
Court sets June 30 for mention in child kidnapping, car theft case
Magistrate Aini Adilah Muhammad Faizal fixed the date after no plea was recorded from Jaafar Sidek Darus, 63, who was charged with kidnapping the girl from the lawful custody of her biological mother last week.
Jaafar also stole a brown Toyota Corolla with the registration number PBN 2173.
Both offences alleged took place near a service workshop at Jalan Penaga, Kepala Batas about 5.30pm last Friday.
The kidnapping charge was framed under Section 363 of the Penal Code, which provides for up to seven years' imprisonment and a fine, upon conviction.
Deputy Public Prosecutor Siti Marissa Safina Saiful Adli prosecuted.
Earlier, when the charges were read to Jaafar, he appeared confused — initially pleading not guilty, then changing his plea to guilty, and moments later, stating that he was ready to be sentenced to prison.
Due to this inconsistency, the court decided to assess the accused's mental stability before proceeding further.

Duo claim trial to causing mischief with firecrackers
GEORGE TOWN: A coffee shop waiter and a tomyam shop assistant were charged at the Sessions Court here today with committing mischief by burning and throwing firecrackers at a restaurant last week. Khoo Teng Chi, 32, and Joanne Lim, 37, pleaded not guilty when the charge was read to them in Mandarin before Judge Irwan Suainbon. They were accused of commiting mischief by using explosives, namely firecrackers, by burning and throwing them at the premises of Jing Zhang Restaurant & Bar, causing damage and losses amounting to RM34,800. They were accused of commiting the offence at Jalan Pahang here about 5.19am on July 23. The charge, under Section 435 of the Penal Code, carries a naximum 14 years jail and fine. Deputy Public Prosecutor Lee Jun Keong offered bail of RM15,000 for each accused but counself for the accused, Muhammad Zul Zarif Mohd Zakwan, requested the amount to be reduced to RM5,000 each. The lawyer pleaded that his clients were facing financial difficulties and this was their first offence involving mischief. He said Khoo was a coffee shop waiter with a monthly income of RM1,800 and had to support his six-year-old daughter following a divorce. He said Lim assisted her mother in managing a tomyam shop with a monthly income of RM1,000 and had no previous criminal record. The court then allowed bail of RM8,000 each with one surety. The court also ordered the accused to report to the nearest police station once every month and for both accused to not disturb witnesses. The court fixed Sept 2 for mention of the case.

Teacher-warden gets six years' jail, four strokes for assaulting seven boys
SEREMBAN: A hostel warden was sentenced to six years in prison and four strokes of the cane by the sessions court today on 12 charges of physical sexual assault and sodomy involving seven students. Judge Datin Surita Budin handed down the sentence to the accused, Mohd Khairi Fitri Baharom, 38, a teacher at the learning institute, after he pleaded guilty to the charges. According to six of the charges, the accused had committed unnatural sexual intercourse with five children aged between nine and 12 at the time of the incidents. This constitutes an offence under Section 377C of the Penal Code, which carries a minimum sentence of five years' imprisonment and a maximum of 20 years, along with caning. Based on another six charges, the accused was charged with committing physical sexual assault on six children aged between nine and 12. This constitutes an offence under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a penalty of up to 20 years in prison and caning. All the acts were committed at the learning centre in Batu Kikir, Jempol, and at a house in Kampung Rembang Panas, Kuala Pilah, between March 2024 and January this year. In his plea for leniency, lawyer Ahmad Loqman Hakim Ahmad Khairie informed the court that his client is still single and is supporting his ailing mother, and thus requested the minimum prison sentence. Deputy public prosecutors Norazihah Asmuni and Nurul Balkis Zunaidi urged the court to impose an appropriate sentence, given the seriousness of the crimes committed. They said the accused, who was entrusted with responsibilities as a teacher and dormitory warden, should have protected his students but instead committed heinous acts against them. The court ordered the accused to begin serving his prison sentence from the day of his arrest on May 25. It also directed that the accused undergo rehabilitation counselling and be placed under police supervision for a year after completing his prison term.

Ex-car rental operator gets 33 years jail for murder of customer
MELAKA: A former car rental operator was sentenced to 33 years' imprisonment by the High Court today after being found guilty of murdering a woman who had rented a vehicle from him seven years ago. Judge Datuk Anselm Charles Fernandis delivered the sentence to Shamshuri Mohamad, 55, after ruling that the defence had failed to prove his innocence. The prison term will be calculated from the date of his arrest, on June 4, 2018. In delivering his decision, the judge said he had carefully considered the defence counsel's submission, the aggravating factors presented by the deputy public prosecutor, and the victim impact statement provided by the deceased's husband, who had lost his wife and is now raising their two children without a mother's love. Anselm also took into account the fact that the accused is over 50-years-old and is therefore exempted from caning. Shamshuri was charged with murdering 40-year-old Yuliana at a house in Taman Bertam Perdana here, between 10am and 1pm on June 4, 2018. He was charged under Section 302 of the Penal Code, which provides for the death penalty or imprisonment for a term of between 30 and 40 years. If the death penalty is not imposed, the law also prescribes a minimum of 12 strokes of the cane. Earlier, counsel Sangeet Kaur Deo, representing the accused, pleaded for the minimum custodial sentence without whipping, citing that her client suffers from chronic inflammatory bowel disease, hypertension, and diabetes. She also urged the court to consider that this was her client's first offence, that he is married, has been in custody since 4 June 2018, and had voluntarily surrendered to the police on the day of the incident when contacted. Deputy public prosecutor Mohd Firdaus Saleh pressed for the death sentence, citing the violent nature of the offence and the lasting impact of the victim's death on her family. He also noted that the trial, which began on Sept 1, 2020, involved 21 prosecution witnesses and one defence witness — the accused himself.
