Lawyers are not employees of Bar Council: HC refuses to direct for ICC under PoSH
A division bench of justice Ajey Gadkari and justice Rajesh Patil was hearing a public interest litigation (PIL) filed by the Women Legal Association seeking a permanent grievance redressal mechanism to address complaints of sexual harassment against lawyers.
The PoSH Act protects women from sexual harassment in the workplace and provides a mechanism for complaint redressal. It mandates the formation of ICCs in organizations with 10 or more employees to handle such complaints. Under the Act, the employer is responsible for creating a safe working environment, formulating a policy against sexual harassment and establishing an ICC. However, the court held that the provisions of the PoSH Act would not apply to the complaints of female lawyers of the Bar Council of India (BCI) and the BCMG as there was no 'employee-employer' relationship between the lawyers and the bar councils.
'The provisions of the Act of 2013 apply when there is an employee-employer relationship. But in the case of advocates and the BCI or the BCMG, there is no such relationship as neither the BCI nor the BCMG can be said to be employers of the advocates and, thus the provisions of the Act of 2013 will not apply to complaints filed by lady lawyers,' the court said while rejecting the relief.
'It is, however, made clear that the provisions will apply on complaints filed by any of the employees or the committee members of the BCI and BCMG,' the court observed. It added that Section 35 of the Advocates Act provides action against professional or other misconduct by the lawyers. 'This is a remedy available for lady lawyers, to file complaints against any kind of harassment which may amount to professional or other misconduct,' the bench added.

Panel recommends termination of service of Ramjas College prof accused of sexual harassment

(Representative photo) Officials of the Delhi University's Ramjas College on Thursday said that the college's internal complaints committee (ICC) has recommended termination of service of a professor accused of sexual harassment. The file has been transferred to the vice-chancellor's (V-C's) office, and a final decision will be taken by the V-C, they said. V-C Yogesh Singh said, 'I have not looked at the file yet.' The case was reported in December 2024, when a minor student had accused the professor of sexual harassment and filed a complaint with the ICC. 'The ICC has been probing the matter since last December and has recommended termination of his service. The ICC file has been handed to the V-C's office and the final decision now rests upon the V-C's approval,' a senior college official said. On May 20, HT reported that according to a police officer aware of the case details, the first information report (FIR) was lodged on May 7 under sections 10 (aggravated sexual assault) and 12 (sexual harassment) of the Protection of Children from Sexual Offences (Pocso) Act, and sections 74 (outraging modesty of a woman) and 79 (words or gestures to outrage a woman's modesty) of the Bharatiya Nyaya Sanhita. 'The professor complied with our notice to join the investigation and has been legally bound to participate in further proceedings,' the police had told HT in May. Following the complaint, the professor had been asked to stay off campus and not to interact with the students.

HC mandates safety rules for under-construction high-rises
MUMBAI: The Bombay High Court has directed the Maharashtra government to immediately implement safety standards for under-construction, high-rise projects across the state, after taking serious note of recurring accidents at construction sites. The court directed the state urban development department to issue appropriate directives to implement safety measures at high-rise constructions. (Anshuman Poyrekar/HT Photo) The bench of Justice GS Kulkarni and Justice Arif S Doctor was hearing a petition filed by Lokhandwala Residency Towers Cooperative Housing Society, triggered by an accident on February 14, 2023. During the construction of a high-rise project, 'Four Seasons Private Residences Phase I and Phase II' in Worli, by Provenance Land Pvt Ltd, a large cement block had fallen from the 52nd floor, killing two people. The petition stated that it can never be countenanced that innocent lives are lost by objects falling from a suspended crane at an enormous height, which persons on the ground may ordinarily not notice. The court observed that if the right of a person to move freely, in places that are not actual construction sites, are threatened by the fear of being killed or hurt, it would result in violation of their fundamental right to life. It was against such a backdrop that the court observed the need to urgently devise measures so that accidents like this would not take place. One of the issues raised was whether there was any mechanism for the inspection, approval or certification of the operation of such cranes or constructions by a recognised specialised agency, which may be appointed by the developers. Following this, the court on August 7 appointed an expert committee to recommend special safety measures for construction work at considerable heights. Included in the ambit were high-rise projects by public bodies for projects such as the metro rail, flyovers and bridges, which could place pedestrians, motorists or the residents of adjoining buildings at risk in the event that an object falls from such a height. While appointing the committee, the court took into account an August 5 accident, where an iron rod from an under-construction metro rail site in Bhiwandi in neighbouring Thane district fell on a moving autorickshaw and pierced a 20-year-old passenger's skull. Senior Counsel for the Brihanmumbai Municipal Corporation (BMC), Narendra Walawalkar, on August 12 submitted a copy of the report of the expert committee, which stated that Mumbai now boasts several high-rises above 100 metres, 181 above 150 m, 47 above 200 m and 24 buildings above 250 m. It was observed that the tallest building at the time of submitting the report was 'Lokhandwala Minerva', which was 301.60 m. It highlighted that another 416 buildings were under construction, all ranging from a minimum 150 m in height to 331 m. The report observed that despite construction technology specific to tall buildings being adopted by the city's construction industry, there was still a violation of safety measures by developers and contractors. It noted that mishaps and accidents occurred due to lack of rules regarding accidents specific to high-rise constructions. The report also stated that adjacent plots and nearby areas such as roads, gardens and parking areas are affected by incidents such as falling debris and breakage of construction equipment etc, which endanger the premises and the lives of residents and pedestrians. Stating that the report is of immense public interest, the court ruled that it needs to be implemented in letter and spirit by the BMC, to form part of the building permissions being granted in respect of high-rise constructions. The same needs to be implemented by all other planning authorities where similar high-rise constructions are being undertaken. The court directed the state urban development department to issue appropriate directives to implement the recommendations of the report by all municipal corporations and other planning authorities undertaking high-rise constructions or constructions at substantial heights.

PM Modi On 2-Day Gujarat Visit From August 25, To Inaugurate PMAY Houses
Ahmedabad: Prime Minister Narendra Modi will be on a two-day visit to Gujarat from August 25, during which he will inaugurate 1,449 houses and 130 shops built under the Pradhan Mantri Awas Yojana (Urban) here at a cost of Rs 133.42 crore, officials said. Inauguration of houses under the PMAY will be one of the programmes that PM Modi will attend during his two-day visit, an official statement said. "Under the in-situ slum redevelopment component of the PMAY (Urban), the PM will inaugurate the rehabilitation work of a total of 1,449 houses and 130 shops constructed at a cost of Rs 133.42 crore in sector-3 of the slum popularly known as Ramapir Tekra in Sardar Patel Stadium ward of the West Zone of Ahmedabad city," it said. This project has been carried out under the Slum Rehabilitation and Redevelopment Policy-2013 of the Urban Development and Urban Housing Department of the Gujarat government. Across Gujarat, under the PMAY (Urban), 9.66 lakh houses have been sanctioned against the target of 7.64 lakh, with construction of about 9.07 lakh houses already completed, the statement said. From 2025-26, the Gujarat government has introduced an additional assistance of Rs 50,000 per house at the roof-cast level under the PMAY (Rural), fully funded from the state's share, it said. "This support is aimed at helping beneficiaries achieve the 2024-25 housing targets as well as future goals. So far, 34,759 beneficiaries have received assistance amounting to Rs 173.80 crore under this provision," it said. Under the Gujarat government's 'Mukhyamantri Protsahak Sahay Yojana', beneficiaries who complete house construction within six months of receiving the first instalment are given an additional incentive of Rs 20,000. So far, 74,930 beneficiaries have received assistance worth Rs 149.86 crore under this provision, it said. To support women in households, the state government also provides an additional Rs 5,000 per beneficiary for bathroom construction along with housing. "Till now, 82,845 beneficiaries have availed this benefit, amounting to Rs 41.42 crore. In addition, beneficiaries are eligible for Rs 25,920 for 90 days of employment under the MGNREGA and Rs 12,000 for toilet construction under the Swachh Bharat Mission. In total, each beneficiary is entitled to assistance of Rs 2,32,920 under this scheme," it said. Within three months of the central government announcing the Affordable Rental Housing Complexes (ARHC) Scheme in 2020 -- which aims to provide affordable rental housing for the urban poor and workers -- Gujarat became the first state to receive project approval by converting 393 houses into rental units in Surat city, according to the statement. Gujarat is also one of six states selected by the central government to implement the Light House Project under the Global Housing Technology Challenge (GHTC). In Rajkot, 1,144 houses have been built using monolithic concrete construction technology with tunnel formwork, it said. Under the PMAY (Rural), from 2016-17 to 2024-25, the central government set a target of 8,43,168 houses, of which 6,00,932 have been completed, it said. For the spill-over target of 2,78,533 houses in 2025-26, as many as 39,092 have been completed between April 1 and August 20, 2025, while 2,39,441 are under construction and scheduled for completion by March 2026, the release said. From 2016-17 to August 20, 2025, a total expenditure of Rs 8,936.55 crore has been incurred under the scheme.
