Woman ‘carried shame' for years after Noel Clarke made sexual contact with her, court told

An actor carried a 'deep sense of shame' for years after Noel Clarke made unwanted sexual contact with her while filming an intimate scene, the high court has heard.
Penelope*, a witness in Guardian News and Media's (GNM's) defence to Clarke's libel claim against the publisher, said in her witness statement that the former Doctor Who star got an erection when filming a sex scene with her.
'He was on top of me in the bed,' she said. 'When he first took down his trousers and pants, I felt his penis land on my pubic area. I tried to move myself up in the bed slightly so there would be distance between our genitals, but then his penis was touching me in between my legs right at the entry of my vagina.
'He was so close that I recall being worried in case he moved in further or ejaculated. I don't remember how many takes we did of this scene, in the various camera angles. There may have been four or five takes in each angle. His erect penis remained touching me in the same place throughout all of these takes.'
Philip Williams, representing Clarke, who is suing the Guardian over publications from 2021-2022 accusing him of sexual misconduct, put to her that the incidents could not have occurred as other people would have witnessed them. But Penelope, giving evidence via videolink, said they would not have been able to see. She also rejected Clarke's contention that he was wearing a patch and nylon sock, telling the court he had told her he wanted to 'keep it natural'.
Williams suggested that she did not tell anyone at the time because it did not happen but Penelope told the court it was because she felt 'shock and shame' and 'it was a really horrible thing to experience'.
Writing in her witness statement about the promotion she did for the film, she said: 'I was under an obligation to promote and sell the film. It was not an option to say something negative. For many years after I did not tell people what had happened because I had not come to terms with it myself and I didn't want people to think badly of me. I carried a deep sense of shame.'
Thalia Hambi-Fisher, a choreographer and dance teacher, who also gave evidence on Wednesday, told the court about a business meeting with Clarke the day after he received the Orange rising star award 2009 from Bafta.
'When we had finished the lunch, I got up to go to the bathroom,' she said in her witness statement. 'Out of the blue Noel asked me, since I was going there, to take a photo of my 'pussy' – for him. He said he loved photos of women's vaginas.'
Williams said Clarke had a witness statement by the former EastEnders actor, Nabil Elouahabi, who did not give oral evidence, saying that Hambi-Fisher had flirted with with Clarke on a previous occasion.
Hambi-Fisher denied doing so and when it was put to her that the writer-producer of the Kidulthood trilogy was not attracted to her, she replied: 'Well, he was interested in one part of my body.'
Accused by Williams of 'jumping on the bandwagon', she said: 'I have nothing to gain from this at all.'
The court also heard from Hugh Sherlock, whose witness statement states that he saw Clarke put his hands on the hips of a woman called Isla* while filming in a pub. He said Clarke 'pulled her into him and started saying 'I know what you want, you want my dick inside you'. He started fondling her breasts. She was visibly uncomfortable. Noel looked over at me and said 'that's what they all want, they want my dick inside them.''
Williams accused Sherlock of wanting to 'stick the knife in' because he does not like Clarke. Sherlock accepted that he does not like Clarke but denied that was his motivation for coming forward.
The trial continues.

As the BBC 's Doctor Who, Ncuti Gatwa came under fire when he mysteriously pulled out of his Eurovision hosting duties moments after Israel qualified last month. Now it can be revealed that three days after the actor departed Doctor Who, he spoke at a pro-Palestine demonstration outside parliament. On 3 June, the actor, 32, stood in front of a banner reading ' Gaza: Actions Not Words' and delivered a speech to hundreds of people at the Westminster event, organised by Choose Love – a charity that this week supported Greta Thunberg 's 'selfie yacht' trip to Gaza. Gatwa had withdrawn from his role as a Eurovision Grand Final spokesman just 18 days before his speech at the rally. It has prompted renewed speculation as to his motivation for pulling out of the role and whether the BBC was aware that he would do so if Israel qualified. He had been due to announce the UK jury's points during the live broadcast but was replaced at short notice by singer Sophie Ellis-Bextor, 46. The BBC made the change public only two minutes after Israel qualified for the final – prompting speculation that his withdrawal was a protest. The broadcaster cited 'unforeseen circumstances' as the reason. The timing raised eyebrows, as Israel's contestant, Yuval Raphael – a survivor of the October 7 Nova music festival attack – secured her place in the final that same evening. Gatwa has previously expressed support for the Palestinian cause on social media, sharing images of 'Free Palestine' graffiti and promoting fundraising campaigns. The Rwanda-born, Scotland-raised actor made history as the first Black actor to lead Doctor Who, taking on the role of the Fifteenth Doctor in 2023. However, his tenure ended after just two series, making him the second shortest-serving Doctor in the show's history – only Christopher Eccleston's single-series run was shorter. Gatwa's departure was announced in May 2025, when his character regenerated into Rose Tyler played by Billie Piper, 42, ending his 18-month stint in the Tardis. One attendee at the Westminster rally told the Mail: 'He actually read out the names of deceased Palestinian children from his mobile. 'Ncuti appears unaware that, despite his support for Palestine, he could face serious risks in parts of the Middle East. Given the timing – coming so soon after the Eurovision controversy and his abrupt departure from Doctor Who – his appearance may reflect a belief that his position at the BBC had become untenable.' He was joined at the rally by comedian Alexei Sayle and his former Doctor Who co-star Varada Sethu. Sethu, 33, who played companion Belinda Chandra in Doctor Who, who left the sci-fi show at the time as Gatwa, also spoke at the rally.

Harvey Weinstein has been found guilty of one charge in his sex crimes retrial, after lengthy proceedings in New York. The disgraced film mogul was initially convicted of a criminal sexual act in the first degree and rape in the third degree, in February 2020. However, his 23-year sentence was overturned last year, sparking a three-week retrial in Manhattan. After a second round of hearings, the 73-year-old was convicted of sexually assaulting Miriam Haley. He was also acquitted of a second charge stemming from sexual assault accusations made by Kaja Sokola, with the jury struggling to reach a unanimous verdict on a third count involving Jessica Mann. According to the Guardian, Judge Curtis Farber encouraged them to continue deliberating in the hopes they can find a verdict. Deadline reports that each count of first-degree criminal sexual act carries a maximum sentence of 25 years. Weinstein's previous conviction for sex crimes in New York was overturned last April by the Court of Appeal, after it was ruled that he didn't receive a fair trial in 2020. In September, he was then indicted on new sexual assault charges – but has denied all accusations against him. Earlier today, Weinstein addressed Judge Farber to plead for a mistrial, but was quickly denied. 'This is my life that's on the line, this is not fair,' the former movie producer said. 'I'm not getting a fair trial.' Although the sentencing hearing has not yet taken place, the conviction will be in addition to a 16-year sentence he is yet to serve in LA. Weinstein has been at the center of rape or sexual misconduct allegations from more than 100 people, with some claims dating back to the 1970s. It believed the ad was compliant with the advertising rules but said it removed the ad from the Guardian website. The brand said Price was 46 years old and had a body type that was not usually included in high fashion campaigns, explaining that the average age for editorial models was between 16 and 23. Article continues below Diesel believed the image was a "celebration of Ms Price's sexuality and empowerment and was not objectifying, degrading or sexualising", and "showed Ms Price clearly in control in an active and dynamic pose where she proudly showed off her body and the handbag". Diesel added that Price was "well-known for her exaggerated appearance and larger-than-life personality and her large lips and breasts formed part of her curated public image", and this "exaggerated, eccentric and altered appearance" formed part of the creativity of the campaign. Finally, Diesel said although Price was slender, she had excellent muscle tone and was not unhealthily underweight. ‌ The Guardian said it received a complaint directly about the ad on April 4 and blocked it from appearing again because it did not consider it complied with their policies. Partly upholding the complaints, the ASA said the bikini only partially covered Price's breasts, and it considered the positioning of the handbag, in front of her stomach with the handle framing her chest, drew viewers' attention to, and emphasised, that part of her body. The ASA said: "While we acknowledged that Ms Price was shown in a confident and self-assured pose and in control, we considered that because of the positioning of the handbag, which had the effect of emphasising and drawing attention to her breasts, the ad sexualised her in a way that objectified her. ‌ "We therefore considered the ad was likely to cause serious offence, was irresponsible and breached the Code." The ASA did not uphold complaints about Price appearing to be unhealthily thin, and concluded that the ad was not irresponsible on that basis. The watchdog ruled that the ad must not appear again, adding: "We told Diesel to ensure their future ads were socially responsible and did not cause serious or widespread offence." A key image features model Katie Price, 46, showcasing a body type rarely seen in high fashion, proving that women of all shapes and ages deserve representation. The photo celebrates confidence and empowerment without objectification. "Shared in over 100 countries, it has not received any regulatory complaints, highlighting Diesel's commitment to respectful, inclusive storytelling."
