). These probes focus on numerous allegations of mismanagement. Public frustration continues to grow, with civic organisations and residents demanding accountability and new leadership.
