
Former Dublin county registrar drops appeal in neighbour extension case
Former Dublin county registrar Rita Considine has dropped her appeal of a judge's dismissal of claims she brought against her next-door neighbours over an extension to the neighbours' home.
Last December, Judge Jennifer O'Brien in the Dublin Circuit Civil Court
threw out the case
, criticising Ms Considine's 'unnecessarily aggressive, threatening and litigious approach' in her dispute with Michael and Anne Flanagan, and their daughter, Sinead.
Ms Considine had sought damages for negligence, trespass and nuisance against the retired couple and their daughter, the legal owner of her parents' home 'at an address in Dublin'.
On Tuesday, the first of several scheduled hearing days in Ms Considine's High Court appeal, her senior counsel James Dwyer informed Ms Justice Sara Phelan that the appeal was being withdrawn.

In the circumstances, the judge made an order affirming the decision of the Circuit Court. She said not having to proceed with the appeal was probably the 'most appropriate manner of dealing with things'.
The judge also made an order for costs in the appeal in favour of the Flanagans.
Mr Dwyer had submitted to the judge that there should be no order on costs.
Ted Harding SC, appearing with Eamon Marray SC for the Flanagans, said costs should be awarded to his side. He noted that Ms Considine's side waited until Tuesday's hearing before withdrawing the case, and put 'great cost' on his clients.
Granting an order for costs to the Flanagans, Ms Justice Phelan said she was of the view that Ms Considine's side had 'ample opportunity' to withdraw the appeal before Tuesday's hearing date.
Ms Considine, the current county registrar for Limerick and Clare, brought the Circuit Court case against her neighbours in November 2021.
In the proceedings, she claimed she entered into an agreement with the defendants in 2019 whereby she would not object to planning permission to their planned extension.
In return, she was told there would be no trespass on her property, all work would occur within the curtilage of the neighbours' property, a mature evergreen hedge between the properties would not be damaged and windows would be moved so they did not overlook her property.
Judge O'Brien ruled that there had been, at best, an 'understanding between neighbours' about how to proceed. She quoted the late SC Paul Anthony McDermott's book, Contract Law, which stated that 'generally good neighbours will assist each other without ever imagining that they are creating legally binding relations'.
Demolition and excavation work began in June 2021 and, after damage was noticed to a boundary wall, a meeting was held between representatives of the two property owners and an agreement reached.
Ms Considine claimed the agreement was subsequently breached and, among other matters, that the work carried out by her neighbours led to damp in the garage that she and her husband used as a home gym and utility room.
In their submissions, the Flanagans described as 'inexplicable' Ms Considine's refusal to engage in mediation, and said she and her husband had sought to 'weaponise their legal experience'.
In her judgment, Judge O'Brien said she was satisfied 'that [Ms Considine] adopted an unnecessarily aggressive, threatening and litigious approach from the outset'.
'The court accepts the contention proffered by the defendants that the plaintiff's conduct in this matter shows a determination on her part to pursue the claim to trial. This is a most unfortunate approach to take to any dispute, least of all a dispute between neighbours,' said the judge.

Highest number of domestic violence disclosures in 50 years is ‘just tip of iceberg' says Women's Aid
Women's Aid received the highest number of disclosures of domestic violence and abuse in its 50-year history last year, with more than 41,000 women reporting abuse by their partner or ex-partner, and more than 5,000 reporting abuse of children. The 2024 figure for disclosures, up 17 per cent on 2023, included reports of assaults with weapons, constant surveillance, relentless put downs and humiliations, taking and sharing of intimate images online, complete control over all family finances, sexual assault, rape and being threatened with theirs or their children's lives. Five women, the report notes, died in violent circumstances in 2024. The number and nature of the abuse disclosures is 'utterly appalling' but is 'just the tip of the iceberg', said Women's Aid chief executive Sarah Benson. 'Fear, stigma and the debilitating impact of the abuse itself, but also persisting social attitudes to domestic violence, prevent victims from coming forward.' Domestic violence must be tackled by champions across society and men are needed 'to lead as allies in prevention of male violence'. Women's Aid, she said, is concerned about the 'inconsistent' response from members of An Garda Síochána to record numbers of domestic violence and abuse contacts, including more than 65,000 contacts to the force last year. While there was 'excellent progress' in areas such as the National Protective Services Bureau, 44 per cent of women said they found the gardaí response unhelpful when they sought support. Specialist training regarding domestic abuse and stalking must be a 'core part' of training for all members, not just those in specialist units. Young women, Ms Benson noted, are reporting very high levels of intimate partner and other forms of gender-based violence. A continuing increase in online or technology-facilitated gender-based violence showed the harm of online pornography but there is 'little meaningful accountability' for online platforms and perpetrators. The report said the housing crisis and issues with the family and criminal law processes adversely impact on the ability of victim-survivors to access justice and safety, with greater challenges for those with disabilities and migrant backgrounds. One in three women in contact with Women's Aid services were being subjected to domestic abuse from their ex-partner, said Eavan Ward, the organisation's head of regional services. Separating from a controlling and abusive partner is difficult and a time of heightened risk, she said. Many women needed to access the courts about children's matters but the 'prolonged, costly and disempowering' family law system 'is failing many women and children'. The process often results in unsafe custody and access arrangements which disregard the impact of domestic abuse, including coercive control on children, she said. The annual impact report for 2024, published on Wednesday, discloses that Women's Aid national and regional frontline services were contacted 32,144 times in 2024, up 12 per cent on 2023. There were 46,765 disclosures of incidents of domestic violence and abuse – 41,432 against women and 5,333 against children – up 17 per cent on 2023. Allegation of sexual abuse rose by 30 per cent, physical abuse by 22 per cent, emotional abuse by 15 per cent and economic abuse by 5 per cent. Specialist services are 'overstretched and underfunded' and resourcing by Government and implementation of the Third National Domestic, Sexual and Gender-Based Violence Strategy remains 'crucial' to effectively reduce the scale and impacts of violence against women and children in Ireland, the organisation said. The final implementation plan for that strategy, published on Tuesday by Minister for Justice Jim O'Callaghan , sets out 95 actions, including expansion of refuge accommodation.

Two injured in serious incident on ship at Foynes Port, Limerick
Two people are understood to have been injured following a serious incident on board a ship docked at Foynes Port, Co Limerick , on Tuesday night. The incident occurred shortly after 7pm. Sources said gardaí and emergency services, including fire and rescue as well as HSE paramedics, rushed to the port as part of a major emergency response to a serious incident. A Garda spokeswoman said: 'Gardaí are currently at [the] scene following a report of an incident on a ship in Foynes Port, Limerick this evening. READ MORE 'Gardaí are assisting ambulance services at scene and dealing with a number of injuries. There are no further details, at this time.' Exact details of the incident were initially unclear, although locals had reported seeing emergency service personnel in and around the Bow Hercules, a registered oil and chemical tanker. The was no visible signs of the vessel being in distress in the water. The Cork Air Ambulance, officially known as the HSE Air Ambulance, emergency medical helicopter, based in Rathcoole, Co Cork, was part of the emergency response at the port. It landed at the port at about 8.15pm and was believed to have brought one person to Cork University Hospital. Another is believed to have been brought to hospital by road ambulance. The emergency helicopter service operates as part of the National Ambulance Service, providing rapid response to critical medical emergencies in the southern region of Ireland. The helicopters are equipped with advanced medical equipment and are staffed by specialist paramedics and an emergency medical technician. The Foynes Port Authority has been contacted for official comment.
