Mining scam case: BJP leader Gali Janardhan Reddy's plea 'bizarre attempt' to use electorate as shield, CBI tells HC
In a detailed counter filed before the High Court, the CBI urged dismissal of the criminal appeal and accompanying interlocutory application, arguing that Reddy had failed to establish any exceptional grounds warranting such relief.
Reddy was convicted by the trial court under Sections 120-B read with Sections 409 and 420 of the Indian Penal Code (IPC), and was sentenced to undergo rigorous imprisonment for seven years, with all sentences running concurrently.
The trial court had categorically held that the prosecution had proved the charges eyond reasonable doubt, backed by substantial evidence, including witness testimonies and documentary records.
The CBI emphasised that Reddy is also facing trial in several similar criminal cases in the state of Karnataka.
The agency further pointed out that in his present plea, Reddy had not cited a single mitigating factor to support his case for suspension of conviction.
Notably, the appeal merely contains a one-line statement alleging harm if the conviction is not stayed - without any supporting affidavit or specific details.
'In the absence of demonstrated exceptional circumstances, the case does not qualify for suspension of conviction,' the CBI submitted.

Gurgaon: A district court has awarded Rs 1.8 crore in damages to Gurusharan Lal Awasti, a UK citizen, who was falsely implicated in a dowry harassment case by his wife. He frequently travelled between London and Gurgaon for the trial, pleading for a speedy resolution. In 2017 — after an arduous eight-year legal battle — the district court acquitted Awasti and his family, citing inconsistencies in Shalini's statements and insufficient evidence from the prosecution. Her lawyer, Rishi Raj Yadav, argued that the damages suit was baseless, as the acquittal was under appeal in the high court and Awasti had not paid the required court fee. However, Awasti's lawyer, Kirti Sejwal, clarified that the court fee would be paid based on any decree awarded for damages. On Aug 13, civil judge (senior division) Manish Kumar ruled in favour of Awasti, stating that the pending appeal did not negate the trial court's acquittal, which formed the basis of the damages claim. Consensual sex with girl on verge of turning 18 not offence: HC
Madras high court CHENNAI: A man's consensual sex with a girl, who was just 19 days short of turning 18 years old, cannot be an offence under the Pocso Act, ruled Madras high court, acquitting the man of all charges. He had been sentenced to undergo rigorous imprisonment for five years by a trial court in Coimbatore. Reversing the trial court ruling, Justice GK Ilanthiraiyan said the girl was capable of understanding the consequences of her actions and that her age at the time of the incident could not be proved beyond doubt. "There is nothing in the evidence to show that the appellant took away or enticed the victim to flee with him. Therefore, the charge under section 363 of IPC is not made out against the appellant. Further, the family members of the victim were aware that the victim was having a love affair with the appellant,' said the judge. Acquitting the appellant, the high court stated that the bail bond, if any, executed by the appellant shall stand cancelled, and the fine amount, if any, collected should be reimbursed.
