
SC places monuments in Mehrauli complex under ASI supervision

A bench of Justice B V Nagarathna and R Mahadevan directed that upkeep and any renovation of the monuments should be done under the supervision of ASI and the DDA would have to abide by ASI's direction. The court passed the order on a petition expressing apprehension that the civic authority was intending to demolish the structures on the name of encroachment of the public land.
The DDA, however, refuted the allegation and told the court that it was planning to take action only on recent constructions built around the monuments and not against the ancient structures.
The controversy was settled once the ASI filed its report after visiting the site.
"Tomb of Shaikh Shihabuddin and Chillagah of Baba Sheikh Fariduddin Shakar Ganj have multiple layers of history belonging to the period of 12-13th Century CE but most of the layers are missing creating a great unconformity of the history and origin of the place. The structural modifications and alteration for the sake of restoration and conservation has impacted the historicity of the place," it told the court.
"But, it would not be out of the context to mention here that the place definitely has some historical importance in terms of its origin and religious significance as mentioned in the report of Zafar Hasan. The location of the tombs in the middle of Mehrauli Green Belt close to Centrally Protected Monument of Ranjit gate and falls within the regulated area of the CPM therefore any repair renovation/construction work to be undertaken with prior permission of competent authority as per the AMASR (The Ancient Monuments and Archaeological Sites and Remains) Act," the affidavit said.

In this case the petitioner had first moved Delhi High Court for protection of monuments but the HC refused to grant relief and he moved SC through advocate Talha Abdul Rahman seeking court's interference.
Accepting the report of ASI, the bench allowed the plea and directed that the monuments be protected and directed that any repair or renovation of the structure must be done under the supervision of ASI.
The report said the tomb of Shaikh Shihabuddin also known as Ashiq Allah Dargah at Mehrauli has lost its heritage touch. "The Dargah at present has a modern look and due to intervention in the original historical fabric of the structure has been diluted. But, if seen closely the ancient structure (the Chattri Pavillion) can still be träced. The historical connotation of the Chattri pavilion could not be confirmed except that the location is close to Ranjit gate.
Ranjit gate was one of the prominent gate of Lalkot Citadel," it said.

Can't supply school uniforms for students, only subsidy: Delhi govt to HC
The Delhi government has informed the High Court that it will not be able to provide school uniforms in kind to students this academic year — despite previously assuring the court it would do so before the new academic session. The issue stems from a 2013 petition highlighting the failure to provide free uniforms as mandated under the Right to Education (RTE) Act. The High Court has consistently directed that uniforms be supplied physically rather than by transferring money to families. In its latest submission, the Education Department cited 'operational difficulties' and said the matter had been placed before the Council of Ministers. As per the Cabinet decision taken on May 10, 'The Council of Ministers approved the proposal of the Education Department for revision of rates of school uniform for students of Delhi government schools through the direct bank transfer (DBT) mode, due to operational difficulties in providing it in kind.' It added: 'The Council of Ministers further directed the Education Department to approach the Hon'ble High Court of Delhi accordingly.' The government informed the court that students in Classes I-V will now receive Rs 1,250, those in Classes VI-VIII will receive Rs 1,500, and those in Classes IX-XII will receive Rs 1,700. These revised rates, which were notified on June 10, will apply to students in government and aided schools, as well as to children from the Economically Weaker Section (EWS) and Disadvantaged Group (DG) categories studying in private schools under the RTE and Freeship quota. The previous rates of Rs 1,100, Rs 1,400 and Rs 1,500 respectively had remained unchanged since 2017-18. However, the petitioner, Justice For All, a Delhi-based NGO, has argued that the increase is 'meagre' and that the subsidy continues to be misused by families instead of being spent on uniforms. The Directorate of Education told the court that the rates were calculated after a market survey using wholesale prices. A uniform kit at wholesale cost typically includes two sets of clothing, a sweater, socks, shoes, a belt; in the case of girls, it includes a suit or dupatta. While the Cabinet approved the revised figures, the department has said it will continue to disburse the subsidy through the DBT mode for at least one more year. The matter has been listed for hearing in September.

Bombay high court dismisses election petition against BJP legislator R Tamil Selvan
MUMBAI: Observing that the petition comprised vague and generic pleadings, the Bombay High Court on Tuesday dismissed an election petition filed against the victory of Bharatiya Janata Party (BJP) legislator Captain R Tamil Selvan. He won from the Sion-Koliwada constituency in the 2024 Maharashtra Assembly elections. Selvan petitioned the HC for the dismissal of the petition filed by Ganesh Kumar Yadav, the Indian National Congress (INC) candidate who emerged with the second-highest votes. Yadav earlier this year filed the election petition and, through his counsel Premlal Krishnan, challenged Selvan's election on grounds of non-compliance with certain rules and provisions, including those governing valid nominations under Section 33 of the Representation of People (RP) Act. Justice Milind Jadhav, who pronounced the judgment on Tuesday, said, 'It is, however, prima facie seen that the Election Petition comprises vague and generic pleadings and there is a complete absence of material facts.' Krishnan argued that averments in the petition were enough to lay the foundation for the challenge.
