Diddy juror points to where defense ‘poked holes' in prosecution's case to get racketeering acquittal

Fox News09-07-2025
A jury of his peers found rapper Sean "Diddy" Combs not guilty of the most serious charges he had been facing on July 2.
On that day, the jury told the courtroom the government had not proven the disgraced music mogul participated in a racketeering conspiracy or sex trafficking. However, Diddy was found guilty on two counts of transportation to engage in prostitution.
An alternate juror, who presented his badge to Fox News Digital for confirmation, explained where Diddy's defense had "poked holes" in the prosecution's case.
"I mean, there were always moments where there was, you know, when the defense really was able to get in," the juror told Fox News Digital. "I mean one that really stood out for me… I even wrote it in my notes, was the cross-examination of Dawn Richard. But Miss Westmoreland, you know, her cross-examination of her, and even Bana. I mean… she definitely poked holes. I think that's why they had her do that, but just to see how she did it, it really was something just to behold."
Former Danity Kane singer Dawn Richard testified that she told Diddy's ex-girlfriend, Cassie Ventura, to leave the rapper after witnessing him physically assault the musician. Diddy and Richard were in the recording studio when he allegedly said that what was witnessed the day before was "passion" and what people in relationships do. He claimed Cassie was OK and that it was best if they didn't say anything. The rapper allegedly said that where he's from, people go missing. Richard heard his words to mean that people end up dead.
Diddy's attorney, Nicole Westmoreland, brought up inconsistencies in Richard's multiple interviews with prosecutors. The defense attorney also highlighted the fact that the singer hadn't disclosed Diddy's alleged threat against her life until a week before the trial.
"It was a death threat that you didn't recall on seven different occasions?" Westmoreland questioned.
Diddy's defense also intensely cross-examined Bryana Bongolan, a friend of Cassie. Bongolan, who sometimes went by the nickname "Bana," testified that Diddy dangled her off the ledge of a 17-story balcony. During cross-examination, Westmoreland was able to get Bana to admit she couldn't remember details of the alleged incident.
WATCH: DIDDY'S DEFENSE 'POKED HOLES' IN PROSECUTION'S WITNESS TESTIMONY, ALTERNATE JUROR SAYS
The alternate juror, who listened to seven weeks of testimony but did not participate directly in deliberations, did note that he would have "reached the same conclusion that the jurors had made" on the racketeering charge.
He also praised both sides for being "at the top of their game" in the Southern District of New York, describing the SDNY as the "top district" and "the place for trials."
"It was really like a movie," the juror said. "Just as a witness who's never been, you know, who's never been really in the court, never been a juror… never followed the courts or never done any of this stuff, just to be there and watch that and how they conducted themselves was very memorable."
WATCH: DIDDY 'DODGED A BULLET' BEATING RICO CHARGE IN SEX TRAFFICKING TRIAL, EXPERT SAYS
Diddy was "always very engaged" throughout the trial, according to the juror.
"You could tell that he was fighting the whole time. He was always writing notes whenever there was a cross-examination. He was taking notes, giving them to the lawyer. So, I found that to just be all very interesting."
The rapper's presence never "intimidated" the alternate juror, who said he'd never seen Diddy or followed his music.
"So, just to see him in person every day with his white hair was completely different than anything I ever saw," he told Fox News Digital. "So it was definitely memorable in that way. But I never felt intimidated or looked at him as a celebrity in any way to impact impartiality. I was just sitting and just listening to all the evidence that was presented."
Judge Arun Subramanian set Diddy's sentencing hearing for Oct. 3. He could face up to 20 years behind bars, 10 years for each count of transportation to engage in prostitution.
The alternate juror explained he just hopes Diddy gets the help he needs.
"I do think that when they had the opening arguments, they basically presented Diddy as a very flawed individual — a drug addict, a sex addict, a person that has many flaws," the juror recalled. "So I think whatever sentence he's given… I hope that he just gets the help that he needs. If he's in prison, I hope he can get the help that he needs."
He added: "I just hope that he takes that time to just reflect and get the help that he needs."
According to Diddy's defense lawyer, the disgraced music mogul will reenter a program for domestic batterers after he is freed. He had begun the program shortly before his arrest in September 2024.
"He's doing OK," Marc Agnifilo told The Associated Press.
He claimed Diddy genuinely desires improvement and "realizes he has flaws like everyone else that he never worked on."
"He burns hot in all matters. I think what he has come to see is that he has these flaws and there's no amount of fame and no amount of fortune that can erase them," he said. "You can't cover them up."

'Zombies 4' star Sway Bhatia brought out her alter ego of a sassy vampire for hit Disney movie

Disney's popular Zombies franchise has continued with the success of Zombies 4: Dawn of the Vampires (streaming on Disney+), with stars including Milo Manheim, Meg Donnelly, Freya Skye, Malachi Barton and Chandler Kinney. But a notable cast member that joined Zombies 4 is the talented Sway Bhatia, who previously played Sophie Roy, daughter to Jeremy Strong's character Kendall, in Succession, in addition starring in The Mighty Ducks: Game Changers. Bhatia's Zombies 4 character Vera takes to the screen with force. She's sassy, unapologetically her vampire self, and that's something that really appealed to the actor. "I loved how strong-willed she was and how much being a vampire meant to her," Bhatia told Yahoo. "Especially as a young South Asian woman, I think it's so important to show strong female characters in films. So I'm really grateful that both me and Freya's characters were portrayed as that, even Meg and Chandler and Kylee [Russell] are such strong female characters, and I love how confident and independent they are." "I hope people can ... relate to everything that we go through and how we deal with our conflicts. But Vera was a lot of fun to play in that way. I've never played a vampire before, so that was very different for me, for sure, but she was a lot of fun. ... I got to bring out my inner, I guess my alter ego of like sassiness and confidence." Milo Manheim 'predicted' Sway Bhatia's future But being part of the Zombies franchise is a tall order. There's singing, dancing, and of course in Bhatia's case, the acting challenge of transforming into a vampire. "You have to fully use your imagination on how this vampire would be in real life," she said. "So I think it's a lot of fun bringing those characters to life." Bhatia also has a particularly fun moment when she gets to "fang out" with Willa (Chandler Kinney), which is particularly fun to watch. "Especially for me, being a fan of the franchise, that scene with Chandler was one of the coolest moments for me on set ever," she said. "Watching her in the second and third movie was so cool for me, getting to see a woman of colour on screen just be so powerful and such a strong werewolf." "So getting to watch her fang out in front of me and then having to fang out back to her was such a cool moment. And it looked really cool with the SFX added, because doing it without it definitely felt a little bit weird. But I had her there to comfort me." While Bhatia had been a fan of the Zombies films before Zombies 4, Manheim actually predicted her future when she went to the premiere for Prom Pact. When Bhatia met Manheim, he said he would see her in Zombies 4, before the film was even confirmed. Fast forward and the two actors did in fact star alongside each other in the movie. "That was insane. I still think about that all the time," Bhatia said. "I took it as a complete joke, ... and then a year or two later, when I found out I booked it, he texted me because the casting director gave him my number, and he was like, 'Is it true that I told you you were going to be in Zombies 4?' ... Yes Milo, you predicted my future." "So I've always kept an eye out for him, because he freaked me out ever since he did that, but I'm so grateful to have him in my life as a friend now." View this post on Instagram A post shared by Swayam Ranjeet Bhatia (Sway) (@sway_bhatia) Being mentored by 'Succession' cast Before Zombies 4, Bhatia had a number of impressive projects under her belt, with the actor specifically describing her time on Succession as an "unreal" experience. "It was nothing like anything that I've ever experienced as an actor," Bhatia said. "I think getting to work with such an incredibly talented cast and crew was such a blessing, and they had been mentors from the start." "A lot of them didn't have kids when the show started, so I was kind of their first kid before they all ended up having kids. ... Even if I wasn't on set so much, they were all so supportive and they all had a parental instinct with us, because there were only two kids on the entire show, and you know how intense the material is of the show. So they would always have to remind us after every take to never repeat what they're saying, because I was eight years old on the set and there were F-bombs flying everywhere." Specifically when it came to working with Jeremy Strong, who played her father on Succession, Strong had some words of caution for the young actors playing his children. "With Jeremy's method acting, every time we wrapped he would remind us to never do what he does, because he would smoke, drink, and then he would like drown in a pool," Bhatia said. "So he was like, 'Please don't ever repeat anything that Kendall does.'" While Succession was a huge hit, when Bhatia moved into The Mighty Ducks: Game Changers, it was a particularly "special project" for her. "It was sort of my first time having a significant role in a project, and I feel like I grew a lot as an artist, not just as an actor, on that set," Bhatia said. "I learned a lot about what being on a set was really like in the terms of chemistry of actors and chemistry of crew, and what it was like being on set every day for intense hours, and how to play hockey and act at the same time." "But I loved getting to play my character, because I think she didn't fall into any sort of crazy stereotype. She sort of pushed the boundaries of what someone that looks like me can tell story-wise on a set. And I loved how strong willed she was, just like Vera in that sense, and it was just a great experience for me. I learned a lot from the writers and the producers and the directors." While Bhatia has had significant success on screen, she's also working to hone her skills behind the camera, including attending New York University (NYU). "I knew I wanted to do filmmaking and I knew that NYU was the number one film school in the country, and it had such a unique program," she shared."They really want to make you a wholesome filmmaker in the sense of learning every single part of a film set. And to me, that's so interesting. "You can ask literally every Disney employee that I've worked with, I'm the kind of person that wants to know what everyone is doing. ... I learned from so many incredible filmmakers, and I get to bring that knowledge with me to NYU." Bhatia shared that she has two movies in the works right now, taking on a producer role, and she's hoping to move into a project where she can be the director or writer in the future. "My goal is to just sort of grow as an artist and test my limits as an artist," she said. "I'm really excited to kind of just find my voice as an artist, and see how people can resonate with my work, and if people can enjoy the stories that I want to tell."

The Memo: Trump struggles to extract himself from Epstein mire

President Trump is trying, yet again, to climb out of the political mire into which he has sunk over the Jeffrey Epstein scandal. On Wednesday, Trump sought to pin the blame on unnamed Republicans for getting 'duped' by Democrats over the lack of new revelations about the disgraced financier and sexual predator. 'It's a hoax,' Trump told reporters in the Oval Office, where he was meeting with the Crown Prince of Bahrain, Salman bin Hamid Al Khalifa. 'It's started by Democrats. It's been run by the Democrats for four years.' Trump further complained that 'some stupid Republicans and foolish Republicans fall into the net and so they try and do the Democrats' work. The Democrats are good for nothing other than these hoaxes.' Such claims point to a deep level of frustration on the president's part about a controversy that — unusually for him — has left his own base discontented. His anger was also apparent in a social media post on Wednesday morning, where he lamented about a supposed Democratic-pushed 'SCAM' over Epstein. Trump griped that 'my PAST supporters have bought into this 'bull—-' hook, line and sinker.' It remains to be seen whether his appeal to party and personal loyalty will be enough to quell the storm. Trump's strategy cuts against years of speculation on the right that more skeletons were about to fall out of Epstein's closet. Right-wing influencer Laura Loomer and Rep. Lauren Boebert (R-Colo.) have both called for the appointment of a special counsel to look deeper into the Epstein matter. The political problem, in short, is that the Trump administration has delivered far less than they once promised. Staunch Trump allies, including Attorney General Pam Bondi, FBI director Kash Patel and deputy FBI director Dan Bongino had suggested major revelations about Epstein were at hand. In previous years, during former President Biden's administration, Trump's eldest son Don Jr. and future-Vice President Vance had implied there were nefarious reasons why the public had not learned more about Epstein's activities. Epstein had myriad connections to the rich, powerful and politically influential. A deal he struck with prosecutors when he was first investigated almost two decades ago has been widely criticized for its leniency. He pleaded guilty to prostitution-related charges at that point. At the time of his death, he faced new and more expansive charges revolving around the alleged sex trafficking of minors. Trump himself called Epstein a 'terrific guy' in a 2002 New York magazine profile, in which the future president also referred to Epstein's liking of women 'on the younger side.' This was before Epstein had ever been investigated. He and Trump later fell out. Epstein was also acquainted with powerful Democrats, including former President Clinton. Clinton wrote in a book published last year that he found Epstein 'odd' but that he had 'no inkling of the crimes he was committing.' As far as the Trump base is concerned, the expectation that some new information was at hand was stoked anew by a February interview Bondi gave to Fox News. There, she said that Epstein's client list was 'sitting on my desk right now to review.' But earlier this month a joint, unsigned memo from the FBI and the Department of Justice (DOJ) asserted that there was, in fact, 'no incriminating 'client list,'' nor any 'credible evidence found that Epstein blackmailed prominent individuals as part of his actions.' The memo also asserted that Epstein had indeed killed himself in his cell at a New York City detention facility in August 2019. Speculation and lurid rumors have long swirled about Epstein's death. The pouring of cold water on all the speculation about Epstein has created chaos for Trump. Bondi and Bongino were widely reported to have had a confrontation about the issue, and Bongino was rumored to be considering resigning. No resignation has materialized and Trump has backed Bondi. The president did so again on Wednesday, saying that his attorney general had promised to release any further 'credible' information and asking rhetorically, 'What more can she do than that?' Democrats have upped the pressure, with Rep. Ro Khanna (D-Calif.) pushing a congressional measure that would have forced a release of the so-called Epstein files. One Republican member, Rep. Thomas Massie (R-Ky.) backed Khanna's effort. Meanwhile, Speaker Mike Johnson (R-La.) on Wednesday sought to close down perceptions that he was breaking with Trump on the topic. In an interview published the previous day with conservative podcaster Benny Johnson, the Speaker had said Trump 'should put everything out there and let the people decide' the facts on Epstein. But on Wednesday, he told reporters at the Capitol, 'We're for transparency. I'm saying the same thing the president is — that, I mean, you need to have all of the credible information released for the American people to make their decision. We trust the American people. And I know the president does as well.' For now, though, the fire over Epstein has not yet burnt itself out.
