KUALA LUMPUR: The Attorney General's Chambers (AGC) has filed a notice of appeal against the High Court's decision to dismiss its committal proceedings against former Umno information chief Isham Jalil. The proceedings were related to Isham's public remarks under his full name, Hizatul Isham Abdul Jalil, on the 1Malaysia Development Berhad (1MDB) case involving former prime minister Datuk Seri Najib Tun Razak. Isham's lawyer, Jamie Wong, confirmed that her team received an email with the attached notice of appeal from the AGC on Tuesday (July 15) night. "We received the email along with a cover letter from the AGC at 7.28pm," she said. On July 8, judge K. Muniandy dismissed the committal proceedings, ruling that Isham's comments did not pose a real risk of undermining public confidence in the judiciary. The proceedings arose from statements made by Isham during an interview titled "Townhall for Justice: Keadilan Sebenarnya Untuk Siapa", in which he allegedly made remarks concerning the trial and appeal of Najib in the SRC International and 1MDB cases. The remarks were subsequently published on the Facebook page of The Malaya Post on Sept 30, 2023. The AG contended that Isham's remarks included a challenge to the recusal process involving Justice Datuk Collin Lawrence Sequerah (now a judge of the Court of Appeal), who had presided over the 1MDB trial in the High Court. The AG further asserted that the respondent's statements had the effect of scandalising the judiciary and were capable of eroding public confidence in the integrity and impartiality of the judicial institution. - Bernama

FORMER UMNO supreme council member Isham Jalil seems to have struck the chord with many man-on-the-street Malaysians as he rallied 'original UMNO' members to turn up in full force at the July 26 Turun Anwar gathering in Dataran Merdeka, Kuala Lumpur. His killer line that has inadvertently enabled the PAS-initiated rally gained even more momentum was that the issues to be raised at the Turun Anwar rally 'are of the same proportion if not bigger than ICERD' for they revolve around the livelihood and well-being of every ordinary Malaysian. 'At least the issues raised during ICERD only centred on our identity and had no bearing on bread and butter matters such as how to put food on the table,' he articulated with zest in a Facebook video which has since fetched 25K likes, 1.9K comments, 3.2K shares and 435K views. '(The) current leaders couldn't care less, they go overseas negotiate while the country is saddled with billions in debts.' The former UMNO information chief who was fired from the party on Dec 7, 2023 for disagreeing to cooperate with DAP in elections further called on the UMNO grassroots to toughen up in the event UMNO slaps them with disciplinary action. 'If UMNO wants to sack you, so be it as I've long been fired not to mention threatened to be thrown in jail,' he pointed out in a fiery tone. 'Don't tell me you guys are unable to withstand little pain … We should gather in full force … Make it like ICERD when UMNO members gathered in the millions.' Jointly organised by PAS and UMNO, the Dec 8, 2018 ICERD rally was staged to protest against the then Pakatan Harapan (PH) administration's move to ratify the International Convention on the Elimination of All Forms of Racial Discrimination as it was alleged such ratification was contrary to the Federal Constitution. Added the once special officer to incarcerated former premier Datuk Seri Najib Razak: Therefore, we need to show our utmost dissatisfaction to them with our protest … I know many of you disagree with the UMDAP alliance but are unable to voice your protest for fear of getting sacked from the party. Ex-Umno man Isham Jalil acquitted of contempt

KUALA LUMPUR : The High Court here has acquitted former Umno Supreme Council member Isham Jalil of contempt over remarks on Najib Razak's 1MDB-related cases. Justice K Muniandy said the prosecution failed to prove that Isham's statements, made in late 2023, posed a real risk of interference in the administration of justice. 'The claim that the administration of justice was derailed or sullied by the statements does not hold water,' he said. Muniandy also said the allegation that Isham's statements had scandalised the judiciary appeared untrue. Filed on Dec 28, 2023, the application to cite Isham for contempt concerned statements he allegedly made during an interview titled 'Townhall for Justice: Keadilan Sebenarnya Untuk Siapa' published on Sept 30 through a Facebook account known as Malaya Post. In an affidavit filed in support of the leave application, deputy public prosecutor Mustapha Kunyalam claimed that Isham had commented on Najib's 1MDB and SRC International trials, and on the Federal Court's conduct of the final appeal in the latter case. Isham allegedly accused Justices Collin Lawrence Sequerah and Nazlan Ghazali of bias and said they should have withdrawn from hearing the cases. Sequerah is presiding over Najib's 1MDB trial in the High Court while Nazlan was the judge who convicted the former prime minister in the SRC case. Both Sequerah and Nazlan now sit in the Court of Appeal. Mustapha also said Isham had claimed that the panel of five judges, led by former chief justice Tengku Maimun Tuan Mat, who heard Najib's final appeal from his conviction and sentence in the SRC case, had judged the case unfairly. According to the affidavit, the statements made by Isham could undermine the public's confidence in the judiciary and could be considered as interference with the administration of justice. Muniandy ruled that the attorney-general had not discharged the burden of proof in the case before him, adding that criticism levelled by Isham against the courts' various decisions were within reasonable limits. He said the law of contempt was not designed to protect judges or their dignity but to ensure that the administration of justice was not obstructed. 'As judges, we must stand resilient in the face of adversity and criticism, for the scales of justice must never be swayed by external pressures,' he said. He said that when delivering judgments, judges not only decide cases but also reinforce public trust in the judiciary, proving that even in the most emotionally charged circumstances, the pursuit of truth and application of law can, and must, prevail. 'The most effective way for the judiciary to dispel unwarranted criticism and defend its integrity against scurrilous attacks is through the delivery of judgments that are undeniably fair, just and deeply rooted in the principles of law,' he said. Muniandy said while Article 10 of the Federal Constitution allowed for free speech, the right was not absolute and came with inherent limitations, including contempt of court. 'While freedom of speech is the cornerstone of democracy, its exercise must respect the vital function of the judiciary. However, (the contempt process) should be reserved for where there is real risk of undermining the administration of justice,' he added.
