Punish Isham with jail, fine for attacks on judges, court told

KUALA LUMPUR : The prosecution has called for former Umno Supreme Council member Isham Jalil to be punished severely for his comments on judges in ex-prime minister Najib Razak's various 1MDB-related cases, saying the statements he made were unfair and scandalous.
Deputy public prosecutor (DPP) Mustaffa P Kunyalam told the High Court that the contents of Isham's interview – published on social media on Sept 30, 2023 – risked undermining public confidence in the administration of justice.
'We want this court to impose a fine or jail (sentence) or both, as the contemnor (Isham) has failed to purge the contempt,' he said in submissions before Justice K Muniandy.
Last year, the attorney-general rejected representations lodged on Isham's behalf seeking that he be allowed to offer an unreserved apology in exchange for the proceedings coming to an end.
Mustaffa, who was assisted by DPP T Deepa Nair, said Isham had launched scurrilous attacks on trial judges Nazlan Ghazali, Collin Lawrence Sequerah and a Federal Court bench chaired by Chief Justice Tengku Maimun Tuan Mat.
'The actions mentioned above constitute interference in the administration of justice,' he added.
Filed on Dec 28, 2023, the application concerned statements Isham allegedly made during an interview titled 'Townhall for justice: Keadilan sebenarnya untuk siapa? (Who is justice for?)'.
The interview was published on Facebook on Sept 30, 2023 via an account known as Malaya Post.
In an affidavit filed in support of the leave application, Mustaffa claimed Isham had during the interview commented on Najib's 1MDB and SRC International trials, and the Federal Court's conduct of the final appeal in the latter case.
Isham is also alleged to have accused Sequerah and Nazlan, who presided over the 1MDB and SRC International trials, respectively, of bias. He allegedly said the judges ought to have withdrawn from hearing the cases.
Both judges now sit in the Court of Appeal.
According to Mustaffa, Isham also claimed that the five apex court judges, led by Tengku Maimun, who heard Najib's final appeal in the SRC International case, had judged the case unfairly.
Lawyer Azhar Azizan Harun, appearing for Isham, said the prosecution had failed to prove their case beyond a reasonable doubt as there was a material contradiction between the attorney-general's affidavit and statements made by a Malaysian Anti-Corruption Commission (MACC) officer and a court deputy registrar.
He said the dignity of judges no longer needs protection, unlike in medieval England when judges were representatives of the king.
'In the present democratic system, the people are the king,' he said, adding that the offence of scandalising the court is to protect against interference in the administration of justice.
He said in the modern UK, no contempt proceedings were initiated even when the media had criticised judges.
Azhar, who was assisted by Jamie Wong, said Isham's action did not create chaos in society.
'The people did not demonstrate to express they were unhappy with the SRC verdict, nor did anyone throw shoes at judges,' he said, adding that the judges had to be resilient in accepting criticism from public-spirited individuals.
'We now live in a social media age where everyone wants to be a star of their own show. Gone are the days when one had to be invited by RTM for an interview,' he added.
Azhar said what Isham had uttered outside the courtroom was a repeat of what lawyers for Najib had said in court, albeit in temperate language.
He said Malaysia should adopt the UK's approach of finding that contempt is no longer a species of scandalising the court.
'Freedom of speech as guaranteed under the Federal Constitution should be given priority,' he added.
Muniandy will deliver his ruling on July 1.

At a gathering of Teoh's family and civil society groups tonight, A Jayanath of Saya Anak Bangsa Malaysia issued a blunt message to politicians who once stood with the family as they sought justice. 'During a protest for Teoh in 2009, many politicians from the opposition were then present. But tonight I don't see any of them. 'This is something all of us need to understand – politicians will make use of any issue (for their own benefit),' he said at the Kuala Lumpur and Selangor Chinese Assembly Hall here, where the participants gathered to remember Teoh and demand accountability. Jayanath challenged those who once pledged support for Teoh to reflect on their role now that they are in government. He added that many of them had pledged to introduce institutional reforms once in power and ensure justice is served for Teoh. 'I am only making a very short speech — one call to these politicians. Tomorrow morning, can you please look at yourself in the mirror and ask what you are going to do about this? 'We have not seen (your efforts), and we are giving you one last chance to (ensure justice for Teoh).' Jayanath also called on those attending the gathering to take action by writing to their respective MPs and assemblymen to urge them to raise Teoh's case in Parliament or the state assemblies. Last week, the Teoh Beng Hock Association for Democratic Advancement urged all DAP ministers to resign in protest of the Attorney-General's Chambers' decision to classify the investigation into Teoh's case as requiring no further action, or NFA. The group said the ministers should also take responsibility on behalf of DAP for failing to fulfil the party's past promises involving Teoh. None of the DAP ministers have responded to the call yet. Teoh's sister, Lee Lan, also did not hold back in her remarks at the gathering, delivering a strong and emotional message to government leaders. 'Back then, all PH leaders told Malaysia that Teoh was murdered and that when they attain power, they will act on the case. 'But why was the investigation classified as NFA? This is a slap in the face for all PH supporters.' She also reminded Prime Minister Anwar Ibrahim that he had promised to ensure justice for Teoh once appointed to the top post. Last month, Teoh's family was informed by police that their latest investigation into the case had been classified as NFA. Teoh was found dead on July 16, 2009 on the fifth floor of Plaza Masalam, Shah Alam, after being questioned for hours by the Malaysian Anti-Corruption Commission (MACC). An inquest was held and the coroner returned an open verdict. However, the Court of Appeal in 2014 ruled that Teoh's death was caused by 'one or more persons unknown', including MACC officers. While the police's latest investigation was classified as NFA, several quarters have questioned why the probe was launched under Section 342 of the Penal Code, which is for wrongful confinement.

(Reuters pic) TOKYO : Bank of Japan governor Kazuo Ueda said today the country's economy can withstand the hit from US tariffs and sustain a cycle of rising inflation accompanied by wage growth, signalling the bank's readiness to raise interest rates further. 'Uncertainty over US trade policy and the range of tariffs imposed by President Donald Trump's administration could hurt Japan's exports, prod firms to delay capital expenditure plans, and discourage them from raising wages,' Ueda said. 'While an agreement between the US and China to scale back reciprocal tariff rates is perceived by markets as a positive development, uncertainty over the outlook remains high,' he said. 'Recent tariff policies will exert downward pressure on Japan's economy through several different channels,' Ueda said in a speech. 'That said, we expect that Japan's economy can withstand such downward pressure, as historically high corporate profits serve as a buffer,' he said. He also said Japan's tight labour market means the economy will likely sustain a trend in which wages and prices rise in tandem – a key prerequisite for further rate hikes. 'While underlying consumer inflation will stagnate temporarily, there is no change to the BOJ's view that it will gradually rise toward its 2% target,' Ueda said. 'Although developments in trade policies since early spring have had a larger impact on Japan's economy than we had expected, progress towards achieving our price target continues to gain momentum,' he added.

Bursa ends lower amid US tariff concerns

KUALA LUMPUR : Bursa Malaysia erased early gains to close lower for the sixth consecutive day today, weighed down by selling pressure in regional emerging markets due to concerns over the ongoing US tariff conflict, said an analyst. Rakuten Trade Sdn Bhd equity research vice-president Thong Pak Leng said key regional indices closed mixed amid uncertainties surrounding US president Donald Trump's tariff war, prompting cautious investor behaviour. European equities slipped at the open due to weak sentiment and in anticipation of upcoming eurozone inflation figures. In contrast, markets in China and Hong Kong rallied on hopes of renewed US-China trade talks. On the domestic front, market sentiment remains subdued as investors adopt a wait-and-see stance amid ongoing foreign selling and escalating global trade uncertainties involving the US. The benchmark index is currently near its psychological 1,500 support level. 'Despite these challenges, we view this as an opportunity to pick up blue-chip stocks at lower prices due to their strong fundamentals, attractive valuations, and appealing dividend yields. 'As such, we anticipate the FTSE Bursa Malaysia KLCI (FBM KLCI) to trend within the 1,490-1,520 range for the week,' Thong told Bernama. Meanwhile, UOB Kay Hian Wealth Advisors Sdn Bhd head of investment research Sedek Jantan said market caution has intensified amid growing fears of a tariff-driven global slowdown and weakening external demand. Although the US has extended a pause on tariffs for certain Chinese goods until Aug 31, tensions have flared after Beijing rejected US accusations of breaching the existing tariff truce, instead blaming Washington for backtracking. 'A potential call between Trump and Chinese president Xi Jinping this week may offer much-needed clarity on the future direction of trade relations,' he said. Locally, Malaysia's manufacturing purchasing managers' index edged up to 48.8 in May from April, but remained below the 50-point threshold, signalling continued contraction. 'Weak new orders and declining output reflect persistent demand weakness. 'As a trade-reliant economy, Malaysia remains vulnerable to global trade disruptions, with export-oriented sectors, particularly industrial products, technology, and small-cap stocks, most exposed to downside risks,' Sedek added. At 5pm, the FBM KLCI eased 5.10 points, or 0.33%, to 1,503.25 from last Friday's close of 1,508.35. The benchmark index opened 4.37 points higher at 1,512.72 and moved between 1,497.42 and 1,514.12 throughout the trading session. Market breadth was negative with decliners thumping gainers 705 to 297, while 423 counters were unchanged, 921 untraded and 15 suspended. Turnover fell to 3.04 billion units valued at RM2.20 billion compared with last Friday's 3.21 billion units worth RM5.04 billion. Bursa Malaysia was closed yesterday in conjunction with the official birthday of Yang di-Pertuan Agong Sultan Ibrahim. Among the heavyweights, Petronas Chemicals dipped 14 sen to RM3.28, QL Resources fell 10 sen to RM4.40, IHH Healthcare eased 15 sen to RM6.75, Press Metal dropped nine sen to RM4.95, and Hong Leong Financial Group lost 28 sen to RM16.30. Among active stocks, Permaju Industries eased 0.5 sen to one sen, ACE Market debutant ICT Zone Asia, Tanco, and Harvest Miracle Capital were flat each at 20 sen, RM1 and 18 sen respectively, and MyEG slipped three sen to 89 sen. On the index board, the FBM Emas Index trimmed 45.35 points to 11,254.45, the FBMT 100 Index lost 38.28 points to 11,022.72, and the FBM ACE Index sank 69.22 points to 4,481.81. The FBM Emas Shariah Index decreased 46.10 points to 11,210.15, while the FBM 70 Index retreated 59.35 points to 16,142.16. Sector-wise, the financial services index slid 77.90 points to 17,762.63, the industrial products and services index shed 2.57 points to 150.08, and the energy index fell 9.08 points to 698.96, but the plantation index increased 11.03 points to 7,218.88. The Main Market volume declined to 1.21 billion units worth RM1.90 billion against Friday's 1.88 billion units valued at RM4.82 billion. Warrants turnover expanded to 1.50 billion units valued at RM201.92 million from 1 billion units worth RM111.49 million previously. The ACE Market volume advanced to 323.10 million shares worth RM94.99 million versus 318.43 million shares worth RM107.68 million on Friday. Consumer products and services counters accounted for 270.72 million shares traded on the Main Market, industrial products and services (184.66 million), construction (76.45 million), technology (139.98 million), SPAC (nil), financial services (85.81 million), property (164.11 million), plantation (29.49 million), REITs (11.64 million), closed/fund (3,400), energy (106.55 million), healthcare (57.20 million), telecommunications and media (43.34 million), transportation and logistics (18.57 million), utilities (31.21 million), and business trusts (20,700).
